HomeMy WebLinkAboutOrd 1240follows: ORDINANCE N0, 1240 URGENCY INTERIM ORDINANCE IMPOSING A MORATORIUM ON BUSINESSES SELLING FOOD, DRUGS OR SUNDRIES IN THE C-1 and C-2 DISTRICTS The CITY COUNCIL of the CITY OF BURLIfJGAME does hereby ORDAIN as Section 1. Moratorium upon rocer'V and drug establishments in C-1 and C-2 Districts. Notwithstanding any other provision of the Burlingame Municipal Code, no application for special permit shall be filed, no building or other permit shall be issued for, nor shall any construction be commenced upon, any grocery store, drug store or similar business for the sale of packaged and prepared food, drugs and sundries at retail in the C-1 and C-2 Zoning Districts Section 2. Urgency. It is hereby declared that this ordinance is 'an ordinance for the immediate preservation of the public peace, safety, health and welfare, and is an emergency measure as provided by law, and shall take effect upon its adoption. The facts constituting such urgency are as follows: There currently exists a number of markets and drugstores in the C-1 and C-2 zones f the City, many of which are located in areas of Severe parking urgency zoning and traffic impacts. Such businesses are recognized as high generators of vehicle C-2 Zones and traffic and an increase in their numbers, even meeting parking requirements, could seriously impact already heavy traffic loads in commercial areas. The Planning Commission of the City of Burlingame is therefore directed by this ordinance to pursue a study of the number, necessity urgency zoning and standards for a review of such businesses automatically in the C-1 and C-2 Zones and to report to this Council upon its determination the Section 3. Duration. This ordinance is intended to be an interim urgency zoning ordinance. Unless this ordinance is extended as provided by law it shall automatically cease to have force and effect without specific repeal when either (1) the City Council shall enact new regulations, publish same, and the same shall become effective; (2) the City Council shall e -1- formally consider new regulations and shall reject the same or shall refuse to enact them into law; or (3) after the expiration of six months from the date of adotpion of this ordinance, whichever comes first. Section 4. Publication. This ordinance shall be published as required by law. F 1` Mayor I, EVELYN H.
