HomeMy WebLinkAboutOrd 1182ORDINANCE N0. 1182 ORDINANCE ADDING CHAPTER 25.56 TO THE BURLINGAME MUNICIPAL CODE TO REGULATE THE RENTAL OR LEASE OF VACANT SCHOOL PROPERTIES The CITY COUNCIL of the City of Burlingame does ORDAIN as follows: Section 1. Chapter 25.56, concerning rental or lease of vacant school properties, is added to the Burlingame Municipal Code to read as follows: "CHAPTER 25.56 RENTAL OR LEASE OF VACANT SCHOOL PROPERTIES 25.56.010 Use of vacant school properties. The provisions of this chapter shall apply whenever all or part of real property owned by a public school district is to be rented, leased, or otherwise used for other than public school classroom or administration purposes by that district. 25.56.020 Use permit required. A11 uses of real property of a school district, whether individual classrooms or entire sites, other than for public school classroom or administration purposes of the district, shall be conditional uses requiring a special permit pursuant to the procedures of Chapter 25.1.6. 25.56.030 General regulations. Considerations in granting, denying or conditioning such a per shall include, among others: 1. Neighborhood character within the environs of the school site. 2. Proximity to major streets and public transportation. 6/2/80 1 6/5/80 3. On-site facilities available to the proposed lessee or other organization. 4. Type of activity, hours of operation and number of employees or others regularly visiting the property. 5. Parking and traffic impacts on adjacent streets. 6. Changes to the existing school district facilities. 7. Possible continued use of the site by neighborhood children and adults. 8. Such neighborhood criteria as may be developed by the School District." Section 2. This ordinance is intended to apply only to rental or lease of school. facilities by a school district; upon the sale o.f property by a school district it shall be subject to all the zoning ordinances of the City of Burlingame and to the zoning districts as determined in Planning Commission Resolution No. 4-78. Section 3. This ordinance shall be published as required by law. Mayor I, EVELYN H.
