HomeMy WebLinkAboutMin - CC - 2001.04.02BURLINGAME, CALIFORNIA April2,200l The City Council and Civil Service Commission met at 6:30 p.m. in Conference Room A to discuss the City's newly formed Human Resources Department. Staff provided the Council and Commission with an overview of the challenges associated with recruitment and retention; also provided an overview of programs that they will be reviewing over the next few months to attract and retain employees. The Council and Commission shared their perspectives and provided some additional input in terms of the City's efforts in these areas. The Council thanked the Commission for their continued service and support. I. REGULAR MEETIIIG CALLED TO ORDER A regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at7:00 p.m. by Mayor Joe Galligan. 2. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Gerald Aragoni. 3. ROLL CALL Council Present: Council Absent: Coffey, Galligan, Janney, O'Mahony, Spinelli None 4, MINUTES Vice Mayor Spinelli made a motion to approve the minutes of March 19,2001; seconded by Councilwoman Janney, approved unanimously by voice vote, 5-0. 5. CEREMONIAL MATTERS a. RECOGNITION OF BURLINGAME GH SCHOOL 4.0 SENIORS FOR 2OO1 Sam Johnson, SMUHSD, explained this is one of the opportunities to honor the "best of the best"; the Burlingame High School students who, through hard work and persistence, have excelled in the school system and are prepared to accomplish the goals they set forth. The students honored were: Kimberly Wong, Kristina Cydzlk, Chuck Ou, Debra Mao, Tiffany Noel Allen, and Michael Whooley. Councilwoman Janney noted that as a former member of the San Mateo Union High School District Board of Trustees and three time Board President, she couldn't be more proud of this group of students. 6. PUBLIC HEARINGS Burlingame City Council 31,9 April2, 2001 BURLINGAME, CALIFORNIA April 16,2001 1 REGULAR MEETIN CALLED TO ORDER A regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at7:02 p.m. by Vice Mayor Mike Spinelli. 2. PLEDGE OFALLEGIANCE TO THE FLAG Led by Georgette Naylor 3. MINUTES Councilwoman O'Mahony made a motion to approve the minutes of the Special Council Meeting held March 28,200L; seconded by Councilwoman Janney, approved by voice vote, 4-0-1, with Mayor Galligan absent. Councilwoman O'Mahony made a motion to approve the minutes of the Regular Council Meeting held April 2,2001with one correction under the heading of Council Committee Reports noting she attended a scholarship fundraiser with speaker Joe O'Donohue recalling the recent history of Irish Americans in San Francisco; seconded by Councilwoman Janney, approved by voice vote, 4-0-1, with Mayor Galligan absent. 5. PUBLIC HEARINGS ESTABLISHING CO.MMERCI.+L DESIGN REVIEW IN THE C.l AND C.2 ZONING CP Monroe noted this ordinance was reviewed by the Planning Commission on March 12 andMarch 26,2001, and voted to recommend it to Council for approval. On April 9, the Commission reviewed the changes to the guidebook and also recommended it to Council for approval. The writing of the proposed ordinance has been in the process since May, 2000. The staff report includes a brief summary that indicates when commercial design review is required for new construction applicable to C-l and C-2 zones, for remodeling when changes of 50% of the front facade .or 50linear feet of the street of the building are requested. If frontage of the building on the street is 25 feet or less of the street, no design review will be required. This does not apply to newer replacement awnings. The ordinance establishes five criteria for commercial design review, which is similar to residential design review. The criteria are explained in more detail both graphically and in writing in the revised guideline booklet. All of the current residential design reviewers are also April 16,2001 Burlingame City Council a. SECOND READING AND PUBLIC HEARING FOR AN ORDINANCE DISTRICTS AND CONSIDER IMPLEMEIiTING FEES 320 experienced in commercial work, so the same team will be used for commercial design review. Since the amount of residential design review has dropped by almost 60 per cent since the Planning Commission revised their processing, the design reviewers should not be overburdened. The suggested proposed fee for submittal of commercial design review is $395; $200 for staff review, $75 for the required environmental review and $60 for each public notice with two required. In addition, we will ask the applicant to give a deposit of $500 for commercial design review; design reviewers are paid by the hour and if the project is not referred to design review, the applicant would receive their entire deposit back. CA Anderson noted there is also a provision of the fee schedule that would clarify the way staff time is charged in preparing EIR's; it has been revised to be based on staff time expended with the cap being set at25o/o of the contract cost. Vice Mayor Spinelli opened the public hearing. There were no comments from the floor and the hearing was closed. Councilwoman Janney made a motion to approve the ordinance establishing Commercial Design Review in the C-l and C-2 ZoningDistricts; seconded by Councilwoman O'Mahony, approved by voice vote, 4-0-1, with Mayor Galligan absent. Councilwoman Janney made a motion to approve the Resolution implementing Commercial Design Review fees; seconded by Councilwoman O'Mahony, approved by voice vote, 4-0-1, with Mayor Galligan absent. Councilwoman Janney made a motion to acknowledge the Commercial Design Review Guidebook to be used as a facilitating and implementing tool by Commission, applicants and staff; seconded by Councilman Coffey, approved by voice vote, 4-0-1, with Mayor Galligan absent. PUBLIC COMMENTS Dan Anderson, 728 Vernon Way, noted there are two Burlingame Ordinances that address protected and heritage trees in Burlingame. Burlingame is known as the "City of Trees"; feels it's time to reassess and protect City-owned trees. Feels the City should assess trees on City owned land, especially those in Washington Park, and place those that comply with the definition in the ordinances on a protected tree list. Stressed his desire to have the issue of building a teen center in Washington Park placed on the November ballot so that all Burlingame citizens can have a voice and an opinion on this matter. Mr. Leigh Tanton, Linden Avenue, noted that in 1982 the California Legislature approved second units in R-l areas. In June 1993, research was done by a consultant to retrieve information to complete the housing element; has a second unit that has been there since the war; Planning Department does not have a list of who has been given permits for secondary units from 1940 to 1950. Should not expect the 600 owners of the secondary units to pay $500 for permits. Burlingame City Council 32r April 16,2001 7, STAFF REPORTS AND COMMUNICATIONS a.INTRODUCTION O F AN ORDINAIICE TO ESTABLISH AN AMNESTY PERIOD AND SPECIAL PERMIT PROCESS FOR DWELLING UNITS IN THE R.l ZONE CP Monroe noted the second unit amnesty program is the last of the major programs in the 1994 housing element that needs to be implemented; the results will roll over into the 2001 Housing Element currently being developed. The object of this ordinance is to retain these units that are eligible for amnesty in the housing stock and make them safe and sanitary; they are now non- conforming, but as non-conforming, there is no incentive for the property owner to maintain the units. An important objective is to keep smaller units that would rent for less money and insure the owners are providing safe and sanitary housing. There were approximately 600 second units estimated in the 1994 housing study; the target for the amnesty program is 250 of those 600 units. In 1954, the zoning ordinance changed; up to that date, the City did not prohibit second units in the R-l zone. [n January, 1994, the City adopted a new zoning ordinance that prohibited second dwelling units in R-l zone properties. The amnesty program will apply to the non-conforming units that were built prior to 1954. This Ordinance would apply only to properties in the R-l single-family zone. The parameters of the program are that the program would be effective two years from the date the Ordinance is adopted. For a unit to qualify for the program, it must meet all five affixed criteria; there are no variances or exceptions to these criteria. The property owner must provide one uncovered parking space on site, in addition to required parking for the primary dwelling on the site. No more than two people can live in the second unit, and the owner of the property must live in one of the two units on the site. To qualify for this program, the second unit can be no larger than 650 square feet and the FAR on the total site would have to be met. The second unit would be required to meet all the requirements of the Califomia Health and Safety Code standards for housing. Improvements would be limited to remodeling, however, the proposal does allow for a 30 square foot addition to an existing structure. If an existing second unit in an R-1 zone is intentionally demolished or the primary dwelling unit is demolished for reconstruction, the second unit cannot be replaced. The program is initiated by the property owner. Included in the staff report was a summary of the types of comments and concerns made by the residents regarding second units. There will be no Planning Department fees proposed for this activity; in order to go through this program, two public notices would be required, which cost $35.00 per notice in the R-1 zone. There would also be an hourly fee charged for the building inspector who would have to date the unit and also inspect what improvements or violations need abating. The applicant would have to make a deposit to cover this fee. The Planning Commission considered the proposal, held a public hearing on March 26 and voted to recommend to Council the proposed Ordinance establishing the two-year amnesty program. Vice Mayor Spinelli requested City Clerk Musso to introduce the proposed ordinance to Establish an Amnesty Program and Special Permit Process for Secondary Dwelling Units in the R-l Zone. Councilwoman O'Mahony made a motion to waiver fuither reading of the proposed ordinance; seconded by Councilwoman Janney, approved by voice vote, 4-0-1, with Mayor Galligan absent. Vice Mayor Spinelli noted on item 8a regarding the Burlingame Art and JazzFestival that in one section of the report it states the parking lots will be open, and in another section it states that Primrose, Howard and Park will be closed to traffic, in which case the parking lots behind Burlingame Avenue will not be accessible; stated the Chamber and City needs to address this issue. Councilwoman O'Mahony made a motion to approve the consent calendar; seconded by Councilwoman Janney, approved by voice vote, 4-0-1, with Mayor Galligan absent. 9. COUNCIL COMMITTEE REPORTS Councilwoman O'Mahony attended the ABAG quarterly meeting, the Traffic, Safety and Parking focus meeting, and a C/CAG meeting. Councilman Coffey was out of town for the previous two weeks. Councilwoman Janney attended the "Dad's Count" breakfast, San Mateo Chamber of Commerce meeting, North County Council of Cities Dinner, participated in the Celebrity Heart luncheon, Burlingame Chamber of Commerce board meeting and New Member mixer, SamTrans Board of Director's meeting, and attended the burying of the time capsule.
