URGENCY ORDINANCE INCREASING TRANSIENT
OCCUPANCY TAX FROM SIX TO EIGHT PERCENT
The CITY COUNCIL of the Gity of Burlingame does ORDAIN
a.s follows:
Section 1. Section 4.09.030 of the Burlingame ?Municipal
Code is amended to read:
"4.09.030 Tax imposed.
For the privilege of occupancy in any hotel, each
transient is subject to and shall pay a tax in the amount
of eight per cent (8%) of the rent charged by the operator.
Said tax constitutes a debt owed by the transient to the
city which is extinguished only by payment to the operator
or to the city. The transient shall pay the tax to the
operator of the hotel at the time the rent is paid. If
the rent is paid in installments, a proportionate share
of the tax shall be paid with each installment. The unpaid
tax shall be due upon the transient's ceasing to occupy
space in the hotel. If for any reason the tax due is not
paid to the operator of the hotel, the tax administrator
may require that such tax shall be paid directly to the
tax administrator."
Section 2. URGENCY DECLARED. Section 1 of this
ordinance is for the immediate preservation of the public peace,
'.safety, health and welfare and is an emergency measure as provided
by law, and shall take affect immediately. The facts constituting j
'such urgency are as follows: An essential function of the City

which involves the fixing of a budget to be used as
the basis for determining the amount
and rate of taxes to be
levied. Before
the City Council can
properly prepare
a budget
it must be able
to ascertain with reasonable
accuracy
the amount
of income which
may be expected from
all sources and
the effective
date of such sources,
which effective
date should be
before the
commencement of
the fiscal year.
Section 3. It is further declared that Section 1
of this ordinance relates to taxes for the usual and current
expenses of the City and therefore, pursuant to Government Code
Section 36937(d) is exempt from the requirements of Government
Code Section 36934 regarding referendum periods.
Section 4. This ordinance shall be published as
required by law and shall be effective July 1, 1978.
