Minutes). The retail clothing business recently closed and the applicant would now like to propose a retail use which is non- automobile related (rug sales and instrument repair). The applicant currently has a retail rug sales business at 218 California Drive (conditional use permit granted in September, 2000). This building contains five tenant spaces with frontage on California Drive between 210 and 218. This applicant would use one at each end of the five, with the three middle spaces leased to other tenants. Summary:. The applicant is proposing to open a retail rug sales and music instrument repair business at 210 California Drive, zoned C-2, Subarea D. Any retail use other than those related to automobile sales, service, and storage are allowed only with a special permit in Subarea D, Auto Row. The proposed retail business would occupy the entire 1,750 SF space. The applicant is proposing to sell rugs and offer music instrument repair service at this site. There are no exterior changes proposed, so commercial design review is not required for this project. Most of the 1,750 SF space would be used for the sales area and instrument repair. The rear of the space includes a 216 SF storage room, a 90 SF office, and a 144 SF restroom behind the sales floor (all included in the 1,750 SF total). The store hours would be 10:00 a.m. to 7:00 p.m., seven days a week. There would be two full-time employees working at the store, with an increase to three in the next two to five years. It is anticipated that there would be 5 customers visiting the site on weekdays and 10 customers on wcckends, and that number is expected to stay the same in two to five years. The applicant expects a maximum of six people on-site at any one time. The subject property is a through lot with frontage on California Drive on the west side and West Lane on the east side, at the rear. There are a total of six retail spaces (including 210) that are on this parcel. Four of the spaces (including 210) front on California Drive and two of the spaces front on West Lane. The previous use of Coraditional Use Permit 210 C.alifornia Drive this space was a retail clothing store. The adjacent uses along California Drive include a retail furniture store,a rug store, and the Pez Museum. The retail spaces at 216 and 218 California Drive are currently vacant. The businesses at the rear of the parcel along West Lane include a pet salon and a car stereo and alarm store. The building is non-conforming with no on-site parking available. The code requires retail uses to provide one on-site parking space per 400 SF. Based upon this standard, 5 on-site parking spaces are required for a retail use in this space. The previous use of the space, a retail clothing store, was considered a retail use, therefore no additional parking is required because the use is staying the same and the nonconformity is not being increased. The applicant notes that merchandise for this tenant space will be delivered to the existing rug sales business at 218 California Drive, approximately one to two times a week during operating business hours. Select merchandise will then be moved to 210 California Drive by the applicant. Proposed Existing Allowed/Req'd. Categorically Exempt per Section: 15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Previous Use: Furniture Sales - California Futon Proposed Use: Retail Sales - Oriental Rugs Allowable Use: Retail use other than those related to automobile sales and services with a Conditional Use permit. Summary: The applicant, A1 Heriz, is requesting a Conditional Use Permit for a retail use for operation of a retail rug store in an existing building at 218 California Drive. Any retail use which is not related to automobile sales and service requires a Conditional Use Permit in the C-2, Subarea D zoning district. The previous use of this tenant space was California Futons, a furniture store. The store will be open seven days a week, 10:00 A.M. to 7:00 P.M. The store intends to have 2 full-time employeeS and one part-time employee seven days a week. The number of employees is expected to stay the same over a five year period. The maximum number of customers expected to come to the site per day is 3 on weekdays and 5 on weekends. The maximum number of people on site at any one time is expected to be four. The building has no on-site parking and is e�sting nonconforming in parking because it was built prior to the code requirements for parking. Since this use is a replacement of an existing retail use a parking variance is not required. The building owner leases unimproved land adjacent to the Caltrain railroad tracks behind the building across East Lane, which is available for customer parking. The leased area is not paved or striped so the exact number of spaces available is unclear. The leased area is 15' x 200'. The lease is a one-year lease which is automatically renewed each year, and can be terminated by Caltrain on 15 days written notice. The lease has been in effect since 1981. Public parking is available on the street and in Lot V, across Burlingame Avenue from the site, and in Lot M, across California Avenue from the site. There are four other tenant spaces in this building, Computer Spectrum, an internet publisher, Rock & Roll, auto stereo and alarms, Bark Station, a dog grooming business, and a vacant tenant space. The five tenants share a restroom facility located towards the rear of the building. Conditional Use Permit for Retail Sales Use: Parking: Proposed *Retail, Rug Store 0 *Conditional Use permit required for retail use. This project meets all other zoning code requirements. Conditional Use permit for non-auto retail use 0 Site is existing nonconforming in parking - req. pkg. ratio is 1:400 GSF Staff Comments: The Chief Building Inspector, the City Engineer and the Fire Marshal had no comments on this project. Study Meeting: At the August 14, 2000 Planning Commission study meeting, the commission asked what was the estimated number of customers daily at the existing futon shop. Planning staff would note that the futon shop operator estimated that 17 customers per day would visit the site on weekdays and 23 customers per day on weekends. The commission noted that the maximum number of daily customers estimated for the rug shop seemed low, would the applicant review this number. The applicant has submitted the attached letter date stamped August 17, 2000 which states that they expect 2-3 customers per day on weekdays and 3-5 customers per day on weekends. He notes that he feels this projection is correct, because most of their clients are business customers buy larger numbers of rugs and are seen by appointment. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. 2l8 California Drive Previous Allowed/Req'd Retail, Furniture Store Findings: Based on the fact that the proposed business is similar in nature to the previous retail use on the site (furniture store), the business is found to be compatible with other uses in the area and complies with the findings for a conditional use permit. Conditional Use Permit for Retail Sales 218 California Drive Commission Action: The Planning Commission should hold a public hearing. Af�irmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: Conditions: that the tenant space shall be operated as shown on the plans submitted to the Planning Department and date stamped June 27, 2000, and access to the shared bathroom facilities shall be maintained; 2. that the business shall not be open for business except during the hours of 10:00 a.m. to 7:00 p.m, seven days a week, and if the number of customers exceeds 20 per day, this permit shall be reviewed; that if property owner loses the lease to the supplemental parking provided on the Caltrain right-of-way, he shall inform the City of the change and the conditional use permit for the non-auto related use shall be subject to review; 4. that the area leased for parking from Caltrain shall be posted for the use of employees and customers of tenants of this site and parking usage shall be enforced by the property owner; and 5. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1998 Edition, as amended by the City of Burlingame. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the cnvirorunent, and categorical exemption, per CEQA Article 19, Section 15301 - existing facilities, Class 1(a), interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances is hereby approved. 2.
