HomeMy WebLinkAboutOrd 18641 2 3 4 s 6 7 s 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2s 29 30 31 32 ORDINANCE NO. 1864-2011 ORDINANCE OF THE CITY OF BURLINGAME AMENDING THE BURLINGAME MUNICIPAL CODE AND THE ZONING MAPS INCORPORATED IN TITLE 25, THE ZONING CODE BY ESTABLISHING NEW ZONING DISTRICTS AND RECLASSIFYING PROPERTIES WITHIN THE BOUNDARIES OF TH BURLINGAME DOWNTOWN SPECIFIC PLAN The CITY COUNCIL OF THE CITY OF BURLINGAME does hereby ordain as follows: Section 1. In 2010, the City Council adopted the Burlingame Downtown Specific Plan to provide a framework for future development within the downtown area. This ordinance implements the Downtown Specific Plan by establishing new zoning districts and reclassifying properties within this area to implement the vision of the plan. Section 2. The establishment of new zoning districts and reclassifying properties to implement the Downtown Specific Plan were considered as an implementation program contained in the Downtown Specific Plan. The potential environmental impacts of implementation of the Burlingame Downtown Specific Plan were reviewed in Mitigated Negative Declaration No. ND -555-P. This document determined that with mitigation, no adverse environmental impacts would result from implementation of the policies and programs outlined in the Downtown Specific Plan, and the Mitigated Negative Declaration and plan were approved by the City Council on October 4, 2010 by Resolution No. 73-2010. There is no new information or significant development which has occurred in this area since the approval of the Mitigated Negative Declaration which would result in a change in this determination. Section 3. The zoning maps attached to Ordinance No. 539 as amended and referenced in Section 25.12.010 of the Municipal Code are amended as follows: 1. From the C-1, First Commercial District to the CAC, Chapin Avenue Commercial District: The area between EI Camino Real and Primrose Road, on both sides of Chapin Avenue, excluding those properties which front on Primrose Road. 2. From the Cw 1, First Commercial District to the BAC, Burlingame Avenue Commercial District: The area between EI Camino Real and California Drive, on both sides of Burlingame Avenue, properties on the westerly side of Primrose Road between the R-4 zoned properties on Bellevue and Fox Plaza Lane; properties on the west side of Donnelly between Donnelly and Burlingame Avenue, and along the east side of Lorton between Burlingame Avenue and Howard Avenue. 3. From the C-2, Second Commercial District to the BAC, Burlingame Avenue Commercial District: The area between Lorton Avenue and California Drive, and between Bellevue and Burlingame Avenues. From the C-1, First Commercial District to the DAC, Donnelly Avenue Commercial District: The area on both sides of Donnelly Avenue between Primrose Road and Lorton Avenue, except the property on the southwest corner of Lorton and Donnelly, and the adjacent property which extends from Burlingame to Donnelly Avenues; and Property along Primrose Road between the R-4 zoned property south of Bellevue and Burlingame Avenue. 5. From the C-2, Second Commercial District to the DAC, Donnelly Avenue Commercial District: The area on the west side of Lorton Avenue between Bellevue Avenue and Donnelly Avenue. 6. From the C-1, First Commercial District to the HMU, Howard Avenue Mixed Use District: The area between EI Camino Real and California Drive, and Fox Plaza/City Hall Lanes and Howard Avenue, except the east side of Lorton Avenue; and the area on the south side of Howard Avenue between EI Camino Real and Highland Avenue, except the property on the southeast corner of Howard and EI Camino Real. 7. From the C-2, Second Commercial District to the CAR, California Auto Row District: The area on both sides of California Drive between South Lane and Peninsula Avenue, 8. From the C-2, Second Commercial District to the MMU, Myrtle Mixed Use District: The area between the Caltrain railroad right-of-way and Myrtle Road, and between Burlingame and Bayswater Avenues, on the east side of Myrtle Road between Howard and Bayswater Avenues, and between the railroad right of way and Anita Road, between Bayswater and Peninsula Avenues. 9. From the R-3, Multiple Family Residential District to the MMU, Myrtle Mixed Use District: The area on the south side of Burlingame Avenue between East Lane and Myrtle Road, and the property on the northeast corner of Howard and Myrtle Avenues. 10. From the C-2, Second Commercial District to the 114, Multiple Family Residential District: Property on the southwest corner of Bayswater and Highland Avenues, and on the northeast corner of Peninsula and Highland Avenues. 11. From the CA, First Commercial District to the BMU, Bayswater Mixed Use District: The area between Howard and Bayswater Avenues and Primrose and Park Roads, except the properties fronting on Howard Avenue; properties on the south side of Bayswater between EI Camino Real and Park Road; and properties on the east side of Park Road between Bayswater and Peninsula Avenues. From the R-3, Multiple Family Residential District to the BMU, Bayswater Mixed Use District: The area on the east side of EI Camino Real between Howard Avenue and Peninsula Avenue. 13. From the R-4, Multiple Family Residential District to the BMU, Bayswater Mixed Use District: The property on the northeast corner of Bayswater Avenue and Park Road. 14. From the R-4 Multiple Family Residential District to the C-2, Second Commercial District: Two properties on the south side of Douglas Avenue, west of California Drive. These reclassifications are generally shown on Exhibit "A" of this ordinance. These reclassifications shat be effective upon the effective date of the City ordinance establishing the zoning regulations for the BAC Burlingame Avenue Commercial, HMU, Howard Mixed Use, MMU, Myrtle Mixed Use, DAC, Donnell. Avenue Commercial, CAC, Chapin Avenue Commercial, and CAR, California Auto Row Districts. Section 4. This ordinance shall be published as required by law.
