URGENCY ORDINANCE
ESTABLISHING A THIRTY MILE PER HOUR
SPEED LIMIT ON BAYSWATER BET4IEEN
HUMBOLDT ROAD AND CALIFORNIA DRIVE
The CITY COUNCIL of the CITY OF BURLINGAME, does ORDAIN as follows:
Section 1. Section 13.24.015 of the Burlingame Municipal Code is
hereby amended to read as follows:
"13.24.015 Thirty Miles Per Hour
No person shall drive a vehicle upon any of the following
designated streets at a speed greater than tViirty (30) miles
per hour:
1. Occidental Avenue between 6arroilhet Avenue and
E1 Camino Real.
2. Bayswater Avenue between Humboldt Road and California
Drive.
The Director of Public bJorks is hereby authorized and directed
to procure appropriate signs giving notice of same prima facie
speed limit, and to erect the same upon the above designated streets."
Section 2. Urgency Clause
It is hereby declared that this ordinance is an ordinance for the
immediate preservation of the public peace, safety, health and welfare, and
is an urgency .measure as provided by law, and shall take effect upon its
passage. The facts constituting such uroency are as follows: A speed study
of July 8, 1976, indicates a critical speed (prima facie speed limit) of
thirty-five miles per hour on the portion of Bayswater Avenue above set forth.
Twenty-three per cent (23%) of the traffic thereon travels thirty-five miles
per
hour and
over.
Eight
per
cent
(8%)
travels
in
excess of
forty
miles per
hour.
The
speed
limit
of
thirty
miles
per hour
is
necessary
immediately
because of the opening of schools in this vicinity; because of the unrestricted
driveway access which exists in the area; and because of some restricted
visibility at intersections along the above-described street. The indicated

speeds and the above conditions create an immediate danger to the health and
safety of the persons in such area, and therefore require this ordinance be
passed.
Section 3. This ordinance shall be published as required by law.

I, EVELYN H. HILL, City Clerk of the City of Burlingame, do hereby
certify that the foregoing Urgency Ordinance was introduced and adopted at
a regular meeting of the City Council held on the 7th day, of September, 1976,
by the following four-fifths vote:
