URGENCY ORDINANCE APIENDING DEVELOPMENT F
The CITY COUfJCIL of the CITY OF BURLINGAME, CALIFORNIA, does hereby
ORDAIN as follows:
Section 1. Section 4 of Ordinance 1151, which Ordinance establishes
development fees for road improvements in certain areas of the waterfront
commercial and light industrial zones of the City of Burlingame, is hereby
amended to read as follows:
"Section 4, Fees.
Fees are hereby established for all property within the Bayfront Area
',of Benefit; one-half of said fees shall be deposited with submittal of project
assessment and one-half shall be paid prior to the approval of final framing
of the buildings or additions subject to this ordinance. Any project which
has submitted a project assessment prior to the effective date of this
.'ordinance but has not received a building permit shall pay the initial one-
half
of the fee at
the time
of
obtaining
the building
permit.
Said
fees shall
be in
the following
amounts
and
shall
be
prorated
for
portions
of
an
acre:
Land Uses
Charge
Office Uses
Restaurant Uses
Hotel Uses
Office Warehouse Uses
Car Rental Uses
Commerical Recreation Uses
$735/Thousand Square Feet
of Building
$2,325/Thousand Square Feet
of Building
$165/per Room
$420/Thousand Square Feet
of Building
$5400/per Acre
$4050/per Acre
i Uses not identified or not reasonably within the above classification
hall pay such charge as may be determined by the Director of Public Works,
subject to an appeal to the City Council. Combined uses shall pay fees for
the area of each use. Fees shall be annually reviewed and adjusted to reflect

the increase or decrease in the latest Engineering News Record Highway
Construction Cost Index, as of July 1. If a project does not proceed to
construction for reasons determined by the Council to be beyond the control of
the applicant and loses its traffic allocation, the portion of the bayfront
development fee on deposit may be returned to the applicant. Planning and
environmental fees will not be returned."
Section 2. Urgency It is hereby declared that this ordinance for
the immediate preservation of the public peace, safety, hearth and welfare,
is an emergency measure as provided by law and shall take effect upon its
adoption. The facts constituting such an urgency are as follows: The City
of Burlingame is currently undertaking traffic control and street improvement
projects in the Bayfront area, and it is necessary and desirable that funds
be raised promptly and that projects in interim phases of development be
properly and fairly assessed their portion of the fees.
Section 3. This ordinance shall supercede Ordinance 1236.
Section 4. Publication. This ordinance shall be published as
(required by law.
