AN ORDINANCE OF THE CITY OF BURLINGAME
AMENDING SECTION 15.14.140 OF THE MUNICIPAL CODE REGARDING
REDUCTION OF POLLUTANTS IN STORM WATER
The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows:
Section 1. Factual Background and Findings.
WHEREAS, Pursuant to the implementation of Clean Water Act, in October
2009, the San Francisco Regional Water Quality Control Board adopted a new Municipal
Regional Permit (MRP) for storm water discharges; and
WHEREAS, the new MRP imposes more stringent requirements for identification
of trash hot spots and implementation of trash control measures by municipal agencies;
and
WHEREAS, the Section
C.10
of
the
MRP
Provision requires that the municipal
agencies reduce trash loads by 100%
by
the
2022;
and
WHEREAS, in addition to pollutant discharges by the general public onto the
roadways, motor vehicles remain a significant pollutant source to local water ways
through load spills onto the roadways; and
WHEREAS, in order to address trash and pollutants dispersion from unsecured
or uncovered vehicles, it is essential to update the City's Municipal Code by requiring
that all materials hauled by any persons over the public streets within the City shall be
properly covered ; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME
DOES ORDAIN AS FOLLOWS:
Section 2. The City Council hereby amends the Section 15.14.140 of the Burlingame
Municipal Code by adding new language to sub -section (d) and
redesignating the existing section (d) language into a new sub -section (e)
as follows:
"(d) All solid waste and recyclable materials hauled by any person over
public streets in the city shall be securely tied and covered during hauling
thereof so as to prevent leakage, spillage, or blowing. No person shall
allow any solid waste or recyclable materials of any kind whatsoever to
leak, blow, or drop from any vehicle on any public street within the city."
"(e) Compliance with Best Management Practices. Where best
management practices guidelines or requirements have been adopted by
the city for any activity, operation, or facility which may cause or
contribute to storm water pollution or contamination, illicit discharges,
and/or discharge of non -storm water to the storm water system, every
person undertaking such activity or operation, or owning or operating
such facility shall comply with such guidelines or requirements as
identified by the Public Works Director"
Section 3. The Public Works Department is directed to take necessary actions to
implement this ordinance.
Section 4. The City Clerk is directed to publish this ordinance in the manner required
by law.

regular meeting of the City Council held on the 21s` day of January, 2014, and adopted
thereafter at a regular meeting of the City Council held on the 3rd day of February, 2014,
