HomeMy WebLinkAboutOrd 1866ORDINANCE NO.-, 1866-2011 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AMENDING SECTION 3.28.010 OF THE BURLINGAME MUNICIPAL CODE TO REVISE THE NUMBER OF MEMBERS OF THE BEAUTIFICATION COMMISSION FROM SEVEN COMMISSIONERS TO FIVE COMMISSIONERS Section 1: Findings WHEREAS, the City established the Beautification Commission in 1968 to provide recommendations to the City Council regarding all matters related to City trees and heritage trees within the City with the goal of enhancing the City's urban forest; and WHEREAS, with the exception of the Planning Commission, all City Boards and Commissions, such as the Library Board and the Traffic Safety Parking Commission, are composed of five members; and WHEREAS, the Beautification Commission has seven members which has occasionally made achieving a quorum difficult because four members would have to be present at a meeting for business to be conducted; and WHEREAS, in the recent past, the City has been unable to secure a sufficient number of applicants for the Beautification Commission and last year, the City extended the application deadline twice to no avail; and WHEREAS, reducing the number of board members of the Beautification Commission will make the process of recruitment easier. Section Z: Amendment to Municipal Code section 3.28.010 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES ORDAIN AS FOLLOWS: Section 3.28.010 of the Burlingaine Municipal Code, "Organization, Teams of Members, Compensation", is hereby amended to delete the first sentence of the section and to replace it with the following sentence: "There shall be a beautification commission in the city consisting of five (5) members, appointed by the council; their terms of office shall be for a period of three (3) years and until their successors are appointed and qualified." The balance of section 3.28.010 shall remain unchanged. Section 3: Publication The City Clerk is directed to publish this ordinance according to the provisions of state law. Section 4: Severability If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.
