HomeMy WebLinkAboutOrd 1239follows: ORDINANCE NO. 1239 The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as Section 1. Mor Notwithstanding any other provision of the Burlingame Municipal Code, no application for special permit shall be filed, ordinance is no building intended or other permit shall be issued for, nor shall any construction urgency zoning ordinance. Unless be commenced ordinance upon, any establishment for sale of food at retail in the by law M-1 Zoning District; provided, however, that this ordinance shall not apply to any such business for which a special permit has been granted by the Planning Commission of the City and which permit has become final. Section 2. Ur, enc It is hereby declared that this ordinance is Ian ordinance for the immediate preservation of the public peace, safety, health and welfare, and is an emergency measure as provided by law, and shall take effect upon its adoption. The facts constituting such urgency are as follows: There have been ',;granted a number of permits for retail sales of food in office buildings and Mother similar locations throughout the M-1 District in the City of Burlingame. The increasing number of these businesses and their impact upon the parking and character of the M-1 District indicates that standards for review and approval of such businesses needs to be established. The Planning Commission of the City of Burlingame is therefore, directed by this ordinance to pursue a study ,of the number, necessity and standards for a review of businesses for the retail sales of food in the M-1 Zone and to report to this Council upon its determin- ation. Section 3, it shall automatically cease to have farce and effect without specific repeal Duration. This ordinance is intended to be an interim urgency zoning ordinance. Unless this ordinance is extended as provided by law it shall automatically cease to have farce and effect without specific repeal when either (1) the City Council shall enact new regulations, publish the same,' and the same shall become effective; (2) the City Council shall formally consider new regulations and shall reject the same or shall refuse to enact them into law; or (3) after the expiration of six months from the date of adoption of this ordinance, whichever comes first. Section 4. Publication.
