AN ORDINANCE T4PKIldG RESIDENTIAL USES IN COMMERCIAL
ZONES SUBJECT TO USE PERMITS, AND REQUIRING GENERAL
PLAN CONSISTENCY
The CITY COUNCIL of the CITY OP BURLINGAME does hereby
ORDAIPd as follows:
Section 1. Section 2.5.04.080 is hereby added to
the Burlingame Municipal Code to read:
Section 25.04.080 Consistency with General or Specific
Plans and CEOA.
Approval of a zoning, rezoning, variance or use permit
Pursuant to this title shall be based on a finding that said
approval is consistent with the General Plan and applicable
specific plan adopted by the City Council. Applications for a
zoning, rezoning, variance or use permit shall be denied if found
to be inconsistent with. the General Plan or applicable specific
Plan. Prior to taking action on any application the approving
authority, i.e., Planning Commission or City Council, shall review'
the environmental status of the project for which the application
is being made. Unless the project is categorically exempt or
received a negative declaration, the approving authority shall
have certified the environmental impact report as complete and
adequate before action on the application.
Section 2. Section 25.36.020 of said Code is amended to
read:
Section 25.36.020 Permitted uses.
The following uses are permitted in the C-1 Districts,
1. Advertising structures, where such structures
are a component part of a building and used
for advertising the business therein;
2. Antique shop;

Automobile sales room, but excluding service
facilities;
4.
Barber shop;
5.
Business office or agency;
6.
Cleaning and dyeing agency;
7.
Creamery, but excluding bottling or manufacture
of dairy products;
8.
Dancing academy;
9.
Dressmaking or tailoring, but excluding
wholesale manufacturing;
10.
Electrical appliances, fixtures, radio, etc.;
11.
Hotel;
12.
Pet shop, but excluding breeding pens, boarding,
or kennels;
13.
Professional offices;
14.
Public eating establishments;
15.
Real estate offices;
16.
Shoe repair shop;
17.
Store or shop for the conduct of any retail
business as otherwise herein provided;
18.
Washing machine rental service, but excluding
laundries.
19.
Uses customarily incidental to the above uses,
and accessory buildings when located on the
same lot, provided that there shall be no
manufacturing, assembling, compounding, spraying,
processing or treatment of products other than
that which is clearly incidental and essential
to a store or business and where all products
therefrom are sold on the premises;
20.
Other uses similar in character to those
enumerated in this section which will not be
obnoxious or detrimental to the neighborhood
in which they are located;

3. Section 25.36.030 of said Code is amended to
read:
Section
25.36.030 Conditional uses requiring a special
permit.
The following are conditional uses requiring a special
permit:
1. A11 permitted uses and all uses allowed with a
conditional use permit in the R district, and
subject to the same regulations and restrictions
applying to those uses in their respective
districts, and subject to the building restrictions
prescribed in Sections 25.36.060 and 25.04.080
of this chapter;
2. Public garages;
3. Gasoline service stations, subject to regulations
prescribed herein;
4. Transportation terminal, depot, station ticket
offices and any building or structure used for
the accomodation of passengers;

5. Parking lots, subject to the regulations prescribe(
herein;
6. Mortuary;
7. Banks, savings and loan associations, small loan
companies, credit unions and similar financial
institutions;
8. Other uses similar in character to those enumerate(
in this section which will not be obnoxious or
detrimental to the neighborhood in which they are
located;
9. Any structure that is more than thirty-five feet
in height.
Section 4. This ordinance shall be published as
required by law.

do hereby certify that this foregoing ordinance was introduced at
a regular meeting of the City Council held on the 6th day of
July ,1982, and was adopted thereafter at a. regular
meeting of the City Council held on the 19th day of July ,1982
by the following vote:
