Proposed Amendments to the SBWMA JPA FinDir Nava presented the proposed amendments by South Bayside Waste Management Authority and discussed their implications for the City. 1. CALL TO ORDER A duly noticed regular meeting of the Burlingame City Council was held on the above date in the City Hall Council Chambers. Mayor Cathy Baylock called the meeting to order at 7:10 p.m. 2. PLEDGE OFALLEGIANCE TO THE FLAG Led by Jennifer Pfaff. 3. ROLL CALL COUNCILMEMBERS PRESENT : COUNCILMEMBERS ABSENT : Baylock, Cohen, Keighran, Nagel, O'Mahony None 5. a. 4. MINUTES Councilwoman O'Mahony made a motion to approve the minutes of the January 3,2006 regular Council meeting; seconded by Vice Mayor Nagel. The motion was approved unanimously by voice vote 5-0. PRESENTATIONS PROCLAMATION HONORING AMERICAN HEART ASSOCIATION'S "GO RED FOR woMEN" D,{Y iIY FEBRUARY 3.2006 Mayor Baylock presented a proclamation to Annie Oliveto of the American Heart Association honoring "Go Red for Women" Day on February 3,2006. BFI/ALLIED WASTE SERVICES ON PROPOSED REROUTE SCHEDULE FinDir Nava introduced Stacey Wagner, Community Relations Manager for Allied Waste Services/BFl, who presented the proposed reroute schedule for Burlingame that will become effective February 6,2006. PUBLIC HEARINGS ADOPT ORDINANCE NO. 1776 TO AMEND CHAPTER 6.24 (PEDDLERS AND SOLICITORS) AND REPEAL CHAPTER 6.26 (CHARITABLE SOLICITATION) CA Anderson reviewed the staff report and requested Council hold a public hearing and adopt Ordinance No. 1776 amending Chapter 6.24 (Peddlers and Solicitors) and repealing Chapter 6.26 (Charttable Solicitation). After some Council discussion, Councilwoman Keighran requested the Police Department add a procedure requiring solicitors to display their badges. Chief Van Etten stated that this requirement would be incorporated into the permit process for peddlers and solicitors. Mayor Baylock opened the public hearing. Pat Giorni, 1445 Balboa, requested limiting solicitation to daylight hours. CA Anderson advised that the courts said cities should avoid this issue. Residents may post a "No Soliciting" sign if they so choose. There were no further comments from the floor, and the hearing was closed. Councilwoman O'Mahony made a motion to adopt Ordinance No. 1776 amending Chapter 6.24 (Peddlers and Solicitors) to conform to judicial decisions and repealing Chapter 6.26 (Chaitable Solicitations) and to incorporate into the permit process the requirement for peddlers and solicitors to display their badges; seconded by Councilwoman Keighran. The motion was approved unanimously by voice vote 5-0. Mayor Baylock directed CC Mortensen to publish a summary of the ordinance within 15 days of adoption. Sue Fuller, 22l}Poppy Drive, spoke about problems she encountered with Allied Waste Services. Marge Colapietro, 367 El Paseo, Millbrae, spoke against Shared Recreation Services between Burlingame and Millbrae. Charles Yoltz,725 Yemon Way, spoke about the upcoming public forum sponsored by Citizens for a Better Burlingame. There were no further comments from the floor. STAFF REPORTS RESOLUTION NO. 1-2006 ACCEPTING THE 2006 SOLID WASTE RATE ADJUSTMENT ESTABLISH A REVENUE RESERVE THE CITY'S SOLID 8. A. OF FIVE PERCENT WASTE BALANCING ACCOUNT WITH ALLIED WASTE SERVICES FinDir Nava reviewed the staff report and requested Council accept the proposed three percent rate adjustment for residential and commercial accounts effective January 1,2006, to establish a revenue reserve in the City of Burlingame's Solid Waste Balancing Account with Allied Waste Services. PUBLIC COMMENTS Councilwoman O'Mahony made a motion to approve Resolution No. 1-2006, authorizing Allied Waste Services (formerly BFI) to increase rates for refuse collection services; seconded by Councilman Cohen. The motion was approved unanimously by voice vote 5-0. b. SHARED RECREATION SERVICES BETWEEN THE CITIES OF BURLINGAME AND MILLBRAE P&RD Schwartz reviewed the staff report and recommended that Council give direction to staff about whether to continue the steps to move forward with the potential merger of Recreation Services with the City of Millbrae. Council discussed various options and concluded that there is no compelling financial need to continue towards a merger of recreation services with Millbrae and wanted P&RD Schwartz to return to Burlingame on a full time basis. c.CONSIDER APPOINTMENT TO THE PLANNING COMMISSION Councilwoman Keighran made a motion to appoint Richard Terrones to the Planning Commission with the term expiration of April 2010; seconded by Mayor Baylock. The motion was approved unanimously by voice vote 5-0. d. INVESTMENT POLICY FOR 2006 FinDir Nava reviewed the staff report and requested Council approve the City of Burlingame's investment policy for 2006. Councilwoman O'Mahony made a motion to approve the 2006 Statement of Investment Policy for the City of Burlingame; seconded by Vice Mayor Nagel. The motion was approved unanimously by voice vote 5-0. CONSENT CALENDAR RESOLUTION NO. 2-2006 APPROVING ADOPTION OF A DISADVANTAGED BUSINESS ENTERPRISE GOAL OF FIVE PERCENT FOR THE FEDERAL FY 2005/06 Asst. DPW Murtuza requested Council approve Resolution No. 2-2006 adopting the Disadvantaged Business Enterprise (DBE) goal of five percent for the period of October 1 , 2005 to Septemb er 20,2006 This item was deferred for further discussion (see below). RECOMMENDATION TO ADOPT THE REVISED 2006 COUNCIL CALENDAR CC Mortensen requested Council adopt the Revised 2006 City Council Calendar which includes the cancellation of the July 3 and August 7 , 2006 regular City Council meetings to accommodate Council vacations. Burlingame City Council Approved Minutes 9. a. b. c. 331 January 17,2006 Councilwoman O'Mahony made a motion to approve option 3, to discontinue steps towards an eventual merger but to continue the joint operation of programs and services with Millbrae, and to return P&RD Randy Schwartz to full time status as Recreation Director in Burlingame; seconded by Vice Mayor Nagel. The motion was approved unanimously by voice vote 5-0. d. FIRST AMENDED AND RESTATED JOINT EXERCISE OF POWERS AGREEMENT OF FinDir Nava requested Council approve Resolution No. 5-2006 approving the first amended and restated Joint Exercise of Powers Agreement for the South Bayside Waste Management Authority. e. WARRANTS AND PAYROLL FinDir Nava requested approval for payment of Warrants #15774-16225 duly audited, in the amount of $2,154,803.97 (excluding library checks 15927-15951), Payroll checks #1,64203-164539 in the amount of 93,822,577.26 for the month of December 2005. f. APPOINTMENT OF FRANKIE MEYER TO THE BURLINGAME AVENUE AREA BUSINESS IMPROVEMENT DISTRICT (BID) ADVISORY BOARI) CA Anderson requested Council appoint Ms. Frankie Meyer to the Burlingame Avenue Area BID Advisory Board to serve an unexpired term to January 2007. Councilwoman O'Mahony made a motion to approve Items a. and c. through f. of the Consent Calendar; seconded by Vice Mayor Nagel. The motion was approved unanimously by voice vote 5-0. b. RESOLUTION NOS. 3-2006 and 4-2006 AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH SOLEM AND TO CONDUCT A PHASE I PUBLIC OPINION POLLING FOR THE CITYWIDE FACILITIES IMPROVEMENTS PROJECT AND APPROVING TRANSFER OF FUNDS M CONTINGENCY RESERVE TO THE FACILITIES PROJECT Asst. DPW Murtuza requested Council approve Resolution No. 3-2006 authorizing a professional services agreement with Solem and Associates to conduct public opinion polls for Citywide Facilities Improvements, Phase I, for $43,410 and approve Resolution No. 4-2006 to transfer $80,000 from the Contingency Reserve to the Citywide Facilities Improvements project to fund Phase I efforts. After Council discussion, Council directed that questions relating to the visionary improvement options be omitted and that Council have an opportunity to review the questions. Mayor Baylock made a motion to approve Item b. of the Consent Calendar, to have the poll questions tailored towards the pragmatic approach, and to have Council provide input in refining the poll questions; seconded by Councilwoman O'Mahony. The motion was approved unanimously by voice vote 5-0. 10.COUNCIL C E REPORTS Council reported on various events and committee meetings each of them attended on behalf of the City. 11. OLD BUSINESS a. DISCUSSION OF ECONOMIC STUDY INTERVIEWS FOR BURLINGAME AVENUE AREA CP Monroe provided a list of 20 members of the business community and Councilmembers who will be interviewed as a part of the downtown Economic Study. Councilwoman Keighran suggested only one 332 Burlingame City Council Approved Minutes January 17,2006 THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY (SBWMA) Councilmember be listed under History Interest; that for Chamber of Commerce one interviewee should be an architect and the other be in another profession; and to add one resident from the Ralston/Howard area (near Safeway). Mayor Baylock requested that Dr. Tanisawa be placed as a primary interviewee which would also address including a resident from the Ralston/Howard area. 12. NEW BUSINESS There was no new busmess. 13.
