ORDINANCE N0. 1107
URGENCY INTERIM ORDINANCE REQUIRING SPECIAL
PERMITS FOR PROJECTS NORTH AND EAST.OF BAY -
SHORE FREEWAY AND WITHIN THE ROLLINS ROAD
INDUSTRIAL AREA
The CITY COUNCIL of the City of Burlingame does ORDAIN as follows:
Section 1. Soecial Permits Reouired.
No building permits shall be issued for neva construction, additions,
or other development of any properties within the City of Burlingame within
that area north and east of Bayshore Freeway from the City of San Mateo to the
City of Millbrae, and that area east of the Southern Pacific right-of-way from
Broadway to the City of Millbrae, without a special permit from the Planning
Commission. Said special permits shall be applied for and heard as set forth
in Chapter 25.16 of the Burlingame Municipal Code, except that all permits
granted shall require approval of the City Council and shall automatically be
placed upon the agenda of the next succeeding regular City Council meeting
following approval of the Planning Commission.
This ordinance shall not apply to the lands covered by the Project
Area of the Bayside Redevelopment Project of the Redevelopment Agency of the
City of Burlingame; any projects or buildings for which a building permit has
been issued or a pian check fee paid as of 5:00 p.m., June 3, 1977; permits
for maintenance or repair of existing structures; or permits under Title 22 of
the Burlingame Municipal Code,
Section 2. Planning Commission Study.
The Planning Commission of the City of Burlingame is hereby directed
to pursue a study of the existing zoning and land uses within the described
area, including those areas of San Mateo and Millbrae in the vicinity of the
Peninsula Avenue and Millbrae Avenue freeway interchanges. Said study shall
include traffic, utility, econcmic and environmental effects of those uses
presently legally possible, and shall consider appropriate ordinances and other
actions to balance said effects with the health, safety and welfare of the
people of the City of Burlingame, including the consideration of the adoption

of a specific plan pursuant to Sections 65450 and 65451 of the Government
Code.
Section 3. Urgency,
It is hereby declared that this ordinance is an ordinance for the
immediate preservation of the public peace, safety, health and welfare and
is an emergency measure as provided by law, and shall take effect upon its
adoption.
The facts constituting such urgency are as follows: Changing
character of the development of said area, including the prospect of numerous
major projects
in said area
in the next three years; liquidation
of the lands
of the largest
single owner
of undeveloped property; and
increased
proposals
for office
building
uses will
cause intensified traffic
volumes,
increased
burdens
upon already
limited
utility services, increased
fire and
police
demands,
and environmental
and
economic problems as yet
unknown.
This ordinance is intended to be an interim urgency zoning ordinance.
Unless this ordinance is extended as provided by law, it shall automatically
cease to have force and effect without specific repeal when either (1) the
City Council shall enact new use or zoning regulations, publish the same, and
the same shall become effective; (2) the City Council shall formally consider
new use and zoning regulations and finally reject the same or refuse to
enact them ninto law, or (3) after the expiration of three (3) months from the
date of adoption of this ordinance, whichever comes first.
Section 5. Publication.
This ordinance shall be published as required by law.
