CALL TO ORDER
A duly noticed regular meeting of the Burlingame City Council was held on the above date in the
City Hall Council Chambers. The meeting was called to order at 7:00 p.m. by Mayor O'Mahony

MINUTES
The minutes of the Regular Meeting of March 3, 1997 were unanimously approved.
ING SAME
City planner reviewed her memo of March 8 which recommended council hold a pubtic hearing and
take action. Edwin James Hannay, Rector Motorcar Company, 1010 Cadillac Way, is requesting a
conditional use permit to store automobiles in a 50 feet wide by 363 feet long area on the Caltrain
property *.rt oi the tracks in the 1200 block of Catifornia Drive. The land is owned by the Joint
bo*.rr Board (JpB) and access has been negotiated through the San Francisco Water property. The
JpB is asking that a chain link fence be installed from the city drainage area at the north end to the
Broadway right-of-way between the track and the auto storage area. Cars will be moved in and out
of the toi Ouiing off-plak traffic hours. The area will not be lit nor will loudspeakers be installed.
Sales people may bring customers to the site to look at cars stored there. No sales transactions will
Ue negotiited at the st6rage site and employees visiting the site will park in the storage area or the
Cattrain parking lot. Cars will be delivered to the 1010 Cadillac site and moved to this storage area
by Rectoi .*ployrer. The planning Commission approved this request at its February 24 meeting.
Ii was appealed by a resident who lives near this site. This resident subsequently wrote stating she
would not be present tonight.
Councilwoman Knight asked how cars would be delivered to the site and about security of the
parked cars; staff noted that no car carriers would come to this site. Vice Mayor Spinelli asked
how this parking area would be demarcated.
Mayor O'Mahony opened the public hearing. James Hannay and a JPB representative, Arleen
paton, were present. ttrey displayed photographs of the site; noted improvements would be made

and a fence installed between the track and parking; responded to council questions regarding
security and sign designating private parking. The hearing was closed.
Councilman Harrison moved to uphold the Planning Commission decision and action approving the
application with conditions by adopting RESOLUTION 22-97. Seconded by Councilwoman Janney
The motion was carried unanimously.
PUBLIC COMMENTS
David Hinckle discussed a repoft on a "Sustainable San Mateo County, " copies of which have been
sent to council, planning commission and staff. This report reviewed demographic and social trends
in the county. He would appreciate any comments from council after they have reviewed this
report.
RESOLUTION 23-97 INTENTION TO AMEND CONTRACT WITH PERS AND INTRODUC-
TION OF ORDINANCE 1567 AMENDING THE PERS RETIREMENT CONTRACT FOR
LOCAL MISCELLANEOUS MEMBERS
City Manager reviewed his memo of March 6 which recommended council adopt a resolution of
intention to amend the PERS Retirement contract and introduce an ordinance that will amend the
PERS contract to provide 2 percent at age 55 retirement benefit for local miscellaneous employees
including an extension of the funding period to the year 2011. The cost of this optional benefit is
3.836 percent of payroll effective July 1, 1998. Four employee bargaining groups have agreed to
long-termcontracts which include no salary increase in1997-98 and a l percent reduction inthe
1998-99 salary increase to fund this increased cost. The estimated annual cost of this amendment is
$282,061. This amount will be paid by reduced salary increases in 1997-98 and 1998-99. The
public hearing for this ordinance will be held on April 23, lg97 .
Councilman Harrison then moved to introduce ORDINANCE 1567, request the clerk to read the
title and to waive further reading of the ordinance. The motion was seconded by Councilwoman
Janney. The mayor asked the city clerk to read the title of the ordinance. The motion to introduce
was carried unanimously.
PROACHING PEPPER AVENUE
Public Works Director reviewed his memo of March 10 which recommended council introduce this
ordinance to place a yield sign on Chapin Lane at Pepper Avenue. A resident has requested the
yield sign be installed to avoid conflicts with through traffic on Pepper. The Traffic Commission
has reviewed this request and recommended it to council. The police department investigated the
request and recommends installation of the sign and staff concurs. There are sufficient funds in the
existing maintenance budget to cover the costs.
Councilman Harrison then moved to introduce ORDINANCE 1568, to request the clerk to read the
title and to waive further reading. The motion was seconded by Councilwoman Janney. The city
clerk read the title of the ordinance. The motion carried unanimously.

CONSENT CALENDAR
Mayor O'Mahony noted the presence of Wheelabrator EOS staff (item "b"). Vice Mayor Spinelli
commented on the generosity of the Library Foundation's matching funds for furnishing the library
(item "a").

WAIVING MINOR BID IRREGULARITY - CP 9305
Public Works memo of March L2 recommended council award this contract to OP Contract
Incorporated in the amount of $323,123.51. In January the library furnishing package was
advertised and six bids were opened in February. Staff discovered a minor irregularity in
OP Contract's bid form; on the base bid line OP indicated their base bid plus all alternates.
Staff recommended waiving this irregularity because it was not to their competitive advan-
tage, did not benefit them monetarily and would not justify withdrawal of the bid.
COOPERATIVE
public Works memo of March 11 recommended council authorize assigning the WWTP
contract from Wheelabrator EOS to United States Filter Cooperative. Staff has recently
received a letter from wheelabrator EoS requesting approval of an ownership transfer from
their current parent company, wheelabrator clean water to United states Filter cooperative.
This will have no effect on the current contract and the existing WEOS staff will remain.

WEST COAST GENERAL VS CITY OF CARLSBAD
city Attorney,s memo of March 10 recommended council authorize him to add Burlingame
to this lawsuit at no cost our city. One of the most recent tricks that some contractors are
using to beat the public competitive bidding system is to "lease" employees and equipment
from subcontractors. If successful, a contractor can bid shop after a bid has been awarded
and increase its profit margin. The city of Carlsbad has successfully prevailed against a
contractor who ittempted to lease its subcontracting elements and the contractor has
appealed. This case will establish important elements in public bidding and contracting
procedures regarding subcontractors'
d. WARRANTS & PAYROLL
Finance Director recommended approval of Warrants Number 48428 - 48934, duly audited,
in rhe amount of $1,236,438.88, Payroll Checks 93574 - 94293 for the month of February
LggT inthe amount of $ggg,798.99 and Electronic Fund Transfers (for employee benefits
and tax withhotdings) for the month of February 1997 in the amount of $447,575.80.
Councilman Harrison moved approval of the Consent Calendar. Seconded by Councilwoman Janney
and carried unanimouslY.

Councilwoman Knight reported on a school liaison committee meeting she and Councilman Harrison
attended; on a legislative committee meeting at which Senator Kopp appeared; and a Samtrans
meeting. Vice Mayor Spinelli told about the Airport Roundtable meeting. Councilman Harrison
reported on the convention bureau meeting and also on the Chamber of Commerce meeting, noting
the Chamber is now "on line" and he hoped the city would update its portion.
Councilman Harrison recommended the mayor request that the large corporations which are moving
into the Burlingame Avenue area support the local Chamber and merchant groups' activities.
Council concurred and discussed various approaches for such a letter.
Mayor O'Mahony had attended a CCAG meeting and welcomed a convention to our city. She
asked that council support resolutions for legislation regarding authorization of ISTEA funds and
Bay Area bridge funds for seismic and other upgrading. These will be on the next agenda.
NEW BUSINESS
Councilman Harrison asked staff to look into placing some warning signs about the stop sign at
Easton and Cortez. Staff will investigate.
City Manager said a report of a recent staff meeting with Caltrans regarding the El Camino trees
has been forwarded to council.
Councilwoman Knight asked the City Planner about two Hillside Construction permit requests. City
Planner said one had been called up for review before the Planning Commission. Councilwoman
Knight asked that the 3008 Hillside request also be reviewed by the Planning Commission.

COUNCIL COMMITTEE REPORTS
CLOSED SESSION
At 7:51 p.m, Mayor O'Mahony adjourned the meeting to a Closed Session in order to confer with
the City Manager regarding public employment of a Police Chief and a Fire Chief. The meeting
reconvened at 8:06 p.m. with no action taken.
ADJOURNMENT IN MEMORY OF PADDY CONNEELY
Councilwoman Janney sadly noted the recent death of the Paddy Conneely, brother of Colman
Conneely the General Manager of the Holiday Inn Crown Plaza Hotel. Mayor O'Mahony adjourned
the meeting at 8:08 p.m. after a moment of silence in his memory'
