AN ORDINANCE APIENDING SECTIONS OP THE
UNIFORM BUILDING CODE TO REQUIRE SMOKE
DETECTORS UPON MODIFICATIONS TO DWELLING
UNITS
The CITY COUNCIL of the City of Burlingame does ORDAIN
as follows:
Section 1. Section 18.08.186 is hereby added to the
�,IBurlingame Municipal Code to read as follows:
"18.08..1.86 Section 1310(a) Amended - Fire Warning
and Fire Extinguisher System.
Section

is amended to read as
follows:
(1) NEW
UNITS.
Every dwelling unit
within an
apartment house and every guest room in a hotel used
for sleeping purposes shall be provided with smoke
detectors conforming to U.B.C.. Standard No. 43-6. In
dwelling units, detectors shall be mounted on the
ceiling or wall at a point centrally located in the
corridor or area giving access to rooms used for sleeping

purposes. In an e€ -fie ent d elling unit, hotel sleeping
room and in hotel suites, the detector shall be centrally
located on the ceiling of the main room or hotel sleeping
room. Where sleeping rooms are on an upper level, the
detector shall be placed at the center of the ceiling,
directly above the stairway. All detectors shall be
located within 12 inches of the ceiling. Care shall be
exercised to insure that the installation will not
interfere with the operating characteristics of the
detectors. The detector alarm, when actuated, shall
be sufficiently audible to be heard through closed sleeping
room doors.

(2) EXISTING UNITS. Smoke detectors shall be
installed in all dwelling units within apartment houses
and all guest rooms in hotels upon the parcel whenever:
Ca) ALTERATIONS, REPAIRS OR ADDITIONS: Interior
or exterior alterations, repairs or additions are
made to any dwelling units or guest rooms in excess
of $500 in any 12 -month period. Such installations
shall be mounted in a manner similar to new units.
Cb) SALE OR TRANSFER OF' TITIE:
Any
apartment
house
or hotel is to be transferred
to, or
vested in
any
other person or persons, or
entity.
The installation
whether or not
shall be the joint responsibility
of
the transferor
sale or transfer
and transferee. The use of
the transferred premises
without compliance herewith
shall constitute
a
public
nuisance.

Section 2. Section 18.08.195 is hereby added to said
Code to read as follows:
"18.08.195 Section 1413 Amended - Fire
Warning Systems.
Section 1-41.3 is amended to read as follows:
(1) NEW

Section 3. This ordinace shall be published as
required by law.

following is a summary of Ordinance No. 1145 , adopted

Amends Uniform Building Code to require installation
of smoke detectors in existing dwelling units, in
addition to new units, upon alterations, repairs or
additions in excess of $500 in a twelve-month period,
or Upon sale; requires smoke detectors in all apart-

Fursuant to Government Code Section 36933(c)C1) the
;following is a summary of proposed Ordinance No. 1145
Amends Uniform Building Code to require installation
of smoke detectors in existing dwelling units, in addition
to new units, upon alterations, repairs or additions in
excess of $500 in a twelvemonth period, or upon sale;
requires smoke detectors in all apartments and hotels by
January 1, 1983; exempts existing units in C-4 and M-1
zones.
Said ordinance was introduced on
a public hearing thereon will be held
February 20, 1979
March 5, 1979 , at
8:00 p.m. at the City Council Chambers, Burlingame City Hall.,
501 Primrose Road, Burlingame, California.
