URGENCY ORDINANCE
EYTENDING URGENCY INTERIM ORDINANCE
IMPOSING A MORATORIUM ON PERMITS FOR
NEW CONSTRUCTION IN THE BURLINGAME
AVENUE OFF-STREET PARKING DISTRICT
The CITY COUidCIL o£ the City of Burlingame does hereby
ORDAIN as follows:
Section 1. Extension of Urgency Interira Ordinance.
Ordinance No. 1204, adopted by this Council on April 6,
1981, which ordinance imposed a moratorium on permits £or new
construction in the Burlingame Avenue Off -Street Parking District,
is hereby extended to the dates hereinafter set forth.
Section 2. Urgency.
It is hereby declared that this ordinance is an
ordinance for the immediate preservation of the public peace,
safety, health and
welfare,
and
is an emergency
measure as
pro-
vided by the law,
and shall
take
effect upon its
adoption.
The
facts constituting such urgency are as follows:
The facts as set forth in Section 2 of Ordinance 1204,
to wit, the impact of certain kinds of businesses on parking in
the Burlingame Avenue area., still exist. The Planning Commission
has completed its study as directed by that ordinance, but
personnel changes and other circumstances have not allowed the
appropriate ordinances to be presented to this Council by the
termination of the original moratorium. It is therefore neces-
sary for the existing interim ordinance to be extended to allow
time for Council consideration of the recommendations of the
Planning Commission,
Section 3. Duration.
This ordinance is intended to be an interim urgency

zoning ardinance. It shall automatically cease to have force and
effect without specific repeal upon the first occurring of the
following:
1. The City Council shall enact new use or zoning
regulations, publish the same and the same shall become
effective;
2. The City Council shall formally consider new
parking and zoning regulations and shall reject the same
or shall refuse to enact them into law: or
3.
After the
expiration of ninety (90) days from
the
date of
adoption of
this ordinance,
whichever comes first.
