AN ORDINANCE ESTABLISHING RULES AND REGULATIONS
FOR A WATER SHORTAGE EMERGENCY AND ESTABLISHING
PENALTIES FOR VIOLATIONS THEREOF
The CITY COUNCIL of the City of Burlingame does ORDAIN as follows:
Section 1. Chapter 15.06 is hereby added to the Burlingame
Municipal Code to read as follows:
"CHAPTER 15.06
WATER SHORTAGE EMERGENCIES
15.06.010 Implementation of Chapter
1. The provisions of this chapter shall be implemented only upon
adoption by the City Council of a declaration that a water shortage
emergency condition prevails pursuant to California Water Code
Sections 350 et seq.
2. The provisions of this chapter shall be of no further force
or effect when the City Council determines that a water shortage
emergency condition no longer exists.
15.06.020 Definitions
For the purposes of this chapter. the following terms, phrases,
words and their derivations shall have the meaning given herein:
(a) 'Water
Department' is the Burlingame Municipal Water
System.
(b) 'Customer' is any person using water supplied by the
Burlingame Water Department.
(c} rector' is the Director of Public blorks of the City
of Burlingame.
(d) 'Person' is any person, firm, partnership, corporation,
company or organization of any kind.
(e) 'Unit of water' is 1,000 gallons of water.
(fi) 'Water' is water from the Water Department.

(g) 'Water shortage emergency' means a water shortage
emergency condition declared by the City Council pursuant
to Sections 305 et seq. of the Water Cade.
15.06.030 Renulations and Restrictions
1. Broken or defective plumbing, sprinklers, watering or
irrigation systems which permit the escape or leakage of adater shall
be repaired immediately.
2. Irrigation of lawns, gardens, playfields, parks, median
strips, golf courses, cemeteries and landscaping of any type shall
be reduced fifty per cent (50%) as compared to the same billing
period during the calendar year 1976.
3. No new irrigation services will be permitted and additional
water will not be allowed for expansion of existing irrigation
facilities.
4. No use of water shall be allowed which results in flooding
or runoff in gutters, driveways or streets.
5. A hose shall not be used for washing cars, buses, boats,
trailers or other vehicles, nor for washing building structures or
parts thereof.
6. Filling of any existing or new swimming pools is prohibited.
7. Sidewalks, walkways, driveways, patios, parking lots, tennis
courts or other hard surfaced areas shall not be cleaned using water
from hoses or by other use of water directly from faucets or other
outlets.
8. Service connections far new construction incorporating water
saving devices may be granted as long as conons of this chapter
are met, provided no landscaping shall be installed during a water
shortage emergency.
9. fVo water shall be used to clean, fill or maintain levels in
decorative fountains.
10. Restaurants shall serve water to customers only on request.

11. Construction water for consolidation of backfill and other
non-domestic uses shall be denied if other methods of water sources
can be used.
15.06.040 Allocations
The following allocations of water shall apply during any water
shortage emergency:
1. SINGLE FAMILY RESIDENTIAL AND MULTIPLE UNIT CUSTOMERS.
A twenty-eight per cent (28%) reduction in the quantity
of water delivered bi-monthly as compared to similar calendar periods
for 1976. The minimum allocation shall be two thousand five hundred
(2,500) gallons per bi-monthly billing period.
2. NON-RESIDENTIAL CUSTOMERS.
(a) Industrial customers using process water to manufacture,
alter, convert, clean, heat or cool a product, including
water used in laundries and recycled car wash facilities,
shall reduce their consumption by twenty-eight per cent (28%)
as compared to similar calendar billing periods for 1976.
(b) Industrial, commercial (including non -recycled car wash
facilities)
and governmental agency customers shall

15.06.050 Exceptions
Consideration for exceptions regarding allocations of water or

any of the regulations and restrictions set forth herein shall be
as follows:
1. Written applications for exceptions shall be made to the
City of Burlingame Water Department, 501 Primrose Road, Burlingame,
California 94010.
2. Each application shall be reviewed and determined by the
Director. Denials of applications may be appealed to the City Council,
whose decision shall be final.
3.
The only grounds
for
granting
such
application
are:
(a)
Undue hardship to
the
applicant,
including
adverse
economic impacts such as loss of production or jobs.
(b) A condition affecting the health, sanitation or safety
of the applicant or the general public.
Prior to granting permission for an exception, the Director
must be satisfied that all practical water conservation measures
have been adopted by the applicant.
15.06.060 Rate Schedules for Water Service Customers

2. FLOW RESTRICTING DEVICES.
The City Pianager may, after one written warning, direct the
installation of a flow restricting device on the service line of any
customer observed by City personnel to be violating any of the
regulations and/or exceeding water allocations hereabove set forth.

material, labor, equipment and overhead. charges.
3. DISCOPJTINUANCE OF WATER SERVICE.
Continued water consumption in excess of the allocation may
result in the discontinuance of water service by the Water Department.
A charge of $20.00 shall be paid prior to reactivating the service.
15.06.070 Enforcement
The Director, all employees of the Water Department, Public
Works Department and Fire Department have the duty and are authorized
to enforce the provisions of this chapter and shall have all the
powers and authority contained in California Penal Code Section
836.5, including the power to issue written notices to appear.
Section 2. URGEiJCY CLAUSE. It is hereby declared that this
ordinance is an .ordinance for the immediate preservation of the public peace,
safety, health. and welfare, and is an urgency measure as provided by law, and
shall take effect upon its passage,
The facts constituting such urgency are as follows: The continuing
drought in the State of California has cause extensive water shortages,
particularly within the service area of the San Francisco Water Department,
to the extent that a twenty-five per cent (25) reduction of water usage has
been mandated upon this City and corresponding restrictions are necessary upon
water users of the City.
Section 3. This ordinance shall be published as required by law.
