AfJ ORDINANCE REQUIRING PERMITS FOR AMUSEMENT DEVIL
The CITY COUNCIL of the City of Burlingame does ORDAIN
as follows:
Section
1. Section

Businesses
with
Amusement
Devices
For
the
Purpose
of
this
chapter,
any
person,
firm or
corporation
operating

it's
premises

than
three

amusement
devices
shall
be
required
to obtain
an
amusement
permit;
such permit shall be in addition to any other fees or licenses
otherwise required by this Code.
Section 3,
Section 6.16.055 is added to said Code to
read as follows:
6.16.055 Amusement Permit Considerations
In granting or denying the permit the Council shall
consider,
among
the
other
thing
s,
the
following
and
matters:
the
zoning
district
of
the
business;
proximity
to
the
schools,
churches
and
other businesses; hours of operation; the age of proposed
customers;
the
type
and manner
of serving food and beverages;
parking
and
traffic
impacts.
ldhile City ordinances require an amusement permit
for businesses whose primary purpose is video games there is
no provision for those businesses which install a number of such
machines as an adjunct to their existing business. Installations
of a number of video games may attract a large number of people
into an inappropriate business, may attract young people at
inappropriate times and hours, may cause traffic and other impact!
upon an existing commercial area and in aeneral may be detrimenta
to a given location in the neighborhood. It is therefore necessai
that an ordinance requiring review of installation of more than s
three video games in a single location be immediately put into
effect.
Section 6. This ordinance shall be published as
required by law. �)

do hereby certify that the foregoing URGENCY ORDINANCE was intro-
duced and adopted at a regular meeting of the City Council held on
the 15th day of March, 1982 by the following vote:

All

businesses
having
more
than
three
amusement
devices
shall
within
thirty
days
of
the
adoption
of this
ordinance
either
reduce
the
number
of
machines
upon
their
premises
to
three
or shall
apply
to
this
Council
for
an
amusement
permit
pursuant
to
this
ordinance.
Section
5.
Urgency.
It
is
hereby
declared
that
this ordinance
is
an ordinance
for
the
immediate
preservation
of
the public
peace,
safety,
health
and
welfare
and
is
an
emergency
measure
as
provided
by
law
and
shall
take
effect
upon
it's
adopt-
ion.
The
facts
constituting
such
emergency
are
as
follows:
