TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at 7:00 p.m. by Mayor Mike Spinelli. PLEDGE OF ALLEGIANCE TO THE FLAG nrd by Senior Commission Chairman Bob Jones R.OLL CALL COUNCIL PRESENT: COUNCIL ABSENT: GALLIGAN, JANNEY, K}.IIGHT, O'MAHONY, SPINELLI NONE MINUTES The minutes of the Council/Planning Joint Study Meeting of May 2, L998 were approved after an addition on page 2, first paragraph by Councilwoman Knight about condominium "parking. storage. and open space.' The minutes of the Regular Meeting of May 4, 1998 were approved after correcting a name, Mrike McOueen on page 1 and a change on page 4-, third paragraph by Councilwoman O'Mahony who "reiterated that afourth term on a commission should not be exceeded." On page 6 Councilman Galligan added that he also attended the Itoosevelt School and OLA events with Councilwoman O'Mahony. PUBLIC HEARING - APPEAI. OF DECISION OF PLANNING COMMISSION ON A HILLSIDE CONSTRIICTION PERMIT FOR A NEW HOUSE AT 1523 LOS ALTOS - DENIED City Planner reviewed her memo of May 11, 1998 which recommended council hold a public hearing and take action. The Planning Commission denied this request at its April 27 meeting finding the proposed project will cause loss of distant views from inside neighbor's homes. The applicant, I. Ping [Io, is requesting a Hillside Area Construction Permit in order to replace an existing one story house with a new two story house at L523 Los Altos. The existing house is 2160 SF and will be replaced with a 4348 SF house. Commissioners noted if this project was presented anew it would have to go through design review. Mayor Spinelli opened the public hearing. Mr. and ldrs" Ho told of the need to enlarge their home, noted 16 neighbors suppofr the project, requested approval and introduced their attorney Janet Fogarty" Fogarty presented a leffer with copies of minutes of past council meeting at which a neighboring propefty's hillside permit was approved. She noted the Ho request requires no variances; it meets all city requirements, the only issue is views; asked how you determine view, it appears from previous permits reviewed by city, to be views of the bay; how determine loss of view outweighs need to expand home; in the minutes of the meeting at which the neighbor's hillside permit was approved the council voted to approve it noting the only view lost was of distant hills which would be 34L blocked by trees when the trees grew taller; issue is fairness, a neighbor got his second story and gained a view; with this project they will still have a substantial view; she presented numerous photos of views with the proposed project superimposed; noted neighbors directly across the street support this project. Speaking in opposition were Mike Cohen, James and Marilu Ergun; Fred Hartwell; Yolanda Bonilla; Ron and Loris Moorbrink, all residents of Los Altos Drive; this project affects a very large number of people; architecturai style is not in character of neighborhood; they each presented numerous photographs of views from inside and outside their homes; views are of hills and trees, with this massive house view will be gone; trees are all mature and will not grow much higher; the project is just another monster home; property values rvill decrease if this is built; suggest move house back on iot so it is lower. Fogarty rebutted; design is in eye of the beholder; pictures do not show the true effect; no blank walls on the project; asked that council grant the project. The hearing was closed. Councilwoman Knight was pleased to get copy of minutes from the former meeting; noted she voted against the earlier hillside project, has always been concerned about hillside views; there is evidence that the applicants can extend back on lct. She rno.ied to uphold the planning commission denial. Seconded by Vice Mayor Janney. Discussion on motion: met with attorney, concerned about'./iews, went to house across the street, no view of the bay from second story, only vierv of hills; weirt to rear yards of neighboring houses; saw story poles; noted from yards where the vierrus rrould be lost; view of hills is as significant a view as of the bay; can extend to rear, hillside permit rioes not mean cannot add a second story, but will affect location and design; there is a substantial vierv from the Ergun house if the poles tell story; they can make a second story that better addresses the vierv. The Mayor called for a vote on the motion to uphold the Planning Commission denial which was approved 5-0 unanimously by roll call vote. The City Attorney will bring a resolution reflecting this action to the next council meeting. PUBLIC HEARING - APPEAL OF DECISION OF PLANI-{ING COMMISSION ON TWO VARIANCES AND TWO SPECIAL PERMITSTO-}IAXE AN ADDITION TO A TO REPLACE A GARAGE AT 949 CHIJI-A VISTA - RESOLUTION 45-98 APPROVING SAME City Planner reviewed her memo of April 15, 1998 vrhich recommended council hold a public hearing and take action. Michael and Teresa Garrett, applicants, a.re proposing to make a 39O SF first floor addition to their home and replace their 288 SF garage ivith a new 455 SF one car garage with workroom/recreation area and toilet and sink" They need a side setback variance (3 feet proposed, 4 feet required) for the addition to the house, a lot coverage variance (43^4 percent requested where 40 percent is allowed), a conditional use permit to add a toilet to an accessory structure, and a condi- tional use permit to use an accessory struoture for a l',rorkroom or recreational use. The Planning Commission approved the two variances llut denied the special permits for a toilet and for recreational use of the accessory structure. She responded to council questions about duplex zoning and parking requirements. Mayor Spinelli opened the public hearing. 'Ihe applicants, Teresa and Michael Garrett, noted they love living in Burlingame; want to stay here, need to enlarge and husband needs a workshop area; he May 18, 1998 342 Burlingame City Council works for a construction cornpany and it's dirty work and needs toilet so he doesn't have to come up stairs into house; garage is dilapidated and needs to be replaced; only have one car so don't need larger garage and code requires one coverdd parking space; have made provision for second covered parking space by designing so that removal of interior wall will make garage two car if needed in the future; will add an electric gate and electric garage door opener so it's easier to use parking in future; want glass door to back yard to make recreation use more feasible; need a work space outside of house; requested approval. The hearing was closed. Council discussed; asked about effectiveness'of conCiticn recorded with deed that space can never be used as living area; can title be clouded so garage carulot be used as second unit, yes done by recording resolution of action with the title; could place a monetary penalty, yes by bond. Council- woman Knight and Mayor Spinelli had some concerns about misuse by future owners, but if recorded with deed could accommodate this young couple. Councilwoman O'Mahony moved to uphold the Planning Commission approvals of two variances, for side setback for addition to the house and for lot coverage, and to reverse the Planning Commission and grant the conditional use permits for a toilet in an accessory structure and for a workroom andlor recreational use in an accessory structure by adopti.on of RESOLUTION 45-98 with conditions, noting it is clear the applicants need the space, can only ehter ttre house by the front door; removing the side stairs will widen the driveway and make it more useable for access to the garage, the workroom will be used by two adults to do work they bring home from teaching and job site; present development on site prohibits use as duplex as zoned. Counciknan Galligan seconded the motion. Discussion: agreed removing stairs will widen driveway; need to think of future, not short term need of applicant, what will happen if facilities there in future; kids grow and drive cars, no place to put thern; recreation use different from workroom, recreation implies more intense use; prefer a sink only; need to meet needs of present owners, can't worry about what might happen in 20 years; can approve with toilet if title is clouded. The mayor called for a vote on the motion to approve two variances and two conditional use permits The motion carried unanimously 5-0 on roll call vote. PUBLIC HEAR.ING - APPEAI- OF DECISION OF PLANNING COMMISSION ON AN AMEND. MENT TO A TJSE PERMIT TO INCREASE THE NUMBER OF EMPLOYEES AND HOURS OF OPERATTON FOR A PHYSIOTHERAPY BUSINESS AT 340 LORTON - DENIED City Flanner reviewed her memo of April 15, 1998 which recommended council hold a public hearing and take action. The Planning Commission denied this request at its April 27 , L998, meeting citing too intensive use for the site. Gina LaRocca, spplicant and business owner, is requesting an amendment to the conditional use permit issuerl. in July 1996 for a physiotherapy business in a 374 SF office at 340 Lorton. The amendment is to increase the number of employees from 2 to 5 and to retain the hours of operation, 8 a.m. to 10 p.m., seven days a week. Mayor Spinelli opened the public hearing. Gina LaRocca, applicant, presented a binder outlining her business; she explained her business in detail and described the time spent with clients; said most of her clients walk to her site, they work in the area; noted many of the offices in her building have increased the employees from when they started; she requested approval. She responded to council Burlingame City Council 36J May 18, 1998 questions about scheduling clients; council noted severe parking problems in this area. The hearing was closed. Councilman Galligan noted that with number of clients and people working there he had no problem in allowing this use. Councilwoman Knight disagreed and thought there was need for code enforce- ment to see if people are doing what they have pennits to be doing in these other offices; area is heavily impacted with traffic and parking; would uphold Planning Commission. Vice Mayor Janney glad the applicant is so successful but feel she needs a larger place. Councilwoman O'Mahony commended the applicant on the work she is doing, but this would impact the area; agreed we have a severe parking problem in the area. Mayor Spinelli hoped she could move to another area in city. Vice Mayor Janney moved to uphold the Planning Commission denial. Seconded by Councilwoman O'Mahony and carried 4-1 on a roll call vote, Councilman Galligan voting no. PUBLIC HEARING - APPEAL OF DECISI-ON OUPLAL{NING COMMISSION ON AN AMEND- MENT TO A TAKE-OUT FOOD PERMIT TO ALLQW DEI IVERY SERVICE FROM A RES- TAURANT AT 1108 BTTRLTNGAME AVENUE-.RESQLTTTTON 46-q8 APPROVING SAME City Planner reviewed her memo of April 15, 1998 rvhich recommended council hold a public hearing and take action. Dan Greenstein, manager of Rosti's Restatrrant, is requesting an amendment to the restaurant's take-out food service permit to allow the resfaurant to provide home delivery service. The proposed food delivery service would only be offered in the evening hours; they would add 3 to 5 part time employees to cover the additional business. The Planning Commission denied this request at its April 27 , 1998 meeting, noting this is not an appropriate location for a delivery service. Councilwoman Knight asked about the deiivery service they had used which charged 25 percent. Councilwoman Knight recalled when this resta.rlrant lvent in, thought it was a destination restaurant, not take-out; then agreed if people stop ih to take honie is ok; appreciate good job they do but if they locate on Burlingame Avenue they should not be take-.out or delivery; people are concerned about parking; allowing this would create circumstance vihere drivers would be circling the block 10 times and double parking; increase parking problems; would support Planning Commission denial. Dan Greenstein, applicant representing Rosti's, explained the delivery service charged 25 percent ofthe price ofthe food for delivery, that charge exceeded their margin of profit, it was too expensive so they snrppeC, using it; they now hire "contract" delivery persons, showed sample contract; these drivers are shrdents and are not on his payroll; drivers use Caltrain parking lot to park; contended take-out or delivery was essentially the same thing; he responded to council questions about delivery service. Jean Pratali, Peter Guy, Cliff Woods, Mrs Nannini and Howard Page spoke in favor of granting this reQuest; delivery provides jobs for kids and keeps them busy; takes so long to find a parking space that delivery is a good alternative, other businesses in the area deliver including Rouncl Table Pizza ancl the florist shop; issue is if delivery is allowed to one food business should bi allowed to aii fbod businesses; parking is not an issue, if want to go there will find a place" The hearing was closecl. take-out on Burlingame Avenue; rvould also support. Councilwoman Knight recalled joint study meeting with Planning Commission where we discirssed take-out. Vice Mayor Janney was inclined to approve, noting delivery service only in evening. Mayor Spinelli asked if services such as "meals on wheels" have permits, he also could approve this request. Councilwoman O'Mahony rnoved to overturn the Plaruiing Commission denial and approve this request for an amendment to take out food service permit to add delivery service by adoption of RESOLUTION 46-98 with the added condition thal dellyg{y service shall be limited to evening hours after 5 p.m. and dropping conditions 1 and 4 in the staff report. Seconded by Vice Mayor Janney and carried 4-1 on roll call vote, Councilwoman Kniglrt voting no. PUBLIC HEARING - APPEAL OF DECISION CE PI.ANNING COMMISSION ON A CONDI- TIONAL USE PERMIT FOR EXTENDED HOUF.$ AT A FOOD ESTABLISHMENT AT 1660 BAYSHORE - RESOLUTION 47-98 APPROVING SAME Councilman Galligan excused himself from the discussion and vote because of a possible conflict of interest since he has a business arrangement with the property ov/ner. City Planner reviewed her memo of April 15, 1998 vrhich recommended council hold a public hearing and take action. Edward Khoury, applicant.and restaurant operator, is requesting a special permit to allow a food establishment to operate Monday through Saturday 7 a.m. to 9 p.m. (Code allows hours Monday through Friday, 6 a.m. to 5 p.m. for incidental food business). The Planning Commission denied this request at its April 27, 1998 meeting. Mayor Spinelli opened the public hearing. Ed Khoury; applicant, said the reason he wants to expand hours is because there is a need for a place for hotel and car rental workers in the area to stop for a quick inexpensive dinner; a lot ofadjacent businesses are open after hours, people can eat and beat the traffic by driving later. He responded to council questions. Ronald Rosberg, landlord, spoke in favor; noted Repo Depot in same building is closed at 6 p.m. and there would be plenty of parking available; did not believe a fast food chain would want to locate in this area because there is not enough traffic; he also noted there is a street light out at his corner and should be fixed. Another person spoke in favor. There were no other comments and the hearing was closed. Council members discussed; generally did not see how extending the hours could cause any problems; the area is about 5 percent of the total building; would serve employees in area; no parking problems; oould review in six rnonths; was some concern about opening the area up to other quick stop eateries in this location in the future; pointed out this area is still evolving; suggest attorney revise the ordinance that allows grocery stores to stay open lateii than restaurants. Councilwoman O'Mahony moved to reverse the Planning Commission and approve the request by adoption of RESOLUTION 47-98 with conditions" Motion seconded by Vice Mayor Janney and carried 4-0-1., Councilman Galligan abstaining. Mayor Spinelli called for a brief recess at9:56 p.m. The rneeting reconvened with all council members present at 10:03 p.m. Eurlingame City Council Ji.j3 May tr8, 1998 PUBLIC HEARING - WEED AND RUBBISH ABATEMENT OF PRIVATE PROPERTY - RESOLUTION 48-98 ORDERING REMOVAL OF V/EEDS AND RUBBISH Fublic Works Director reviewed the memo of May 11, 1998 which recommended council hold a public hearing and take action. Each year the city establishes the Weed and Rubbish Abatement Program. Council declared weeds and rubbish a nuisance on April 6, 1998 and staff has surveyed the city and posted property which requires abatement. A list of posted properties was presented to council. After council approves a resolution ordering destruction of weeds and rubbish, staff will notiry the property owners about the deadline for vreed and rubbish removal. All unabated nuisances will be cleared by a city contractor and a lien vrill be placed on the property to recover the removal expenses. Mayor Spinelli opened the public hearing. There wgre no comments and the hearing was closed. Councilwoman O'Mahony moved adoption of RESOLUTION 48-98 ordering removal of weeds and rubbish. Seconded by Councilman Galligan and carried unanimously by voice vote. PUBLIC HEARING - RESOLUTION 40-98 ADOP-.TNG PLANNING COMMISSION RESOLU- TIONS 7-79 AND 5-80 ESTABLISHING OPELLSPA.CE f,I'ANDARDS AND CRITERIA FOR REVIEW AND EVALUATION OF RESIDENTIAL CONDOMINIUM PERMITS City Planner reviewed her memo of May 11, 1998 which recommended council hold a public hearing and take action. One of the major issues of the 1970's was conversion of apartment buildings to condominiums. ln 1974 the council adopteC CrdinarrcE 1015 which defined condominiums and addressed subdivision requirements for condominiums. trn 1979 the Planning Commission adopted Resolution 7-79 whichestablished open space and landscaping standards and in 1980 it adopted Resolution 5-80 which established guideiines and revierv criteria for condominiums. As part of our goal of reviewing and updating all multiple family developrnent regulations it would be appropriate for council to adopt the Planning Commission Resolutions 7-79 and 5-80. At the meeting of May 4, 1998 council asked that the proposed ordinance specifying that commissioners must be registered voters be redrafted to also.clarify that the entire council appoints. Seconded Councilman Galligan and carried unanimously by voice vote.' .: : APPOINTMENTS TO PLANNING COMMISSION., Mayor Spinelli said he and Councilwoman Ifuight intervierved 14 candidates for the Planning Comrnission last Saturday. Councilwoman Knight said they recommended appointment of Joseph Bojues for the three year term, and Anne I(eighran and Stanley Vistica for the two four year terms" She related all their qualifications, talents and interests and felt they would be excellent additions to the Planning Commission. Both regretted the loss of Commissioner Mike Galligan but thought it best for him to retire because of a concern about how it appears to an applicant before the Planning Commission who has to appeal to a council on which a brother of a commissioner sits. Council members regretted losing Mike Galligan, have greet respect for him, his talent and experience, he has served well. Councilman Galligan commented on the good choices for commission; noted he wished Mike had been asked to withdraw his application for reappointment when he notified council earlier. Councilman Galligan moved to approve the three apoointments as recommended. Seconded by Vice Mayor Janney and carried unanimously 5-0 on voice vote. PROPOSED MAKEUP OF BLUE RIBBON COMMITTEE ON TEEN ISSUES Parks and Recreation Director reviewed his memo of May 14 which recommended council review the proposed committee makeup and decide what representatives and which council member to appoint to the comrnittee. The Park and Recreation Commission recommended at its March meeting that council create a Blue R.ibbon Comrnittee to study teen issues. A.t the last meeting council asked staff to propose a list of persons to be appointed to such a committee. Councilwoman Knight suggested having a representative of our library on this committee. Councilwoman O'Mahony suggested asking a representative of OLA or St. Catherine's Schools. The Mayor appointed Councilman Galligan as council's representative. Councilman Galligan moved to approve the committee with additions recommended. Seconded by Vice Mayor Janney atcl carried unanimously. RESOLUTION 50-98 DENYING APPEAL AND REVOKING USE PERMIT FOR OUTDOOR STORAGE AT 970 DAVID ROAD City Attorney reviewed his merno of May 11 which recomrnended council adopt a resolution confirming council decision on May 4, affirming the Planning Commission's revocation of this permit" Councilman Galligan asked about the property across the street being used by the applicant and whether that should be mentioned in this resolution. City Attorney responded the revocation applies only to 970 David. Code enforcement would be pursued on the other property. Councilwoman O'Mahony moved adoption of RESOLUTION 50-98. The Burlingame High School 75th Diamond Jubilee Committee is requesting.to serve alcoholic beverages at an event for 200-250 persons on September 11 at the Recreation Center. Xf ap;:roved, staff recommends certain conditions: 1) only beer and wine be served; 2) only plastic or p'aper cups be used on the patio; 3) signs be posted at the north end of the patio restricting alcoholic beverages to the patio area; 4) all regulations regarding sale of alcoholic beverages be followed; and 5) an off-duty police officer be hired to patrol the exterior of the Recreation Center. Vice Mayor Janney moved to approve the request r',,ith conditions recommended. Seconded and carried unanimously. TENTATIVE CONDOMINIUM MAP FOR TI{REE UNITS AT 51 EL CAMINO REAL Public Works memo of May 13 recommended council concur with the Planning Commission and approve this map subject to conditions. Councilwoman Knight asked about all the letters council received regarding a condominium project on El Camino. Staff responded letters were regarding a project at l}7-lzl El Camino; attorney noted the map action also waives fee if this developer applies for a parking variance within certain time. Councilwoman O'Mahony moved approval of the tentati're condominium map. Seconded by Vice Mayor Janney and carried unanimously. AUTHORIZE STAFF TO OPPOSE LEGISI-ATION IMPACTING VEHICLE LICENSE FEE ryLN REVENUE Finance Director's memo of May 7 , lggl recommended council authorize staff to oppose legislation that would eliminate the vehicle license fee. Fresently we receive over $1 million annually as the city's share of this fee. Councilwoman Knight noted the impact this legislation would have on the city; another example of the state taking money from the city and calling it a tax cut; this came up before the legislative eommittee and they stressed importance of writing letters to editors about this; these funds help pay (,D. h.
