URGEIICY IIQTERIM ORDINANCE IMPOSING A MORATORIUM
ON PERMITS FOR NEW CONSTRUCTION IN THE
BURLINGA2%1E AVENUE OFF-STREET PARKING DISTRICT
The CITY COUiQCIL of the City of Burlingame does hereby
ORDAIN as follows:
Section 1. IRoratorium upon permits for certain new
uses and construction. Notwithstanding any other provision of
the Burlingame Municipal Code, no application for special permit
or variance shall be filed, no building or other permit shall be
issued for, nor shall any construction be commenced upon, any new
building or any addition to existing buildings, nor any remodel
ing of existing retail or other non -office uses to office uses,
in the Burlingame Avenue Off -Street Parking District; provided,
however, that this ordinance shall not apply to any use or
building for which a special permit or variance has been granted
by the Planning Commission of this City and which permit or
variance has become final.
Section 2. Urgency. It is hereby declared that this
ordinance is an ordinance for the immediate preservation of the
public peace, safety, health and welfare, and is an emergency
measure as provided by law, and shall take effect upon its
adoption.
The facts constituting such urgency are as follows:
The present Parking District regulations which exempt the first
15,000 square feet of development are allowing significant
parking congestion in the Burlingame Avenue Off -Street Parking
District. Additionally, the increasing number of new buildings
and uses of existing buildings for offices, banks, savings and
loans, real estate, and similar businesses have altered and
imaacted the retail -commercial character of that district. It
appears that the uses permitted in said area, the location
policy for conditional uses requiring a special permit in said
area, and the parking exemptions applicable to said area should b
reviewed considering the above concerns. The Planning Commission
of the City of Burlingame is, therefore, directed by this
ordinance to pursue a study of such items in the Burlingame
Avenue Off -Street Parking District and to report to this Council
upon its determination.
Section 3. Duration. This ordinance is intended to
be an interim urgency zoning ordinance. Unless this ordinance
is extended as provided by law, it shall automatically cease to
have force and effect without specific repeal when either (1) the
City Council shall enact new parking and/or use or zoning regula-
tions, publish the same, and the same shall become effective;
(2) the City Council shall formally consider new parking and zon-
ing regulations and shall reject the same or shall refuse to enac
them into law; or (3) after the expiration of six months from the
date of adoption of this ordinance, whichever comes first.
Section 4. Publication. This ordinance will be pub-
lished as required by law.
