HomeMy WebLinkAboutMin - CC - 1999.09.20BTJRLINGAME, CALIFORNIA September 20,1999 CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at 7:00 p.m. by Mayor Mary Janney. PLEDGE OF ALLEGIANCE TO THE FLAG Led by Andrew Walworth ROLL CALL COUNCIL PRESENT: COUNCIL ABSENT: GALLIGAN, JANNEY, KNIGHT, O'MAHONY, SPINELLI NONE CEREMONIAL MATTER Mayor Janney explained that US Filter, operators of our Wastewater Treatrnent Plant, have made a substantial donation to the city for the Village Park children's cottage and programs. She called forward a US Filter representative and presented him with a proclamation recognizing US Filter. Tim Grillo, plant manager, thanked the mayor and noted that US Filter and the city have been in partnership for 27 years; Burlingame was the very first city to establish such a public-private partnership to operate a wastewater treatment plant. He presented the mayor with a large "representative" check showing the donation of $18,250. The mayor also called forward Ross Bowling, Vice President of the Burlingame Lions Club, and presented him with a proclamation naming October l&2 as 'White Cane Days. " MINUTES The minutes of the Regular Meeting of September 8, 1999 were unanimously approved 5-0. PUBLIC COMMENTS Katie O'Brien, resident, spoke in support of council's previous action against spending $4000 for plans for a teen center when the facts were not complete and a site was not known; she supports having a teen center, suggesting a pilot program before planning a bigger building. INFORMATIONAL REPORT ON TEEN CENTER ISSUES Parks & Recreation Director reviewed his memo of Septenrber 16,1999 which recommended council review the report prepared by the Burlingame Together youth group regarding Teen Center issues. Diana Warden, student, explained that the committee looked at several sites and found the preferred site is the Lions Hall building; the size of a teen center should be about 14,000 to 18,000 SF; such a building could be shared with seniors and other recreation programs, as well as with the Lions Club; 1,6 they are not proposing to tear down the existing building but to add to it or remodel like the library or fire station was done; if the concept is approved by council, they will begin fund-raising efforts. Council discussion: commended Diana for her presentation, made him more comfortable with the teens' needs; wonder how much will be the cost of staffing and care of this proposed building; is building an historic building, staff reviewed some of its history, noted it is a city building in a city park, Lions Club has 20 year lease which is up this year and has option to renew the lease; mayor noted the Lions Club has established a committee to address this proposal, the Lions support programs for young people and have been active in Burlingame Together; discussed capital program for the Recreation Center remodeling, has a second floor been considered for Recreation Center to expand, would be very expensive; if city has two recreation facilities can offer more programs; it was suggested we might use mobiles or portable buildings as a start; need to update the recreation facilities plan; we now have a teen coordinator and a teen advisory committee; noted most juvenile crime takes place between 3 and 8 p.m. and a teen center would give students a safe place; the kids will need to determine how to mix ages; Lions Club has made tremendous contributions to children and he was concerned that renting the building was a significant source of income to the club, but have reviewed Lions' budget and the building does not bring in a lot of funds; would like to see city look at use of this building; might consider moving the building and using it as a city museum, then building a new structure on the old site; think we have been shown some options; discussed results of an earlier teen survey, most responses were from middle school kids; noted we are very proud of these young people; noted city will soon have a new "Aquatic Center.' City Manager said staff will discuss with the Lions Club, determine whether this building is an historic site, bring back to council. Mayor would like to see a time line. REOUEST TO USE CITY COUNCIL CHAMBER FOR A CANDIDATE'S NIGHT City Manager reviewed a letter from Glenn Mendelson, Vice President of the Burlingame Homeowners' Association, requesting to use the City Council Chambers for a "Candidate's Night" in October. The date of October 12 was tentatively scheduled. Council noted a conflict on that date and staff will discuss other dates with Mendelson. Councilwoman O'Mahony moved to fund televised coverage of a Candidate's Night on a date to be determined later. Second by Vice Mayor Knight and carried unanimously 5-0. REQUEST FOR COUNCIL REPRESENTATIVE TO THE SCHOOL DISTRICT LIAISON COUNCIL FOR SELECTING A NEW SCHOOL SUPERINTENDENT A letter from the Burlingame School Board asked for council to appoint one representative from the city council or city manager's office to serve on this committee to select a new school superintendent. Mayor Janney said she has asked Councilman Galligan to be the city representative on this committee. Councilwoman O'Mahony moved to appoint Councilman Galligan to this committee. Seconded by Councilman Galligan. Discussion: Vice Mayor Knight said she wouldn't request School Board members to help choose a city manager; this was only a suggestion from the hiring consultant. Councilman Spinelli was reluctant to get involved in school internal affairs. Councilwoman O'Mahony understood concerns but there is a lot of cooperation between the city and the school district, think we should help the school district. The motion carried unanimously 5-0. Burlingame City Council t7 September 20,1999 COMMISSIONER TERM EXPIRATIONS City Manager reviewed his memo of August 30, 1999 which recommended council establish a deadline for applications, unless council wishes to reappoint the incumbent commissioners to Beautification; Civil Service; Parks & Recreation; Traffic, Safety and Parking Commission; and Mosquito Abatement. There are a total of nine commissioner terms expiring on these commissions in the next three months. Vice Mayor Knight believed the newly elected council should get involved in these decisions, others agreed. The filing deadline was set for October 26, 1999. Councilman Galligan moved to set this deadline. Seconded by Councilwoman O'Mahony and carried 5-0 unanimously. PLANNING COMMISSION RECOMMENDATION TO INTRODUCE TWO NEW ORDINANCES AND SCHEDULE PUBLIC HEARINGS: (1) AMENDING FOOD ESTABLISHMENT REGULA- TIONS AND (2) EXTENDTNG DESIGN REVIEW TO NEW STNGLE STORY CONSTRUCTION AND SOME FIRST FLOOR ADDITIONS City Planner reviewed her memo of September 14, 1999, which recommended council direct staff at which meeting council wishes to introduce and set public hearings for each of these ordinances. The Planning Commission has been working for the past year on (1) an amendment to the Food Establishment regulations in the Burlingame Avenue and Broadway coflrmercial areas and (2) on the extension of the current single family second story addition design review process to new single story houses and some first floor additions. The Planning Commission has held public hearings on these ordinances and recommended the two ordinances to the city council for action. Council can schedule both ordinances at one meeting or, because of the complexity, schedule at two separate meetings. Vice Mayor Knight said she would like to participate in restaurant decision before she goes off council. Council discussed: willing to hear both at one meeting; hard issues, should take separately; might hold over for new council member; still see some problems with design review, have only been working on since early this year, no need to rush into this, might be better to separate these items and do food establishments first. Councilman Spinelli moved to introduce both ordinances at the next meeting. Seconded by Councilwoman O'Mahony and carried 3-2, Councilman Galligan and Mayor Janney voting no. CONSENT CALENDAR Councilman Spinelli had a question regarding "a" Laguna Park and whether a tree would be dedicated to Chris Gannis. Councilman Galligan asked about "b" Park offices and whether this should be combined with the locker room remodel and proceed this year. Councilwoman O'Mahony thought it may be a good idea to delay until new comprehensive parks and recreation facilities plan is reviewed. RESOLUTION 104-1999 AWARDING CONTRACT TO JJR CONSTRUCTION FOR LAGUNA PARK PLAYGROUND REHABILITATION - CP 9847 Parks Superintendent's memo of September 9, 1999 recommended council award this contract to JJR Construction in the amount of $48,000 to reirabilitate Laguna Park. a September 20,1999 18 Burlingame Ciry Council d b RESOLUTION 105-1999 REJECTING ALL BIDS - PARK MAINTENANCE BUILDING ADDITION Parks & Recreation Director's memo of September 16, 1999 recommended council reject all bids for the park maintenance building addition. A little less than $60,000 is available to add a small addition to the Parks Division Yard for office area. The lowest bid received was $92,600, far in excess of budgeted funds. The project will be put on hold until next year. c.RESOLUTION 106-1999 REJECTING ALL BIDS - CALIFORNIA/ GROVE STORM DRAIN PROJECT AT CORTEZ. HILLSIDE AND CALIFORNIA - CP 9829 Public Works memo of September 14,1999 recommended council reject all bids received for the project and re-advertise the project. The low bidder did not submit the Addendum No. 1 and protests have been received from two bidders. It is in the best interest of the city to reject the bids and re-bid as soon as possible. RESOLUTION 107-1999 APPROVING ENCROACHMENT AGREEMENT WITH METRO- MEDIA FIBER NETWORK FOR INSTALLATION OF FIBER OPTIC LINES Public Works memo of September 13, 1999 recommended council approve an Encroachment Permit agreement with Metromedia Network to install a fiber optic network in the railroad right-of-way through the city. CANCEL STUDY MEETING SCHEDULED FOR SEPTEMBER 22, 1999 City Manager's memo of September 13, 1999 recommended council cancel the September 22 study meeting. He noted two possible issues for the October study meeting, a tour of teen facilities or a review of the Burlingame Avenue parking study data. f. STREET CLOSURE ON PRIMROSE ROAD FOR ''SAFE STREET HALLOWEEN'' City Manager's memo of September 9, 1999 recommended council grant this request from the Burlingame Rotary Club to conduct its third annual "Safe Street Halloween" event on October 31 from 4:30 to 8:30 p.m. for young children and their parents. s. WARRANTS & PAYROLL Finance Director recommended approval of Warrants 65517 - 66108, duly audited, in the amount of $3,099,262.26 (excluding Library Checks 65637 - 65691); Payroll Checks 119074 - 1 19880 for the month of August 1999 in the amount of $1,227 ,329.60; and Electronic Fund Transfers for the month of August 1999 in the amount of $328, L76.24. Councilman Galligan moved approval of the Consent Calendar. Seconded by Councilwoman O'Mahony and carried unanimously 5-0 by voice vote. COUNCIL COMMITTEE REPORTS Councilman Spinelli reported on the Emergency Services meeting. Vice Mayor Knight attended the AYSO opening day, Criminal Justice Council, reminded council the Legislative breakfast is coming e Burlingame City Council t9 September 20,1999 up soon. Councilwoman O'Mahony attended the CCAG meeting, AYSO opening season, Art on the Avenue, a tour of our new golf driving range, and the first city Beach Cleanup event, she congrat- ulated staff on this event, especially Janice Jagelski from the Planning Department. Councilman Galligan went to the Golf committee meeting with Councilman Spinelli; Broadway kids fair, the Chamber luncheon, a Samceda lunch, a lradership Class and a wonderful city presentation on YzK. Mayor Janney also went to Broadway kids fair, Samceda, the Bay Cleanup, Art on the Avenue, and noted the Police Department has been given an antique vehicle, she asked the Chief to bring it to display to the public before an upcoming council meeting. OLD BUSINESS Vice Mayor Knight said she got a call about continuing noise from night deliveries at Peninsula Hospital; asked the city attorney to look into this. Councilman Spinelli mentioned an earlier complaint from Richard Newman regarding parking on Highland, viewed this area and saw 12 cars parked on the sidewalk, asked the Police Department to attend to this problem. Councilman Galligan thought deliveries at the hospital might be made on the Marco Polo side further away from houses. He also asked about the vacant house on Laguna adjacent to the Chula Vista parking lot. Council- woman O'Mahony also was interested in this site and asked how we could pursue since the property owner is not responding. City Attorney said next step would be to consider getting an appraisal and possible eminent domain procedures. NEW BUSINESS Mayor Janney set a public hearing for October 4, 1999 for an appeal of the Planning Commission decision regarding a proposed condominium project at 1237-L241 Capuchino Avenue. City Planner also noted an appeal hearing request for a determination on Bayfront signage. Hearing was set for October 18, 1999 as requested by the appellant.
