Regular Meeting of June 3,2002
1. REGULAR MEETING CALLED TO ORDER
A regular meeting of the Burlingame City Council was held on the above date in the City Hall Council
Chambers. The meeting was called to order at7:04 p.m.by Mayor Mary Janney.
2. PLEDGE OFALLEGIANCE TO THE FLAG
Led by Jerry Arrigoni.

4. MINUTES
Councilman Galligan noted that the name of one of the Eagle Scouts who was presented a proclamation at
the May 20th meeting was Anthony Grijalva, not Marcus Grijalva.
Councilwoman O'Mahony made a motion to approve the minutes of the Council meeting of May 20th as well
as the minutes of the Joint City Council/Burlingame School District Board of Trustees meeting; seconded by
Councilman Galligan, approved unanimously by voice vote, 5-0.
5. CEREMONIAL
a. Ceremonv honorins Burlineame High School Seniors for achievine a 4.0 GPA
Mayor Janney presented several Burlingame High School seniors with a proclamation and congratulated
them on receiving 4.0 grade point averages.
b.Presentation of check to A for Skateboard Park
Lisa Christian from the YMCA showed a brief presentation of the new skateboard park in Millbrae and was
presented a check for $100,000 from the City of Burlingame.
6. PUBLIC HEARINGS
a.CONSIDER ADOPTION OF ORDINANCE #1689 AMENDING THE MASSAGE PERMIT
REOUIREMENTS TO ALLOW THE RELEASE OF THE SURETY BOND FOLLOWING 24
CONSECUTIVE MONTHS OF LAWFUL OPERATION UNDER THE PERMIT

CA Anderson requested Council consider adoption of Ordinance #1689 to reduce the suretybond
requirements for massage practitioners following24 consecutive months of lawful operation.
Mayor Janney opened the public hearing. There were no comments from the floor and the hearing was
closed.
Councilman Galligan made a motion to adopt Ordinance #1689; seconded by Vice Mayor Coffey, approved
unanimously by voice vote, 5-0. Mayor Janney requested CC Musso publish a summary of the Ordinance
within 15 days of adoption.
b. ADOPT ORDINAI\ICE #1688 TO GRANT AUTHORITY TO POLICE DEPARTMENT TO
TOW VEHICLES FROM CITY LOTS
DPW Bagdon recommended Council hold a public hearing to adopt Ordinance #1688 granting the authority
to the Burlingame Police Department to tow vehicles from city parking lots.
Mayor Janney opened the public hearing. There were no comments from the floor and the hearing was
closed.
Councilwoman O'Mahony made a motion to adopt Ordinance #1688 granting authority to the police
department to tow vehicles from city lots; seconded by Councilwoman Baylock, approved unanimously by
voice vote, 5-0. Councilman Galligan requested COP Missel have the police officers keep statistics of the
cars that exceed the 72 hour limit and how many times the cars actually vacate the lot. If it is found that
citizens are taking advantage of the use of these lots, it may be necessary to review the Ordinance. Mayor
Janney requested CC Musso publish a summary of the Ordinance within 15 days of adoption.
c.ADOPT ORDINAI\CE #1684 TO AMEND THE CONTRACT FOR POLICE EMPLOYEES
WITH THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM (CALPERS)
AND THE CITY OF BURLINGAME
HRD Bell recommended Council adopt Ordinance #1684 amending the contract for police employees with
the California Public Employees' Retirement System (CaIPERS) and the City of Burlingame.
Mayor Janney opened the public hearing. There were no comments from the floor and the hearing was
closed.
Vice Mayor Coffey made a motion to adopt Ordinance #1684; seconded by Councilwoman O'Mahony,
approved unanimously by voice vote, 5-0. Mayor Janney requested CC Musso publish a sunmary of the
Ordinance within 15 days of adoption.
d. ADOPT ORDINANCE #1685 AMENDING THE LEAF BLOWER ORDINA}ICE FOR USE IN
PUBLIC AREAS
PRD Schwartz recommended Council adopt Ordinance #1685 to amend the leaf blower ordinance limiting

the hours of operation of leaf blowers to allow City employees to operate leaf blowers within city parks and
facilities at an earlier hour.
Mayor Janney opened the public hearing. Sam Malouf,Tl2 Vemon Way, spoke regarding the nuisance of
leaf blowers.
Councilman Galligan made a motion to amend the leaf blower ordinance by adopting Ordinance #1685;
seconded by Councilwoman O'Mahony, approved unanimously by voice vote, 5-0. Mayor Janney requested
CC Musso publish a sunmary of the Ordinance within 15 days of adoption.
e.Adopt Ordinance #1687 to Amend the Second Unit Amnestv extension for two (2) vears
CP Monroe requested Council hold a public hearing and take action on the proposed extension of the Second
Unit Amnestyresidential program to June 30,2004.
Mayor Janney opened the public hearing. There were no comments from the floor and the hearing was
closed.
Councilwoman O'Mahony made a motion to approve Ordinance #1687 to extend the Second Unit Amnesty
residential program to June 30,2004; seconded by Councilwoman Baylock, approved unanimously by voice
vote, 5-0. Mayor Janney requested CC Musso publish a summary of the Ordinance within 15 days of
adoption.
7. PUBLIC COMMENTS
Constance Cohen, 605 Lexington Way, notified Council that the audio of the Council meeting was not being
transmitted; requested this be fixed. Ron Ward, 500 El Camino Real, spoke regarding parking tickets in
front of his building. Sam Malouf,1426 Burlingame Avenue, requested Council postpone deferring any
funds that may be set aside to help improve Burlingame Avenue.
8. STAFF REPORTS AI\D COMMUNICATIONS
a. Request from Unitv 2000 for Soonsorship of "The Social"
Representatives from "Unity 2000" made a presentation to Council and staff and requested funding for an
event, "The Social" that will be held in Burlingame in July. Council noted they would consider funding this
event at the budget study meeting on June 5,2002.
b. Introduction of an Ordinance revising Municinal Code Sections 13.36 and 13.36.040
establishins one-hour narkine on a portion of Masnolia Avenue that is currentlv two hour
parkins
DPW Bagdon recommended Council begin adoption of the Ordinance to revise Burlingame Municipal Code
Sections 13.36 and 13.36.040 establishing one-hour parking on a portion of Magnolia Avenue that is
currently two hour parking.
Mayor Janney requested CC Musso read the title of the proposed ordinance. Councilwoman O'Mahony
made a motion to waive further reading of the proposed ordinance; seconded by Vice Mayor Coffey,
approved unanimously by voice vote, 5-0. Councilman Galligan made a motion to introduce the proposed
ordinance; seconded by Vice Mayor Coffey, approved unanimously by voice vote, 5-0. Mayor Janney

requested CC Musso publish a summary of the proposed ordinance at least five days before proposed
adoption.
c.Form 394 Application for Transfer of Cable TV Franchise from AT&T Corporation to AT&T
Comcast Cornoration
ACM Becker requested Council set a public hearing for JunelTth and to provide input to staff on content of
authorizing resolution.
Council stressed to Kathy Noe, representative present from AT&T, about their extreme disappointment in
the handling of the request to add the Eternal Word Network to the channel line-up, as well as the horrible
quality of the transmission of the City Council meetings.
Ms. Noe stated she would follow up with Council on several questions posed to her regarding the ability to
televise Planning Commission meetings, the cost to provide service to the residents of Burlingame, and what
can be done about the quality of transmission of the City Council meetings.
A public hearing was set for June l7 ,2002 to discuss the request for change of control of AT&T's cable TV
franchise with the City of Burlingame.
d. Sister City Relationship with Wuiiang. China and Burlingame. California
CM Nantell referred to CC Musso's staff report recommending Council discuss their interest in exploring the
creation of a sister city relationship with Wujiang, China and direct staff accordingly.
It was decided by Council to conduct a survey of businesses and residents of Burlingame to determine their
interest in a sister city in general, and whether or not they would be supportive of a sister city relationship
with Wujiang, China.
e.Chaneine time of Budeet Studv Session Meetine of June 5.2002 and Canceline Julv 15.2002
Regular Council Meetins
CC Musso requested Council change the time of the budget study session on June 5,2002 from 7:00 to 5:00
p.m. and to cancel the July 15,2002 regular Council meeting.
Councilwoman O'Mahony made a motion to approve the change of time of the budget study session on June
5, 2002 and to cancel the July 15,2002 regular Council meeting; seconded by Councilman Galligan,
approved unanimously by voice vote, 5-0.
9. CONSENT CALENDAR
Resolution #62-2002 authorizins transfer of funds to review and update of the Bavfront/Anza
Specific Area Plan
CP Monroe requested Council consider Resolution #62-2002 for transfer of funds from the FY 2001/02
Contingency Reserve to fund staff guided review and update of the Bayfront/Anza Specific Area Plan.

ACM Becker requested Council considering approving Resolution #65-2002 to authorize Mayor to sign
amendment to South Bayside Waste Management Authority (SBWMA) JPA changing fiscal year dates.
Councilwoman Baylock pulled item 9a) for discussion and abstained from item 9b).
Councilman Galligan made a motion to approve the consent calendar; seconded by Councilwoman
O'Mahony, approved by voice vote, 5-0, with Councilwoman Baylock abstaining from item 9c).
10. COUNCIL COMMITTEE REPORTS
Council reported on various events and committee meetings they each attended on behalf of the City.

Councilwoman O'Mahony suggested Ross Bruce, Ken Hously and Vice Mayor Coffey be considered for the
Citizens Advisory Committee for the Bayfront/Anza SAP.
