HomeMy WebLinkAboutMin - CC - 2003.04.07BURLINGAME CITY COUNCIL Approved Minutes Regular Meeting of April 7,2003 CLOSED SESSION Mayor Coffey called a closed session to order at 5:37 p.m. in the 2nd floor Conference Room of the Main Library regarding a conference with Labor Negotiator pursuant to Govemment Code $ 54957.6: City Negotiators; Jim Nantell, Bob Bell; Labor Organizations: Police/Fire Administrators; AFSCME; Locals 2190 and 829; IAFF Local 2400; BAMM; Teamsters Local 856; Department Heads; Burlingame Police Officers Association, and Unrepresented Employees. Mayor Coffey adjourned the closed session at 5:54 p.m. STUDY SESSION: a.LAGUNA AVENUE AREA _ STORM DRAINAGE REVIEW A study session was called to order by Mayor Coffey at 6:03 p.m. in the Lane Community Room to present the findings of a storm drainage investigation in the Laguna Avenue Area and to obtain input as well as guidance from Council on the scope and timing of a project to address the drainage issues. Staff will follow-up on citizen comments from the meeting and return to Council with a recommended approach for addressing the storm drainage problem in a study session this summer. Mayor Coffey adjoumed the study session at 6:58 p.m. I. CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. Mayor Mike Coffey called the meeting to order at 7:05 p.m. 2, PLEDGE OF ALLEGIANCE TO THE FLAG Led by Jeffrey Beckham, Veterans of Foreign Wars of the United States 3. INVOCATION Led by Reverend Paul G. Watermulder, First Presbyterian Church of Burlingame. 4. MINUTES Vice Mayor O'Mahony made a motion to approve the minutes of the March 10th Council meeting; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Councilwoman Baylock made a motion to approve the minutes of the March 1Sth meeting, seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. 6. PUBLIC HEARINGS a ADOPTION OF RESOLUTION #35-2003 DECLARING THE CITY GOVERNMENT'S EXPRESSION OF HOPE IN THE SAFE RETURN OF THE MEN AND WOMEN OF THE UNITED STATES SERVING IN THE MIDDLE EAST AND AUTHORIZING THE MAYOR TO PROCLAIM A WEEK IN LATE APRIL OR EARLY MAY AS YELLOW RIBBON WEEK IN THE CITY OF BURLINGAME CA Anderson requested Council consider the proposed resolution declaring the city government's expression of hope in the safe return of the men and women of the United States serving in the Middle East and authorizing the Mayor to proclaim a week in late April or early May as Yellow Ribbon Week in the City of Burlingame. Mayor Coffey opened the public hearing. Councilwoman Janney made a motion to adopt Resolution #35-2003 declaring a week in late April or early May as "Yellow Ribbon Week"; seconded by Councilman Galligan, approved unanimously by voice vote, 5- 0. b. CONSIDER APPROVAL OF AMUSEMENT PERMIT FOR TOWELS CAFE, 1401 BURLINGAME AVENUE CA Anderson requested Council consider approval of an amusement permit for Towles Caf6 for musicians to play during business hours, usually on Sunday afternoons and holiday occasions. Mayor Coffey opened the public hearing. There were no comments from the floor and the hearing was closed. Councilman Galligan made a motion to approve the amusement permit for Towles Caf6; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. 7. CEREMONIAL Burlingame City Council Approved Minutes s96 April 7, 2003 a.PROCLAMATIONS FOR BURLINGAME GIRLS SOFTBALL AND BURLINGAME YOUTH BASEBALL ASSOCIATI ON FOR THEIR CONTRIBUTIONS TO THE CITY OF b BURLINGAME DPR Schwartz presented proclamations to the Burlingame Girls Softball League and the Burlingame Youth Baseball Association for their contributions to the City of Burlingame. b.CITY LABOR ORGANIZATI N CM Nantell acknowledged the City Labor Organizations for their agreement to partner with the City on the budget deficit and forego salary increases in the next fiscal year. 8. PUBLIC COMMENTS Stephen Hazel,2408 Morraine Drive, spoke regarding the yellow ribbons. 9. STAFF REPORTS AND COMMUNICATIONS a. INTRODUCE ORDINANCE TO REVISE EXISTING CONSTRUCTION AND DEMOLITION RECYCLING ORDINANCE DPW Bagdon recommended Council begin adoption of an ordinance revising the existing construction and Demolition (C&D) Recycling Ordinance to incorporate: (1) the addition of roofing projects to the ordinance when the Chief Building Official determines that material from roofing repair or replacement can be diverted; and (2) the exclusion of landfill cover uses from the City's diversion goals. Mayor Coffey requested CC Musso read the title of the proposed ordinance. Vice Mayor O'Mahony waived further reading of the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Councilman Galligan made a motion to introduce the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Mayor Coffey requested CC Musso publish a summary of the proposed ordinance at least five days before proposed adoption. d.INTRODUCE ORDINANCE TO MAKE TO THE UNIFORM TRANSIENT OCCUPANCY TAX CODE Burlingame City Council Approved Minutes 597 April T, 2003 FD Nava requested Council introduce an ordinance to make amendments to the Uniform Transient Occupancy Tax Code. Mayor Coffey requested CC Musso read the title of the proposed ordinance. Vice Mayor O'Mahony waived further reading of the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Councilman Galligan made a motion to introduce the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Mayor Coffey requested CC Musso publish a summary of the proposed ordinance at least five days before proposed adoption. e.INTRODUCE ORDINANCE AND ADOPT RESOLUTION OF INTENTION #48.2003 STATING CITY'S INTENT TO AMEND THE CONTRACT FOR LOCAL MISCELLANEOUS AND SAFETY EMPLOYEES WITH THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (CALPERS) AND THE CITY OF BURLINGAME HR Director Bell requested Council adopt Resolution of Intention #48-2003 to approve an Amendment to the Contract with the California Public Employees Retirement System (CaIPERS). Staff also recommends that the Council review the proposed Ordinance to amend the City of Burlingame's contract with CaIPERS. Both the Resolution of Intention and the proposed ordinance would amend the contract for local miscellaneous members and local safety members to provide two years of additional service credit. Mayor Coffey requested CC Musso read the title of the proposed ordinance. Vice Mayor O'Mahony waived further reading of the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Councilman Galligan made a motion to introduce the proposed ordinance; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Councilman Galligan made a motion to adopt the Resolution of Intention stating City's intent to amend the contract for local miscellaneous and safety employees with the California Public Employees' Retirement System (CaIPERS) and the City of Burlingame; seconded by Councilwoman Janney, approved unanimously by voice vote. IO. CONSENT CALENDAR a. ADOPT RESOLUTION #36-2003 REGARDING WEEDS AND RUBBISH ABATEMENT ON PRIVATE PROPERTY DPW Bagdon recommended Council adopt Resolution #36-2003 setting a public hearing for May 19,2003, for the 2003 Weed and Rubbish Abatement Program on public and private property. b. APPOINTMENT OF PENINSULA LIBRARY SYSTEM ADVISORY BOARD MEMBER Burlingame City CounciI Approved Minutes s98 April7,2003 Librarian Escoffier recommended Council appoint Catherine McCormack as Burlingame's representative to the Peninsula Library System, System Advisory Board, to fill the two-year term formerly held by Jane Dunbar. c. ADOPT RESOLUTION TO APPROVE AGREEMENT WITH THE BURLINGAME AQUATICS CLUB TO CONDUC PRD Schwartz recommended Council adopt Resolution #37-2003 to approve the agreement with the Br"rrlingame Aquatics Club to conduct aquatics programs. d. APPROVAL TO WAIVE BID REQUIREMENTS FOR THE BURLINGAME AOUATIC CENTER'S MAINTENANCE PROPOSAL DPR Schwartz requested Council waive the bid requirements for the Burlingame Aquatic Center's maintenance proposal. N APPROVIN THE PARCEL MAP THAT ESTABLISHES A PUBLIC UTILITY FOR A LOT LINE ADJUSTMENT AT 1544 e. BERNAL AVENUE, LOT 13, BLOCK 55, MAP OF EASTON ADDITION NO. 5 AND PORTIONS OF LOT 5 AND 6. BLOCK 11. RAY PARK DPW Bagdon recommended Council concur with the Planning Commission and adopt Resolution #39-2003 approving the parcel map that abandons and reestablishes a 10-foot wide public utility easement due to a lot line adjustment at 1544 Bernal Avenue. f. ADOPT RESOLUTIONS #40.2003 & 41.2003 SUPPORTING ASSEMBLY CONSTITUTIONAL AMENDMENT NUMBER 10 AND ASSEMBLY BILL 1546 WHICH ADDRESSES PROPERTY RELATED FEES FOR STORM DRAINAGE DPW Bagdon recommended Council adopt the Resolution#40-2003 supporting Assembly Constitutional Amendment Number l0 which addresses property related fees for storm drainage. Also recommends Council adopt Resolution #41-2003 supporting Assembly Bill 1546 which addresses funding for storm water pennit programs and fees. g. SPECIAL EVENT PERMIT - BICYCLE RACE ON BURLINGAME AVENUE. SUNDAY. JUNE 29.2003 CM Nantell recommends Council approve application for a special event permit for the Peninsula Velo Bicycle Club to hold a bicycle race in downtown Burlingame on Sunday, June 29,2003, from 5:00 a.m. to 3:00 p.m. CM Nantell requested Council approve the following requests subject to meeting the police department conditions and providing insurance coverage approved by the city attomey: Burlingame Avenue Merchants Association Sidewalk Sale, Burlingame Art and JazzFestival, holiday decorations and Burlingame Avenue Area Holiday Open House. ADOPT RESOLUTION #42.2003 APPROVING TRANSFER OF FUNDS FOR FISCAL YEAR 2002t03 FD Nava requested Council adopt Resolution #42-2003 to approve the transfer of funds for $9,409 from fund 7 31 -22580 to 737-65 1 80. ADOPT RESOLUTION #43.2003 APPROVING 2OO2IO3 ANNUAL REPORT AND DECLARING CITY'S INTENTION TO RENEW THE BRAODWAY AREA BUSINESS IMPROVRMENT DISTRICT (BID) FOR FIVE YEARS AND TO IMPOSE ASSESSMENTS FOR FISCAL YEAR 2OO3/04 CA Anderson requested Council adopt Resolution #43-2003 approving the annual report and declaring the City's intention to renew Broadway Area BID for five years and to impose assessments for fiscal year 2003104 at same levels and for same programs as 2002103. K. ADOPT RESOLUTION #44.2003 APPROVING SALARY FREEZE FOR CITY ATTORNEY CA Anderson requested Council adopt Resolution #44-2003 approving a salary freeze for the City Attorney. I. ADOPT RESOLUTION #45.2003 ACCEPTING IMPROVEMENTS FOR BROADWAY STREETSCAPE. SOUTHSIDE II99 TO 1 BROADWAY TO J.J.R. CONSTRUCTION DPW Bagdon recommended Council adopt Resolution #45-2003 accepting $ 1,393,875 in improvements for the South Broadway Streetscape project by J.J.R. Construction. m. ADOPT RESOLUTION #46-2003 INCREAS NG THE MEDICAL CONTRIBUTION FOR AFSCME LOCAL 829 AND 2T9O TO $675 PER THE PROVISION OF THE PUBLIC EMPLOYEE MEDICAL HEALTH CARE ACT HRD Bell recommended Council adopt Resolution #46-2003 increasing the City's contribution towards medical premiums effective May 1, 2003 for employees and annuitants covered by the Memorandum of Understanding between the City of Burlingame and American Federation of State, County, and Municipal Employees (AFSCME) locals 2190 and829. n. ADOPT RESOLUTION APPROVING EMENT FOR CITY OF MILLBRAE TO o. PROVIDE CODE ENFORCEMENT SERVICES F TRAVEL TO WASHINGTON D.C. FOR BURLINGAME DEPARTMENT SCHOOL LIAISON OFFICER COP Palmer requested Council approve out of state travel for School Liaison Officer Heather Farber to accompany B.I.S. students on their World Strides trip to Washington D.C. Vice Mayor O'Mahony made a motion to approve the Consent Calendar; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. Burlingame City Council Approved Minutes 600 April 7, 2003 CA Anderson recommended Council approve the agreement with the City of Millbrae under which the City of Millbrae will provide Code Enforcement services to the City of Burlingame. II. COUNCIL COMMITTEE REPORTS Council reported on various events and committee meetings they each attended on behalf of the City. 12.
