HomeMy WebLinkAboutMin - CC - 1995.01.03255 BTJRLINGAME, CALTFORNIA January 3, 1995 CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. The meeting was called to order at 7:30 p.m. by Mayor Knight. PLEDGE OF ALLEGIANCE TO THE FLAG kd by Finance Director Rahn Becker. ROLL CALL COUNCIL PRESENT: COUNCIL ABSENT: HARRISON, KNIGHT, O'MAHONY, PAGLIARO, SPINELLI NONE MINUTES The minutes of the Regular Meeting of December 5, 1994 were unanimously approved after a change on page 5 to show Councilwoman O'Mahony left with the City Manager some questions and salient facts relative to BART which were contributed by board members of C/CAG. Councilman Harrison noted his remarks on antennas had been abbreviated because of the action minutes. ke Tyler, local author, introduced herself. She had donated her book "Clue of the Clever Canine" to the city library. William landucci, resident on DeSoto, thanked the Public Works Director for the letter in response to his letter; he explained he has lived here for 34 years and every time it rains the sewer near his property overflows; he had been told the sewer would be repaired last year. Public Works Director discussed and explained the job would be going to bid in February; he could notify [,anducci when repairs would be done in that area. Landucci asked if there could be a stop on any new building permits and sewer permits in that area until the repairs are made. The Public Works Director noted the sewer repairs would be completed before any work done with a permit issued now is completed. RESOLUTION 1-95 AI]THORIZING REFUSE C OLLECTION. BRUSH PICKUP AND RECY- CLING RATE CHANGES Firance Director reviewed his memo of December 27 which recommended council approve the resolution changing rates. The recommendation reduces the rates for the typical residential 32 gallon can and brush service by 7 cents per month, and reduces the typical small business rate by 73 cents to $4. The typical large business rate increases by 10 percent. The overall rate increase in Burlingame will be 2.9 percent. The sole reason for the increase is a 50 percent increase in the tipping fees at Ox Mountain. This is an interim rate because the county and BFI have not come to agreement on a method for calculating a rate. The recycling rate is unchanged and included in these figures, He responded to council questions and comments. Council was pleased to see our rates are still much lower than other cities in the bay area. Councilman Harrison moved to approve PUBLIC COMMENTS RESOLUTION 1-95. Seconded by Councilman Spinelli and carried unanimously by voice vote. Mayor commented on the month-end pickup which her family uses and the fact that others seem unaware of this service. 1993 -94 COMPREHENSIVE ANNUAL FINANCIAL REPORT Finance Director reviewed his memo of November 28 which recommended council accept the report. The Audit Committee, consisting of council members O'Mahony and Harrison, met with the City Manager, Senior Accountant, the auditors and Finance Director last November 14 to review the draft audit and financial statements. Once again, the city received a "clean" audit report with no management letter prescribing any need for procedural corrections. For the first time, staff has prepared a Comprehensive Annual Financial Report - an expanded version of the General Purpose Financial Statements previously prepared. It includes not only normal financial, but year-to-year comparative information, ten year histories of expenditures and revenues and additional statistical tables and graphs. Senior Accountant Linda l,ee headed the effort to put together this report. Councilman Harrison said he and Councilwoman O'Mahony served on the Audit Committee; he commended staff and the auditors. Councilman Spinelli said the report was a great way to get a handle on city finances for the past ten years. Councilwoman O'Mahony reviewed some charts and graphs in the report showing what a great year we had in 1994 and extended council's thanks to Finance Director Becker, Linda ke and Mary Asturias. Councilwoman O'Mahony moved to accept the report. Seconded by Councilman Harrison and carried unanimously. CITY INVESTMENT POLICY Finance Director reviewed his memo of December 9, 1994 which recommended council approve the investrnent policy. The Govemment Code requires that council annually review the city's invest- ment policy governing allowable investments for city funds. Each month council receives a detailed report of investrnents. With the recent Orange County debacle in everyone's mind, he reviewed our policy and recommended deletion of reverse repurchase agreements as an authorized city invest- ment. He noted he had never entered into one of these transactions. The city portfolio is diversi- fied between the State l,ocal Agency Investment Fund (LAIF), U.S. Treasury and Agency Securities and Certificates of Deposit. We are not presently participating in San Mateo County's pool pending improved reporting and automation by the county treasurer. He responded to a question regarding the Treasurer's monthly report, noting the county places our property tax funds into the county pool which is invested in treasuries. Council members expressed approval of the policy. Councilman Harrison questioned using the term "idle" cash; he then moved to approve the policy deleting reverse repurchase agreements. Seconded by Councilwoman O'Mahony and carried unanimously. Councilwoman O'Mahony also appreciated the memo from the State Treasurer reassuring us about LAIF tunds. BART DRAFT ENVIRONMENTAL IMPACT REPORT/STATEMENT OEIR/DEIS) AND BART/SAMTRANS PI]BLIC HEARING City Manager reviewed the fax from BART regarding the release of the DEIFJDEIS for the BART San Francisco Airport Extension. The public review period will begin January 13, 1995 and the city should receive the document the week of January 3. A notice from SamTrans told of a public hearing set for Wednesday, February 15, 1995 at the South San Francisco Conference Center. Councilman Harrison said council should be at that public hearing but the date conflicts with a snrdy meeting; he moved the February 15 study meeting be canceled. Seconded by Councilwoman 256 257 O'Mahony. Councilman Pagliaro suggested we request that public officials be allowed to speak first at the BART hearing on February 15. Councilman Pagliaro said the topic of the Burlingame Avenue streetscape on that study agenda was very important. Council discussed placing it on a regular agenda and changing the regular meeting of February 22 to February 21. Motion was amended to cancel February 15 and also change February 22 meeting to February 21, seconded and unanimously approved. Council discussed having a hearing for our city on the BART issue. City Planner said she had not seen formal notice about 60 day public review period; she reviewed requirement for BART to respond to all public hearing and written questions about the DEIR/DEIS. Mayor Knight mentioned copies of letters in support of BART extension from Washington legislators. Council wondered if these legislators knew about our feelings regarding BART; discussed sending them a letter. City Manager suggested council wait until it reviewed the DEIR/DEIS before crafting the letter. Council noted BART had said the financial information would be in DEIR/DEIS, but financial are not required to be in an DEIR"/DEIS; discussed concern about SamTrans financial picture and subsequent viability of the project; discussed a letter from Sherman kwis, BART Director, regarding his idea of "CaIBART. " Councilwoman O'Mahony would like all persons who have written about BART to be notified of the meeting. Mayor Knight mentioned there was a sign-in sheet at the public meeting last June that might be used. CONSENT LENDAR Regarding "a" Councilman Pagliaro asked if we have any buildings which should be inspected; after some discussion he asked the Public Works Director to report back. Regarding "c" Mayor Knight asked about base bids and deducts. Councilman Pagliaro said there were four items in "d" he would like to receive more information on after the meeting. a INTRODUCTION OF O RDINANCE 1516 AMENDING BIJILDIN CODE REGARDING STEEL MOMENT RESI G FRAME BUILDINGS Public Works memo of December 9 recommended council adopt an amendment to the Uniform Building Code to revise the accepted method for design and construction of welded joints in steel moment resisting frame buildings. Investigations of buildings using the standard design after the Northridge earthquake revealed a substantial number of failures. An emergency amendment to the 1994 Uniform Building Code was adopted and it is advisable to formally amend our code to reflect this change. b RESOLUTIO 2-95 AUTHORIZING AG WITH MARRIOTT HOTEL AND RTA Finance Director's memo of December 20 recommended council approve an agreement with Marriott Hotel and the County Transportation Authority for use of grant funds to subsidize train and bus transit passes for Marriott employees. R TSM PR RESOLUTION 3-95 REIECTING ALL BID FOR THE WASHINGTON PARK WAcTER Public Works memo of December 28 recommended council reject all bids and direct staff to redesign the project to meet budget specifications. WARRANTS AND PAYROLL Finance Director recommended approval of Warrants 35482 - 35827 , duly audited, in the amount of $1,149,381.10 and Payroll Checks 71288 - 72033 for the month of November 1994 in the amount of $1,204,412.44. e. DENIAL OF CLAIM OF NORMA HOENE City Attorney's memo of December 13 recommended council deny this claim for injuries received when stepping in a parking strip where the property owner installed flagstones. f. RESOLUTION 4-95 AUTHORIZING REAL PROPERTY CONTRACT AND ACCEPTING EASEMENT DEED FOR S AT 19 EL OUANITO Public Works memo of December 28 recommended council adopt a resolution approving this real property contract and accepting the deed for a sewer line at 19 El Quanito. Councilwoman O'Mahony moved approval of the Consent Calendar. Seconded by Councilman Harrison and carried unanimously. COUNCIL COMMITTEE REPORTS Mayor Knight noted she and Counciknan Harrison had attended the 60th Anniversary celebration at the Broadway Bank of America; she had also visited local schools and observed structural improve- ments made with parcel tax monies. Councilman Pagliaro reported on C/CAG meeting; discussed the changes in C/CAG JPA to put on next agenda for review by council; he told about the ABAG General Assembly where they discussed revisions to the state constitution. Councilman Spinelli told about the Emergency Services meeting and about the Airport Roundtable. OLD BUSINESS Councilman Pagliaro coflrmented about the condition of recycling bins and cardboard collection in back of Burlingame Avenue stores; it is an eyesore, discussed frequency of pickup by BFI and asked for a report. Mayor Knight discussed the new state anti-smoking law, some parts appear to be tougher than our city law. City Attorney noted the state law is focused on smoking in the "workplace, " he is reviewing it and will report back to council. Mayor Knight set public hearings for appeals for 601 Ansel, a residential condominium project, and for 1333 Bayshore, Hyatt Hotel for a temporary tent, for the January 18 meeting. Councilman Pagliaro commented about tree removal in his property's planting strip and the type of tree replacements allowed. He also asked that if any council member planned a city sponsored trip, it be reported to council ahead of time. Mayor Knight said she attended the League Conference in long Beach and paid with her own funds, the city reimbursed her for expenses. Council and staff discussed staff travel requirements, any out-of-state trip presently requires council approval. After NEW BUSINESS 259 further discussion, Councilman Pagliaro asked that any travel or conference by council or depart- ment heads which would cost the city over $200 be reported to council. Councilman Harrison moved to support this request for $300. Seconded and carried unanimously. f. ktter from BART Director Sherman Irwis. Letter from County regarding a Violence Prevention Summit and asking the Mayor to appoint representatives. Council approved the Mayor asking for representatives. h. ktter from Chairman of C/CAG regarding changes to the JPA' Letter from William Landucci regarding sewer problem. 6tter from State Vehicle Theft Advisory Committee asking council to adopt a resolution in support of this group. City Manager recommended against. k. Irtter from Mayor Claire Mack of San Mateo regarding homeless shelters. I-etter from State Housing and Community Development accepting Burlingame's adopted housing element. Council expressed its amazement; City Planner noted we are one of few cities of our size in the county to have its housing element approved. ktter from Noel's Hair Care thanking Fire Department for saving her store when two others were destroyed in December 20 fre. J I m 26C Council discussed another fire which occuned today in a residence on kxington and congratulated our fire department on jobs well done. IN MEMORY F ANET Mayor Knight noted with sadness the death of Janet Parker Beck, San Mateo Times reporter and friend of Councilman Spinelli. Councilman Harrison informed council that our Park and Recreation Commissioner Mike Nilmeyer's father Sam also died recently.
