HomeMy WebLinkAboutOrd 1853ORDINANCE NO. 1853-2010 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BURLINGAIVIE AMENDING SECTION 6.04.240 OF THE BURLINGAME MUNICIPAL CODE TO ADD AN EXEMPTION FROM THE CITY'S BUSINESS LICENSE TAX FOR PERSONS ENGAGED IN THE BUSINESS OF PROVIDING GOODS OR SERVICES TO NON-PROFIT ORGANIZATIONS WHICH PROVIDE ACTIVITIES TO THE YOUTH OF BURLINGAME The City Council of the City of Burlingame finds as follows: Section 1. Factual background During the past year, the City has received complaints from numerous non-profit groups which provide activities and/or services to the youth of Burlingame, regarding the business license requirement for their providers of goods and services. Many of these non-profit groups receive goods and services at reduced rates from their suppliers. The requirement of a City business license upon the suppliers of goods and services increases the cost of those goods and services to the non -profits, thereby negatively affecting their cost to provide the variety and level of services and activities to Burlingame youth. Over the past months, the City has discussed amending the ordinance to provide a limited exemption to the business license tax requirement to assist these non-profit organizations: The Council finds that exempting from the City's business license tax those businesses supplying goods and services to the non-profit organizations which provide activities and/or services to the youth of Burlingame, would benefit the health, safety and welfare of the City of Burlingame. Such exemption would allow these non-profit organizations to utilize more of their resources for the enhancement of the youth services, activities and , programs which they provide to the youth of Burlingame thereby benefiting all Burlingame citizens. NOW, THEREFORE, the City Council of the City of Burlingame does ordain as follows: Section 2. Amendment to Burlingame Municipal Code section 6.04.240 A new subsection (g) is added to section 6.04.240 of the Burlingame Municipal Code to read as follows: "(g) Nothing in this title shall be deemed or construed to require the payment of a license tax by any person engaged in the business of providing goods or services to a non-profit organization that provides activities to the youth of Burlingame, or who conducts or officiates any recreation program or activity provided or sponsored by a legal, non-profit organization that provides services to the youth of Burlingame; provided however, that any and all persons providing goods or services to other organizations that are not explicitly exempted by this chapter are still required to obtain a business license and pay the annual tax." Section 3. The City Clerk is directed to publish this ordinance as required by law.
