HomeMy WebLinkAboutOrd 1199ORDINANCE 110. 1199 UP.GETdCY ORDINANCE EXTENDING ORDINANCE IMPOSING MORITORIUM UPON APARTMENT CONVERSIONS TO RESIDENTIAL CONDOMINIUMS The CITY COUIQCIL of the City o£ Burlingame does ORDAIN as follows: Section 1. EXTENSIOTd OF MORITORIUDi UPON APARTMENT CONVERSIONS. Ordinance 1139, adopted November 3, 1980, which ordinance prohibited the conversion of apartments and other multi- unit residential buildings to condominiums, shall be extended beyond its expiration date for the duration set forth in Section 3 hereof. Section 2. URGEAlCY. It is hereby declared that this ordinance is an ordinance for the immediate preservation of the public peace, safety, health and welfare and is an urgency ordi- nance as provided by law and shall take effect upon its adoption. Facts constituting such urgency are as follows: Current ordinances allow the conversion of apartment buildings to condo- miniums with only building code and similar limitations. It appears that protections for existing tenants as well as limita- tions upon the numbers or types of apartments which may be con- verted may be necessary to protect those existing tenants as well as the housing stock within the City of Burlingame. It is there- fore necessary that the conversion of apartments to condominiums be prohibited during the period of study and formation of proposal; for such measures. It is also necessary that the existing urgency ordinance be extended to allow further study and consideration of such measures. Section 3. DURATION. This ordinances is intended to extend an interim ordinance pending the adoption of ordinances 1 establishing criteria for protection of tenants and conversion of apartments to condominiums. Unless it is extended, it shall automatically cease to have force and effect without specific repeal when either (1) the City Council enacts ani ordinance establishing any or all of such measures, publishes the same, and the same shall become effective; or (2) the City shall consider such ordinances and finally reject the same or refuse to enact them into law; or (3) after the expiration of ninety (90) days from the original date of expiration of Ordinance 1189, to wit, June 1, 1981, whichever comes first. i F Mayor � I, EVELYN H.
