HomeMy WebLinkAboutMin - CC - 1998.11.16BURLINGAME, CALIFORNIA November L6,1998 CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at7 02 p.m. by Mayor Mike Spinelli. PLEDGE OF ALLEGIANCE TO THE FLAG Led by former mayor Vic Mangini ROLL CALL COUNCIL PRESENT: COUNCIL ABSENT: GALLIGAN, JANNEY, KNIGHT, O'MAHONY, SPINELLI NONE MINUTES The minutes of the Regular Meeting of November 2, 1998 were approved 4-0-1, Councilman Galligan abstaining because he was absent from that meeting. CEREMONIAL MATTER - ROTATION OF MAYOR AND VICE MAYOR Mayor Spinelli noted this is the time for the annual rotation of Mayor and Vice Mayor. He recalled important events during his five years on the city council and was especially proud of the live telecasting of city council meetings that started this year; he thanked his wife Ro, the city staff and his fellow council members for their support. He then asked for nominations for mayor. Councilwoman O'Mahony nominated Vice Mayor Mary Janney for Mayor. Nominations were closed and Mary Janney was unanimously appointed as Mayor. Mayor Janney introduced her son in the audience and acknowledged many friends present; she thanked council and pledged herself to building harmony this year; she said she felt deeply honored. She presented former Mayor Spinelli with an engraved plaque signifying his year as mayor. She then asked for nominations for vice mayor. Councilwoman O'Mahony nominated Councilwoman Marti Knight as Vice Mayor. Nominations were closed and Marti Knight was unanimously appointed as Vice Mayor. Former mayor Bud Harrison came forward and congratulated the new Mayor and Vice Mayor. He informed council that Marilyn Short passed away recently and he suggested council consider a tree planting and a celebration of Marilyn's life in the Spring of 1999. Vice Mayor Knight suggested a letter of condolence be sent to the Historical Society recognizing Marilyn's contributions to the Society after council adjourns in Marilyn Short's memory later this evening. 439 Mayor Janney called for a recess at7 20 p.m. for celebration and refreshments in the lobby" The meeting reconvened at 7:45 p.m. with all council members present. PUBLIC HEARING - ORDINANCE 1605 AMENDING CHAPTER 6.30 OF THE MUNICIPAL CODE TO ALLOW A FEE TO BE CHARGED FOR SERVICE UNDER A VALET PARKING PERMIT AND MAKING OTHER CHANGES REGARDING VALET PARKING RESOLUTION 119-98 ESTABLISHING A MAXIMUM FEE FOR VALET PARKING SERVICE UNDER CHAPTER 6.30 OF THE MUNICIPAL CODE City Attorney reviewed his memo of November 10, 1998 which recommended council hold a public hearing and take action. At the last meeting council introduced this ordinance to allow businesses providing valet parking services under a valet parking permit to charge a fee for that service. In September, Il Fornaio Restaurant requested council to consider allowing a fee to be charged for valet parking; our present valet parking ordinance does not allow a fee. After adopting this ordinance, council should adopt a resolution setting the maximum allowed fee to be charged for valet parking; staff suggested a maximum of $7; a business could choose to charge less. The ordinance and resolution would become effective in 30 days. He acknowledged a letter from former mayor Frank Pagliaro who suggested with the parking problems in the area, we should require that free valet parking continue at Il Fornaio. Mayor Janney opened the public hearing. Angie Holman, manager of Il Fornaio, spoke in favor of the ordinance; said neighboring businesses tell their customers that they can get free valet parking at I1 Fornaio; when Il Fornaio instituted valet parking they had hoped the neighbors would contribute toward the costs; she thought it was very unfair to provide free service for neighbors. Councilwoman O'Mahony moved adoption of ORDINANCE 1605. Seconded by Councilman Spinelli. Vice Mayor Knight appreciated Angie's comments and the letter from Frank Pagliaro and asked staff about the variance granted to Il Fornaio; staff noted Il Fornaio replaced a non-conforming restaurant use, so did not require a parking variance. Councilman Galligan looked at the costs for Il Fornaio, noted it is not fair to make Il Fornaio provide parking for all these businesses. Councilman Spinelli thought that Il Fornaio should not have to bear the cost of providing valet parking for neighboring businesses. Council concurred. Mayor Janney called for a vote on adopting the ordinance. The motion carried unanimously 5-0 on voice vote. Councilman Spinelli moved adoption of RESOLUTION 1i9-98 Setting Maximum Fee of $7 for valet parking service. Seconded by Councilwoman O'Mahony and carried unanimously 5-0 on voice vote PUBLIC COMMENTS None CONSIDER COMMISSION ABSENCES City Manager reviewed his memo of November 9, 1998. At the last meeting, council requested staff provide information on commission attendance before it makes appointments to several commissions; the report listed six commissioners who have missed more than one-third of the meetings to date. Novernber 16, 1998 440 Burliugame City Council Also attached was Resolution 16-84 providing for removal of commissioners for absences; he said historically council has communicated with a commissioner when there is an attendance problem. Vice Mayor Knight noted her main concern was that the Park & Recreation Commission had to cancel two meetings because of lack of attendance; two commissioners have missed five of nine meetings this year; these are very nice people but she wondered if we should replace these two commissioners now or wait until the January 1999 goal session when we are scheduled to discuss commissions. Council- man Galligan mentioned that Civil Service commissioners attend employee interview panels and tests throughout the year; there are not that many commission meetings and doing assigned interviews should be considered with attendance; he felt attendance is not the same issue with Civil Service. Councilwoman O 'Mahony noted this is a difficult subject, there are many wonderful applicants who want to serve on commissions; we have rules which state after four absences the position is vacant, we should enforce these rules. Councilman Spinelli agreed, so many people are willing to serve; these commissioners should step aside and allow others to serve. Mayor Janney agreed serious issue; Park & Recreation has some very important projects it is reviewing, such as the high school pool and track, and the new park and driving range. Council referred to the 1984 resolution which stated a commission position was vacant after missing one-third of the meetings or four consecutive absences. There was further discussion; staff asked if council would allow these people to reapply to the commission, noted one of these commissioner's term is expired; Vice Mayor Knight mentioned when she was mayor in 1995 mayors wrote letters to commissioners who were frequently absent. Councilman Galligan noted council is just declaring the commission positions vacant. Vice Mayor Knight moved that the commissioner whose term is expired should be dropped from consideration for reappointment and that two commission positions be considered vacant due to lack of attendance at Park & Recreation Commission meetings. Seconded by Councilman Spinelli and carried unanimously 5-0 on voice vote. CIVIL SERVICE COMMISSION APPOINTMENTS City Manager's memo of November 9, 1998 recommended council make appointments to the Civil Service Commission. There were eight applicants including two incumbents to be interviewed by Councilwoman O'Mahony and Councilman Galligan earlier this evening. Councilwoman O'Mahony said she and Councilman Galligan interviewed several outstanding applicants. They nominated James Delia, and reappointment of incumbents Mike Lennon and Victor Richmond. The nominees were unanimously appointed to the Civil Service Commission. CONSENT CALENDAR Councilman Spinelli questioned item "c" regarding the Gilbreth Pump Station. Staff noted the project scope was underestimated and the job has extended over a year, the consultant's costs have therefore increased and this amendment would cover those costs. Burlingarne City Council 44L November 16, 1998 a RESOLUTION 120-98 AWARDING CONTRACT TO VANGUARD CONSTRUCTION FOR MISCELLANEOUS STORM DRAIN SYSTEM REPAIRS - CP 9827 Public Works memo of November 10, 1998 recommended council approve a contract with Vanguard Construction in the amount of $82,626 for Miscellaneous Storm Drain System Repairs. Public Works memo of November 10, 1998 recommended council approve a resolution accepting easements for traffic signal equipment, water meters, sewer, water, utility and drainage. RESOLUTION 122-98 AUTHORIZING AMENDMENT TO AGREEMENT WITH WIN- ZLER & KELLY FOR GILBRETH ROAD SEWAGE PUMP STATION REHABILITATION - cP 9421 Public Works memo of November 12, 1998 recommended council authorize an amendment to the agreement with Winzler & Kelly increasing the consultant fee from $37,155 to $57,655. APPROVING STREET CLOSURES FOR THE HOLIDAY OPEN HOUSE EVENT ON DECEMBER 4, 1998 City Manager's memo of November 6, 1998 recommended council approve closure of Burlingame Avenue and a portion of Lorton on December 4, 1998 for the Chamber of Commerce and Burlingame Avenue Merchant's Association Holiday Open House event. Police overtime for the event is estimated at $850. The Chamber will provide insurance for the event. REJECT CLAIMS OF (1) ROCHEBELLE TAGOYLO: (2) SUSAN ZAMMITT d c. e City Attorney's memos of November 9 and 10 recommended council deny these claims for (1) damage to an automobile in a collision and (2) damage to an automobile from a tree branch. f. WARRANTS AND PAYROLL Finance Director recommended approval of Warrants 60711 - 61122 (excluding Library checks 60776 - 60831), duly audited, in the amount of $1,571,995.38, Payroll Checks 110735 - IIL847 for the month of October 1998 in the amount of $1,710,385.55 and Electronic Fund Transfers for October 1998 in the amount of $383,612.46. Councilman Galligan moved approval of the Consent Calendar. Seconded by Councilwoman O'Mahony and carried unanirnously 5-0 on voice vote. November 16, 1998 442 Burlingame City Council COUNCIL COMMITTEE REPORTS Councilman Spinelli reported on the Airport Roundtable meeting. Vice Mayor Knight attended a Transportation Authority meeting, she was pleased to note the Broadway Station has been removed from the list of stations suggested for closure; she went to the Doubletree opening and the retirement party for Sandy Nolan. Councilwoman O'Mahony attended a Millbrae City Council hearing on the Millbrae Station SAP; also attended a CCAG meeting. Councilman Galligan said he missed the last council meeting to attend his parent's 50th anniversary party; he went to Senator Kopp's retirement roast, Doubletree opening, a playground opening, Burlingame Together and an RFP meeting on the Driving Range. Mayor Janney went to Convention Bureau and the Doubletree Hotel dedication. OLD BUSINESS Vice Mayor Knight asked why the high school track lights are on all night. Staff said they are supposed to turn off at 10 p.m. Vice Mayor Knight asked what was being built at the corner of Oak Grove and California. Staff said a corlmercial project which had been approved some years ago is finally going up. Vice Mayor Knight also noted in Frank Pagliaro's letter he thought the reason why Burlingame's use of the yard waste program was so low might be because so many residents use gardeners who haul away the yard waste. NEW BUSINESS Councilman Galligan noted boats being stored by the Eucalyptus grove at Oak Grove and the train tracks; Councilman Spinelli said a number of cars with "for sale" signs are also there. Staff is discussing with San Francisco (which owns that property) the use of the land. We cannot enforce on another city's property. Mayor Janney asked that we discuss council reorganization and rotation at the January goal meeting ACKNOWLEDGMENTS Commission Minutes: Senior, October 15; Beautification, November 5; Planning, November 9, 1998.
