HomeMy WebLinkAboutOrd 1082ORDINANCE NO. 1 O ORDINANCE AMENDIPJG PROVISIONS OF CHAPTER 9.04 OF THE BURLINGAME MUNICIPAL CODE RELATING TO DOGS The CITY COUNCIL of the City of Burlingame does ORDAIN as follows: Section 1. Section 9.04.011 of the Burlingame Piunicipal Code is amended to read as follows: "9.04.011 Dog license fee. An annual license fee in the following amounts shall be paid for each dog which is more than four months old and is owned, kept, harbored or possessed within the City: Pule and unspayed female dogs in the amount of $7.00 Spayed female dogs in the amount of 3.50 The license fee shall be due and payable on the first day of January of each year. Any person who fails or neglects to pay the license fee on or before the first of March of each year, as the license fees become due, shall be deemed delinquent and shall pay a penalty in the amount of four ($4.00) dollars. Any person who comes into ownership of or commences to harbor, keep or possess a dog over the age of four months after the first of March of each year shall, within thirty days, obtain a license as herein provided for the remainder of the license year in the full amount hereinabove provided. A fee of one ($1.00) dollar shall be paid for any dog tag replacement." Section 2. Section 9.04.015 is added to said code to read as follows: "9.04.015 Rabies Vaccination. Every dog owner, after his dog attains the age of four months shall procure its vaccination by a licensed veterinarian with a canine anti -rabies vaccine approved by and in a manner prescribed 6/25/76 -1- 7/23/76 by the State Department of Public Health. Such vaccination shat l serve as a requirement prior to the licensing of any dog owned or harbored in this City." Section 3. Section 9.04:020 of said code is amended to read as follows: "9.04.020 Dogs running at large a nuisance - Impounding. It is unlawful for any person to allow any dog owned or con- trolled by him or her to run at large and uncontrolled within the City, and any dog so running at large or uncontrolled is a nuisance and it shall be the duty of the humane officer to impound such dog in the public pound." Section 4. Section 9.04.025 is hereby added to said code to read as follows: "9.04.025 Pound Master and Animal Shelter. The Pound Master and Animal Shelter for the City of Burlingame shall be that person or corporation employed as such by the County of San Mateo under that agreement between the City and County dated September 6, 1961, and any amendments thereof. All employees of the Pound Master, when properly sworn, shall be authorized to issue citations for violations of this Code. The licensing and impounding provisions of Sections 3330.12, 3330.13 and 3330.15 through 3330.24 of the San Mateo County Ordinance Code shall apply within the City of Burlingame." Section 5. Sections 9.04.026 is hereby added to said code to read as follows: "9.04.026 Diseased or Vicious Animals. Whenever the Pound Master shall have reasonable cause to believe that any dog, either licensed or unlicensed, or any other animal, is diseased or vicious or dangerous to any person or other animal, he is hereby authorized to take custody of such animal and impound the same 6/25/76 -2- 7/23/76 in a safe place for such period of time as is required in order to observe, examine and determine whether or not such animal is diseased or vicious or dangerous, or constitutes a menace to the public health or safety. It shall be the duty of the Director of the San Mateo County Department of Public Health and Welfare, or his authorized agent, to observe and examine any such animal and determine whether the same is diseased or vicious or dangerous, or does constitute a menace to public health or safety, and,if said director or agent so determines, it shall be unlawful for any person to continue to maintain such animal, and the Director or his agent shall direct the Pound Master to dispose of said animal or to file a complaint against the owner or keeper of said animal for violation of this provision; otherwise said animal shall be returned to the owner or person entitled to its possession. It is hereby made the duty of any person having knowledge that any dog or other animal has bitten any human being within the limits of the City of Burlingame to immediately report that fact to the Department of Public Health, the Pound Master, or to the Police Department with full information in regard to the incident. In the event that the Pound Master secures information of the existence of any case of rabies or any other animal disease dangerous to human beings, he shall immediately report the same to the Director of Public Health." Section 6. This Ordinance shall be published as required by law.
