Summary: The applicants are proposing to open a woman's retail clothing store at 210 California Drive, zoned
C-2, Subazea D. Any retail use other than those related to automobile sales, service, and storage are allowed only
with a special permit in Subarea D.
The proposed retail store would occupy the entire 1,750 SF space and would carry casual women's clothing and
shoes. There are no exterior changes proposed, so Commercial Design Review is not required for this project.
There arc however, interior alterations proposed. Most of the 1,750 SF space would be used for the sales area,
with dressing rooms at the rear of the sales floor, a 216 SF storage room, a 90 SF office, and a 144 SF restroom
behind the sales floor (all included in the 1,750 SF total). The store hours would be 10:00 a.m. to 7:00 p.m.
Monday through Friday, and 11:00 a.m. to 6:00 p.m. Saturday and Sunday. There would be two employees
working at the store, with an increase to three in the next two to five years. It is anticipated that there would be
10 customers visiting the site per day, and that number is anticipated to increase to 15 customers per day in two
years, and 20 customers per day in five years. The maximum number of people expected on-site at any given
time is between two and five.
The subject property is a through lot with frontage on California Drive on the west side and West Lane on the
east side, at the rear. There are a total of six retail spaces (including 210) that are on this parcel. Four of the
spaces (including 210) front on California Drive and two of the spaces front on West Lane. The previous use
of this space was a photography studio. The adjacent uses along California Drive include a rug store, a computer
store, and the Pez Museum which is a part of the computer store space. The space at 216 California Drive is
currently vacant. The businesses at the rear of the parcel along West Lane include a pet salon and a car stereo
and alarm store.

Condrtional Use Permit 2/0 California Drive
The building is non-conforming with no on-site parking available. The code requires retail uses to provide one
on-site parking space per 400 SF. Based upon this standard, 5 on-site parking spaces are required for a retail use
in this space. The previous use of the space, a photography studio, was considered a retail use, therefore no
additional parking is reyuired and the nonconformity is not being increased.
The applicants have stated that there will be about two merchandise deliveries a week between the hours of 12:00
p.m. noon and 3:00 p.m..

Study Meeting: At the November 13, 2001 Planning Commissio�i study meeting, the Commission had the
following questions:

proposed business at 210 California Drive;
+ How did the applicant anive at 10 customers per day for the first year of business, with an increase to
• 15 the second year and 20 customers in five years;
• Where will the merchandise delivery vehicles park;
• How will the employccs get to work; and
• Where will the employees park their cars.
The applicant has responded to all of the Planning Commission's questions. Two of the parking spaces in the
Caltrain leased space on West Lane will be designated by the leaseholder to the applicant's business. The
customer count was an estimate on the part of the applicant. They determine that if they have an average of 10
customer s per day in the first year of business, that some of those customers will become repeat shoppers at the
store in addition to new shoppers, therefore the regular shopper base would grow over five years. Thc
merchandise deliveries would be at the rear of the store, with trucks parking on West Lane. The other businesses
along the block currently follow this delivery practice. There are currently only two employees (the business
owners) proposed to work at the shop. One of the owners would drive to work and park in one of the designated
spots along West Lane, and the other owner would take the train to work most of the time. If she chose to drive
occasionally there would be a parking spot for her at the rear of the shop along West Lane. Customers will park �,,,,�

Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare,
or convemence;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Findings: Based on the fact that the clothing store is replacing an existing retail use, that the use as proposed '•'�"'
will be limited to a maximum of 3 employees, and that deliveries will be at the rear of the store along West Lane,
the proposed use is found to be compatible witl� ttie required findings for a conditional use permit.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action
should be taken by resolution and should include findings. The reasons for any action should be clearly stated.
At the public hearing the following conditions should be considered:
Conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped October 26, 2001; and
2. that the 1,750 SF tenant space at 210 California Drive shall be used as a retail clothing store, any
expansion of the leased space, number of employees exceeding 3 on this site at one time, and/or a change
to the hours of operation from 10:00 a.m. to 7:00 p.m. Monday through Friday, and 11:00 a.m. to 6:00
p.m. Saturday and Sunday shall be brought to the Burlingame Planning Commission for approval; and
that the project shall meet all the requirements of the California Building and Uniform Fire Codes,
1998 edition, as amended by the City of Burlingame.

Senior Planner Brooks presented a summary of the staff report. Commissioners asked: on the
drawings, 12 parking spaces are shown on property leased from the railroad across West Lane, how
many of these are designated for this tenant space; how did the applicant amve at ten customers per day
for the first year, 15 in the second year, and 20 customers per day in five years; where will merchandise
delivery vehicles park; where will employees park, how will they get to work.
This item was set for the consent calendar when all the information has been submitted and reviewed by

How will the proposed structure or use within the structure affect neighboring properties or structures on those properties? If
neighboring properties will not be affected, state why. Think about traffic, noise, lighting, paving, landscaping sunlighdshade, views
from neighboring properties, ease of maintenance.
Why will the structure or use within the structure not affect the public's health, safety or general welfare?
Pub/ic health includes such things as sanitation (garbage), air quality, discharges into sewer and stormwater systems, water supply
safety, and thing which have the potential to affect public health (i.e., underground storage tanks, storage of chemicals, situations which
encourage the spread of rodents, insects or communicable diseases).
Public safetv. How will the structure or use within the structure affect police or fire protection? Will alarm systems or sprinklers be
installed? Could the structure or use within the structure create a nuisance or need for police services (i.e., noise, unruly gatherings,
loitering, traffic) or fire services (i.e., storage or use of flammable or hazardous materials, or potentially dangerous activities like
welding, woodwork, engine removal).
General we(fare is a catch-all phrase meaning community good. Is the proposal consistent with the city's policy and goals for

RESOLUTION APPROVING CATEGORICAL EXEMPTION,
AND CONllITIONAL USE APPLICATION
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
conditional use permit for non-automobile related retail sales in Subarea D of the Burlingame Avenue
Commercial Area at 210 California Drive, zoned C-2, Isaac and Evelyn Baumelgruen, property owners, APN:
029-213-030;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
November 26, 2001, at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received
and addressed by this commission, it is hereby found that there is no substantial evidence that the project set
forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article
19. Categorically Exempt per Section: 15303 — Class I- the operation repair, maintenance, or minor alteration
of existing public or private structures, facilities, mechanical equipment, or topographical features, involving
negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or
exterior alternations involving such things as interior partitions, plumbing, and electrical conveyances.
2. Said categorical exemption and conditional use permit are approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the
minutes and recording of said meeting.
It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 26, 2001; and
2. that the 1,750 SF tenant space at 210 California Drive shall be used as a retail clothing store,
any expansion of the leased space, number of employees exceeding 3 on this site at one time,
and/or a change to the hours of operation from 10:00 a.m. to 7:00 p.m. Monday through
Friday, and 11:00 a.m. to 6:00 p.m. Saturday and Sunday shall be brought to the Burlingame
Planning Commission for approval; and
3. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 1998 edition, as amended by the City of Burlingame.
