Present Absent Mitchell Brown Harris Macomber Henderson Stivers This was a special meeting to continue the consideration of the petition to rezone the property at 1321 Bayswater Avenue from "Apartment" to "Commercial" zone. A public hearing was held on this petition at the Regular Meeting of the Planning Commis- sion March 29, 1951. After that hearing the matter was put ahead 30 days for further consideration. When the subject came up again at the meeting April 26, 1951 there was not a quorum and it was concluded to hold a special meeting May 1, 1951. At this special meeting consideration was given to the location of this property, the front of which is on Bayswater Avenue and the sideline faces El Camino Real. There was a full discussion of the objections to spot zoning and the granting of any variances for busi- ness purposes affecting properties on El Camino Real which is zoned for "Apartments". After discussion and consideration, Commissioner Harris introduced a motion to reject the petition to rezone, which was seconded by Dr. Macomber. On roll call the vote was as follows to reject rezoning from "Apartment" to "Commercial:" Yes No Mitchell bone Harris Macomber Absent Henderson Stivers Brown L. J. Vetter, representing the owner, and Walter Van Tyne, owner of the property, were present. Mr. Van Tyne related that he purchased the property a number of years ago at a price of $+12,500 and would now like to dispose of it. He finds that he is unable to sell it for residential purposes and he urged rezoning or a variance in order that the property might be used for limited business purposes. After further discussion and consideration, Commissioner Harris made a motion, which was seconded by Dr. Macomber, that the Planning Commission recommends to the ity Council that a variance be granted subject to the following limitations n roll call the vote was as follows: A"\ r Yes No l 5) Mitchell Stivers IL Harris Macomber Absent Henderson Brown In explanation of voting "No", Commissioner Stivers explained t�l, at he did not believe it would be good planning practice to recommend spot zoning or^variance`* and particu- larly with reference to property along E1 Camino Real which is zoned for "Apartments." Continuation - MINUTES - Burlingame City Planning Commission Page 2 Special Meeting - May 1, 1951 There have been many requests for spo zoning or variances at these various corners along E1 Camino Real and it has been the policy of the Planning Commission and the City Council and of the citizens of the community to avoid the extension of business use property in Burlingame on El Camino Real. . 1. That the use of the property shall be subject to all restrictions now pre- vailing in the area. 2. No vehicular entrance or exit on E1 Camino Real or Bayswater Avenue. 3. No sign display on E1 Camino Real or Bayswater Avenue. All other signs shall be approved by the Planning Commission. !�. Subject to the further restriction that occupancy shall be limited to the following uses, provided such usage is strictly confined to consulting professional practice without any adjunctive merchandising. Architecture Structural or civil engineering City Planning or planning consultants Mechanical engineering in its various branches Medicine Dentistry Landscape architecture Law 5. And further, limited to semi-professional use within the following categories: Real Estate Insurance Certified Public Accounting Studios for instruction in nursing and other arts Meeting adjourned 9:35 p.m. �[ r D.
