URGENCY INTERIM ORDINANCE IMPOSING A
MORITORIUM ON APARTMENT HOUSE USES IN
C-3 ZONES
The CITY COUNCIL of the City of Burlingame does hereby ORDAIN as
follows:
Section 1. Moritorium upon Apartment Use. Notwithstanding any
other provision of the Burlingame Municipal Code, no apartment house, con-
dominium or other building containing three or more dwelling units shall be
built, nor shall any building permits therefor be issued, in the C-3
(professional business) district of the City of Burlingame.
Section 2. Urgency. It is hereby declared that this ordinance is
an ordinance for the immediate preservation of the public peace, safety,
health and welfare and is an emergency measure as provided by law, and shall
take effect upon its ado tion
The facts constituting such urgency are as follows: Buildings up
to thirty-five (35) feet in height, containing three or more living units,
may currently be constructed within C-3 zones under the ordinances of the
City of Burlingame. It appears that such buildings may be inappropriate con-
sidering the actual location of C-3 zones within the City, and that traffic,
safety and other problems affecting the public health, safety and welfare are
involved. The Planning Commission of the City of Burlingame is directed by
this ordinance to pursue a study of the appropriateness of such uses in the
C-3 zone and to report.to this Council within sixty (60) days.
Section 3. Duration. This ordinance is intended to be an interim
',urgency zoning ordinance. Unless this ordinance is extended as provided by
law, it shall automatically cease to have force and effect without specific
repeal when either (1) the City Council shall enact new use or zoning regula-
tions., publish the same, and the same shall become effective; (2) the City

finally
reject the same or refuse to
enact them into
law, or (3) after
the
expiration
of four (4) months from the
date of adoption
of this ordinance,
whichever
comes first.
Section 4. Publication
required by law.
This ordinance shall be published as

certify that the foregoing Urgency Ordinance was introduced and adopted at
a regular meeting of the City Council held on the 7th day of March, 1977,
by the following four-fifths vote:
