History: On November 26, 2001, the Planning Commission approved by consent calendar a conditional use
permit to allow retail clothes sales at 210 California Drive, zoned C-2, Subarea D(conditional use permit
required for non-automobile related retail sales in this zoning district) (November 26, 2001 P.C. Minutes). The
retail clothing business recently closed and the applicant would now like to propose a retail use which is non-
automobile related (rug sales and instrument repair). The applicant currently has a retail rug sales business at 218
California Drive (conditional use permit granted in September, 2000). This building contains five tenant spaces
with frontage on California Drive between 210 and 218. This applicant would use one at each end of the five,
with the three middle spaces leased to other tenants.
Summary: The applicant is proposing to open a retail rug sales and music instrument sales and repair business at
210 California Drive, zoned C-2, Subarea D. Any retail use other than those related to automobile sales, service,
and storage are allowed only with a special permit in Subarea D, Auto Row.
The proposed retail business would occupy the entire 1,750 SF space. The applicant is proposing to sell rugs and
offer music instrument sales and repair at this site. There are no exterior changes proposed, so commercial
design review is not required for this project. Most of the 1,750 SF space would be used for the sales area and
instrument repair. The rear of the space includes a 216 SF storage room, a 90 SF office, and a 144 SF restroom
behind the sales floor (all included in the 1,750 SF total). The store hours would be 10:00 a.m. to 7:00 p.m.,
seven days a week. There would be two full-time employees working at the store, with an increase to three in the
next two to five years. It is anticipated that there would be 5 customers visiting the site on weekdays and 10
customers on weekends, and that number is expected to stay the same in two to five years. The applicant expects
a maximum of six people on-site at any one time.
Conditional Use Permit 210 California Drive
The subject property is a through lot with frontage on California Drive on the west side and West Lane on the
east side, at the rear. There are a total of six retail spaces (including 210) that are on this parcel. Four of the
spaces (including 210) front on California Drive and two of the spaces front on West Lane. The previous use of
this space was a retail clothing store. The adjacent uses along California Drive include a retail furniture store, a
rug store, and the Pez Museum. The retail spaces at 210 and 216 California Drive are currently vacant. The
businesses at the rear of the parcel along West Lane include a pet salon and a car stereo and alarm store.
The building is non-conforming with no on-site parking available. The code requires retail uses to provide one
on-site parking space per 400 SF. Based upon this standard, 5 on-site parking spaces are required for a retail use
in this space. The previous use of the space, a retail clothing store, was considered a retail use, therefore no
additional parking is required because the use is staying the same and the nonconformity is not being increased.
The applicant notes that merchandise for this tenant space will be delivered to the existing rug sales business at
218 California Drive, approximately one to two times a week during operating business hours. Select
merchandise will then be moved to 210 California Drive by the applicant.

Staff Comments: The Chief Building Official, City Engineer, Fire Marshal and Recycling Specialist reviewed
this request and had no comments.
Study Meeting: At the Planning Commission study meeting on July 14, 2003, the Commission asked several
questions regarding the proposed application (July 14, 2003, P.C. Minutes). The applicant addressed the
Commission's concerns in a written response dated August 22, 2003, which is included in your staff report for
review. The following are questions asked by the Commission and a response to each question provided by the
applicant:
1. Clarify the number of tenant spaces and businesses at the rear of this building facing West Lane.
• Planning staff visited the site and noted that there are two existing businesses with frontage on West
Lane; Rock and Roll Auto Stereo and Alarms at 211 West Lane; and The Bark Station (pet grooming) at
217 West Lane.

2. Clarify where deliveries will be made, staff report indicates deliveries will be made to 218 California Drive,
but also indicates that 218 California Drive is vacant.
Planning staff notes that the staff report contained an error. The staff report should have indicated that
210 and 216 California Drive are currently vacant, not 218 California Drive. The applicant is currently
operating a retail rug sales business at 218 California Drive. All deliveries will be made to 218 California
Drive and select merchandise will be moved by the applicant to 210 California Drive.
3. Explain why there will be an increase in the number of employees in 2-Syears, but no increase in the number
of customers.
The applicant notes that the number of employees will increase because he will be doubling the retail
space by adding 210 California Drive. The number of customers will not increase because a large
percentage of his business includes internet sales and shipping merchandise directly to the customers,
which does not require customers to visit the site.
4. This is a unique combination of retail rug sales and music instrument repair, provide more detail about the
services offered by the proposed business. Explain what is involved in the music instrument repairportion of
the business? What type of instruments will be repaired?
• The applicant notes that in addition to selling rugs, he would also sell and repair musical instruments.
The repair would be on woodwind and brass instruments.
S. Applicant inc�icates a total of five customers to visit the site on weekdays, this number appears low for the
proposed hours of operation, please explain.
The applicant estimates a total of 1-2 customers per day by appointment. A low number of customers are
expected at this site since sales are done over the internet and since merchandise is shipped directlyto the
customer. Customers include buyers for larger retail stores.
6. Where will the employees park?
• The applicant indicates that there are approximately 20 parking spaces behind the building which are
leased from Caltrain. These parking spaces are specifically designated for and shared by all the
customers and employees for the businesses on California Drive and West Lane.
7. Applicant currently is operating this business on Broadway, parking does not seem to be a problem there and
is manageable, please have applicant explain the parking situation at the Broadway site and compare to this
site.
• The applicant notes that there are many available parking spaces along California Drive and behind the
building. This location offers better parking opportunities than the cunent business on Broadway.

210 California Drive
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or
convemence;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to
secure the purposes of this title and to assure operation of the use in a manner conipatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be taken by resolution and should include findings for the conditional use permit. The reasons for any
action should be clearly stated. At the public hearing the following conditions should be considered:
Conditions:
that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped June 20, 2003;
2. that the 1,750 SF tenant space at 210 California Drive shall be used as a retail rug store business as
described with emphasis on internet sales and for a music instrument repair business, any expansion of
the leased space, number of employees exceeding three on this site at one time, and/or a change to the
hours of operation from 10:00 a.m. to 7:00 p.m., seven days a week, shall be brought to the Burlingame
Planning Commission for approval; and
3. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001
edition, as amended by the City of Burlingame.

RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND CONDITIONAL USE PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
conditional use permit for non-automobile related retail sales (retail rug sales and instrument repair� at 210
California Drive, zoned C-2, Subarea D, Samuel Samson, propertyo uwner, APN: 029-213-030;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
September 8, 2003, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15301, Class 1(a), interior or exterior alterations involving such things as interior
partitions, plumbing and electrical conveyances.
2. Said conditional use permit is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said
meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

effective September 18, 2003
1. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped June 20, 2003;
2. that the 1,750 SF tenant space at 210 California Drive shall be used as a retail rug store business as
described with emphasis on internet sales and for a music instrument repair business, any expansion of
the leased space, number of employees exceeding three on this site at one time, and/or a change to the
hours of operation from 10:00 a.m. to 7:00 p.m., seven days a week, shall be brought to the
Burlingame Planning Commission for approval; and
3. that the project shall meet all the requirements of the California Building and Uniforni Fire Codes,
2001 edition, as amended by the City of Burlingame.
