Categorically Exempt per Section: 15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Previous Use: Furniture Sales - California Futon Proposed Use: Retail Sales - Oriental Rugs Allowable Use: Retail use other than those related to automobile sales and services with a Conditional Use permit. Summary: The applicant, A1 Heriz, is requesting a Conditional Use Permit for a retail use for operation of a retail rug store in an existing building at 21 S California Drive. Any retail use which is not related to automobile sales and service requires a Conditional Use Pernut in the C-2, Subarea D zoning district. The previous use of this tenant space was California Futons, a furniture store. � The store will be open seven days a week, 10:00 A.M. to 7:00 P.M. The store intends to have 2 full-time employee and one part-time employee seven days a week. The number of employees is expected to stay the same over a five year period. The maximum number of customers expected to come to the site per day is 3 on weekdays and 5 on weekends. The maximum number of people on site at any one time is expected to be four. The building has no on-site parking and is existing nonconforming in parking because it was built prior to the code requirements for parking. Since this use is a replacement of an existing retail use a parking variance is not required. The building owner leases unimproved land adjacent to the Caltrain railroad tracks behind the building across East Lane, which is available for customer parking. The leased area is not paved or striped so the exact number of spaces available is unclear. The leased area is 15' x 200'. The lease is a one-year lease which is automatically renewed each year, and can be terminated by Caltrain on 15 days written notice. The lease has been in effect since 1981. Public parking is available on the street and in Lot V, across Burlingame Avenue from the site, and in Lot M, across California Avenue from the site. There are four other tenant spaces in this building, Computer Spectrum, an internet publisher, Rock & Roll, auto stereo and alarms, Bark Station, a dog grooming business, and a vacant tenant space. The five tenants share a restroom facility located towards the rear of the building.
