HomeMy WebLinkAboutOrd 1061as follows: ORDINANCE N0. 1061 REQUIRING STATEMENT OF RESIDENTIAL USE The CITY COUNCIL of the City of Burlingame, California, does ORDAIN Section 1. Section 25.28.090 is hereby added to the Burlingame Municipal Code to read as follows: "25.28.090 Statement of Residential Prior to the consummation of the sale or exchange of any real property in a first residential district, the buyer or transferee thereof shall execute a Statement of Residential Use on a form pro- vided by the City; and shall cause said executed statement to be delivered to the Burlingame Building Inspector and shall cause a copy thereof to be delivered to the seller or transferor. The word delivered'as used in this section shall include personal delivery and delivery by depositing in first class mail, postage prepaid. In the case of any sale or exchange through escrow, the buyer may deposit the executed statement required by this ordinance in escrow with instructions to deliver the original and a copy as above required." Section 2. This ordinance shall be published as required by law. Mayor / HERBERT K. WHITE, City Clerk % Deputy ity Clerk STATEMENT OF RESIDENTIAL USE In regard to R-1 Zoning, Section 25. 28.050 of the Municipal Code states that: "Only one building designed or used as a residence for one family shall be erected, located or maintained on one lot. In Burlingame there are some garages or other structures which have been converted into additional living units. Many of these are illegal. When discovered by City officials, the property owner must abate the illegal use and may be forced to restore the structure to its original condition at his own expense. There are some properties which have an additional living unit which is nonconforming since it was established before the zoning laws. This can be legally rented out if use has been continuous. However, if more than 50 per cent of its assessed value is destroyed, it may not be rebuilt or used as rental property in the future. The City of Burlingame Building Department has records of the building permits issued on all properties. You may review those records at any time. However, the only way to determine whether a rental unit is legally nonconforming or illegal is to have an inspection of the premises by City officials. A $10.00 charge will be made for such inspections. Such an inspection is voluntary and not required as a condition of purchasing any property. Dated: I have read the above and understand it. (Signed)
