(8:35 p.m.) Stivers CITY PLANNING COMMISSION Burlingame, California Regular Meeting March 29, 1951 - 8 p.m. Absent Others Present Henderson City Attorney Karmel City Clerk White City Engineer Marr City Building Inspector Watson At this meeting there was held a public hearing of a petition to change the zoning from "Apartment" to "Commercial" affecting a portion of Lots 5A and 5B, Block 3, Town of Burlingame, known as 1321 Bayswater Avenue, Burlingame. L. J. VETTER, real estate broker, representing the owner, appeared. He said that all the property in the same block, except this parcel, is zoned for business purposes and that he has not been successful in selling this property for residential purposes. City Attorney Karmel was present and advised that the proper procedure in this particular situation is to pe- tition for a variance and he expressed the opinion that the Planning Commission could grant a limited variance for specific use of the property facing on Bayswater Avenue. Mr. Vetter responded that the contemplated use of the property is for a real estate office. Mr. Karmel further advised the Planning Commission that it has authority to recommend variance for professional use and he suggested that business signs not be I� allowed on E1 Camino Real but restricted to the Bayswater Avenue frontage. Robert 0. Sherman appeared and asked if business is excluded from property on El Camino Real. He was informed of the zoning ordinance. Commissioner Brown made a motion that the Planning Commission should deny this petition for a variance affecting this lot on the corner of Bayswater Avenue and El Camino Reai. At this point in the hearing Walter Van Tyne spoke in favor ofthis petition saying that his property is the only parcel in this block on Bayswater not zoned for commercial purposes and he asked rezoning for business purposes. Chairman Mitchell explained that part of the subject property is also on El Camino Real and suggested that more time for further consideration be given to this. Commissioner Brown withdrew his motion to deny the petition and Dr. Macomber moved that the matter be put ahead 30 days, which motion was unanimously adopted. Proposed resubdivision of Lot 36 and a Portion of Lot 33, Block 9, Map of Subdivision No. 2. City Clerk White appeared and reported that the owner requested this petition be withdrawn as he had decided to build a residence on the lot as it is. MRS. BERTOIA appeared and inquired if it would be possible to rezone a lot on Channing Way and Howard Avenue from "Residential" to "Duplex." It was explained to her that the Planning Commission could not favor the spot zoning of one lot and that at some future time the entire area may be considered. MR. COOK appeared and inquired about a proposed resubdivision of property lo- cated at Hillside Drive and Adeline. After inspection of the map, Mr. Cook was given informal approval subject to presentation of the matter in proper form. A communication dated March 17 was read from Jack P. Shaffer, real estate broker, as follows: "City Planning Commission, City of Burlingame, 267 Park Road, Burlingame, California Gentlemen: In regards to the following described nrnnPrty! Continuation - MINUTES - Burlingame City Planning Commission Page 2 March 29, 1951 "It seems that mention has been made to the owners, namely Agnes Sullivan and Helen Sullivan that it may be possible that the property is to be changed to Business zoning or that there may be a possibility of it being changed to such a zoning. Will you be kind enough to clarify and answer the above question and in doing so will you write me in duplicate so that I may forward a copy to the Sullivans. If there is or has been any application to change this property would you also state that. Your early answer to this letter is requested with thanks. Very truly yours, JPS:cv (signed) Jack P. Shaffer Property Description: Lot No. 10 and Portion of Lot No. 1 of Burlingame Land Co., Map No. 2 Portion of Lots B and 18, Block 10, No. 2 Burlingame Land Co. and said lot being on the East line of El Camino Real, 129' South from the corner of Bellevue Ave., and extending southerly 109' along said E1 Camino Real." The Secretary was instructed to inform Mr. Shaffer that there has been no movement to re- zone property on El Camino Real. Building Inspector Watson presented plans for alteration of a non -conforming structure at 1516 Ralston Avenue. This was put over for legal opinion. City Building Inspector Watson presented plans for a proposed apartment house to contain five units to be constructed on Lot 4, Block 2, Burlingame Shore Land Co., Subdivision 1 at Bayshore Service Road and Marin Drive; Owner, Paul C. Smith. Approved. City Building Inspector Watson presented plans for duplex to be constructed on Lot 12, Block 1/., Easton Addition, Owner T. Agorastos, 925 Paloma Paloma Avenue, near Edgehill Drive.
