Categorically Exempt per Section: 15303, Class 3—(a) construction of a limited number of new, small facilities or structures including (a) one single family residence or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences maybe constructed or converted under this exemption. Summary: Parcel Map for Lot Line Adjustment (Please refer to attached Public Works Memo dated January 29, 2003). The site on Bernal Avenue consists of two parcels. The eastern parcel (1544 Bernal) has 75 feet of frontage on Bernal Avenue and is 9,000 SF. The western parcel has 65.47 feet of frontage on Bernal Avenue and is 8,040 SF. Mills Creek runs along the left side of the western parcel. The two parcels are not merged by any residential structures or related parking uses and are independently buildable lots. The western parcel was created in 1960 when the rear portions of 1556 Bernal Avenue and 1925 Devereux Drive were divided off to create a 8,040 SF parcel that fronted on Bernal Avenue. Since its creation the western parcel has been owned by the property owner at 1544 Bernal Avenue. Staff would note that there is a discrepancy in way the western property was recorded when it was created in 1960 by San Mateo County and by the City of Burlingame. San Mateo County recorded the property as two separate parcels, a northern parcel that was divided from 1925 Devereux Drive and a southern parcel that was divided fram 1556 Bernal Avenue. The City of Burlingame, however, recorded the two lot segments as a single parcel. The site plan on Sheet A.2, submitted by the applicant, shows a lot line bisecting the western parcel, but in fact the City of Burlingame recognizes this property as a single parcel or lot. There is an existing two-story, single-family dwelling on the parcel at 1544 Bernal Avenue. There is a 10-foot public utility easement running from north to south along the property line dividing the two parcels, but the easement is located entirely on the western parcel. The easement is currently used for aboveground PG&E poles. There is a pole located halfway down the existing easement that supplies power to 1544 Bernal Avenue and to the two properties across the creek at 1556 Bernal Avenue and 1925 Devereux Drive. The applicant is proposing to demolish the existing house at 1544 Bernal Avenue, to move the existing boundary line between the two parcels 25 feet to the east, and to abandon the existing 10-foot public Parcel Mup for Lot Lir:e Ar� i�shnent; 1544 Bernal Avenue Design Review for a New, 1544 Beriial Averaue Tx�o-Ston� Dwelli�rg til�ith a Detac/�erl Carage. utility easement and establish a new 10-foot easement that straddles the new property line so 5-feet of the easement is on each parcel. This would create a 10,200 SF lot at 1550 Bernal Avenue and a 6,840 SF lot at 1544 Bernal Avenue. The result of the shift of the property line would be to make the property at 1550 Bernal developable, with 60% of the lot area as buildable land outside of the creek. Otherwise this lot would not meet the City's current development requirements. The proposed eastern parcel at 1544 will 11ave a 50-foot frontage on Bernal Avenue and a 5-foot public utilities easement running the length of the left side of the property. The proposed western parcel at 1550 Bernal Avenue will have a 90.47-foot frontage on Bernal Avenue and a 5-foot public utilities easement running the length of the right side of the property. The existing power pole will have to be re-located to within the boundaries of the new easement. The parcel at 1550 Bernal Avenue will require a private sewer easement across 1544 Bernal Avenue to connect to the main in the easement east of that property. 1544 Bernal Avenue The applicant is proposing a new, two-story, single-family dwelling with a detached garage at 1544 Bernal Avenue. The proposed floor area on the parcel will be 3,522 SF (0.51 FAR) where 3,689 SF (0.54 FAR) is the maximum allowed. There are 5 bedrooms in the proposed dwelling and the proposed 2-car detaclled garage meets the code requirements for covered parking spaces on the site. All other zoning code requirements have been �net. Planning staff would note that at the February 10, 2003 design review study meeting, the applicant withdrew the dwelling at 1550 Bernal Avenue from the application. At this time, the Commission is only taking action on the parcel map and the dwelling on the new lot created at 1544 Bert�al Avenue. Planning staff would also note that the applicant proposes to remove two protected-size Eucalyptus trees on the parcel for 1550 Bernal Avenue that are located outside the footprint of the proposed dwelling. These two trees will require a Tree Removal permit from the Parks and Recreation Department which must be applied for and approved Uefore a building permit is issued, or the project will need to be re-designed to preserve the trees. A Certified Arborist report submitted by the applicant and date stamped February 13, 2003, finds that in addition to the two Eucalyptus trees the applicant proposes to remove, there are three other protected size trees on the site, including two Coast Live Oaks next to the creek at 1550 Bernal Avenue and a Magnolia in the front yard of 1544 Bernal Avenue. Conditions for approval numbered 15 and 16 address the protection and post-construction maintenance of these trees. Design Review Study Meeting: At the Planning Commission design review study meeting on February 10, 2003, the Commission moved to place this item on the consent calendar, with the followin� direction given to the applicant (February 10, 2003, Planning Commission Minutes): 3 Parccl Map for Lot Gr�ne Adjustntent; 1544 Bernal ,Avefi:se Design Review fo�• a New, 1544 Berrinl A��e�aue Two-Sto�y Du�elling tit�ith n Detached Curcage. • chimney is drawn incorrectly on the front elevation; • investigate a steeper roof pitch, perhaps a 6:12 pitch; this house is teetering between a shingle and a Craftsman design and a steeper roof might be more appropriate; • the columns at the entry porch just die into the eave, design could be improved by adding a beam at the top; • what material will be used for the roof over the curved element at the rear; comp will work, but you have the option of copper, which could really add something special; and • would like to see a Certified Arborist report to address tree protection measures on the site. The applicant submitted revised plans and a Certified Arborist Report (see attached), date stamped February 13, 2003, in response the Commission's suggestions. Revisions to the plans include: � chimney has been revised on the front elevation; • tl�e roof pitch has been changed from 5:12 to 7:12; and • the columns at the entry porch have been revised from two single floor to ceiling columns to two double columns on a stone pedestal, and a wood trim detail has been added below the roof line. Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the Council on A�ril 20, 1998 are outlined as follows: Compatibility of the architectural style with that of the existing character of the neighborhood; 2. Respect for the parking and garage patterns in the neighborhood; 3. Architectural style and mass and bulk of structure; 4. Interface of the proposed structure with the structures on adjacent properties; and 5. Landscaping and its proportion to mass and bulk of structural components. Findings: Based on the findings stated in the attached minutes of the Planning Commission's February 10, 2003, design review study meeting, that the Craftsman design of the proposed dwelling fits in with the existing houses in the neighborhood, that the design of the house follows the shape of the lot and reduces the mass, that the side setbacks have been increased so that the house will not have a detrimental impact on the neighboring properties, and that the lot line adjustment will provide buildable land for the lot adjacent to the creek, the project is found to be compatible with the requirements of the City's five design review guidelines and the parcel map is recommended to the City Council for action. Planning Commission Action: The Planning Commission should hold a public hearing. At the public hearing the following conditions should be considered: that the project shall be built as shown on the plans submitted to the Planning Department date stamped February 13, 2003, sheets A.1 through A.6 and sheet L1, and that any changes to building materials, exterior finishes, footprint or floor area of the building shall require an amendment to this permit; 2. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to Planning Commission review; 3. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional sllall provide architectural certification that the architectural details such as window ]ocations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the property owner or contractor shall provide the certification under penalty of perjury; 4. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans; 5. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issued; 6. that the conditions of the City Engineer's and the Fire MarshaPs November 25, 2003, memos, and the Recycling Specialist's November 26, 2003memo shall be met; 7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 8. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; 9. that prior to schedulin� the foundation inspection a licensed surveyor shall locate the property corners and set the building envelope; 10. that prior to underfloor frame inspection the surveyor shall certify the first floor elevation of the new structure(s) and the various surveys shall be accepted by the City Engineer; 11. that during demolition of the existing residence, site preparation and construction of the new residence, the applicant shall use all applicable "best management practices" as identified in Parcel Map for Lot Line Arfjustrnent,- 1544 Bernnl Avenue Design Review for• a New, 1544 Bernal Avenue Titi�o-Stoi�� Dx�ellir:g with a Detached Garage. Burlingame's Storm Water Ordinance, to prevent erosion and off-site sedimentation of stornz water runoff; 12. that the project is subject to the state-mandated water conservation program, and a complete Irrigation Water Management Plan must be submitted with landscape and irrigation plans at time of permit application; 13. that demolition of the existing structures and any grading or earth moving on the site shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 14. that prior to sclleduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of t11at height; 15. that the tree protection measures detailed in the February 13, 2003, Certified Arborist Report shall be established prior to construction and maintained throughout construction by the certified arborist and be inspected by the City Arborist before a demolition permit is issued by the Building Department for the existing single-family residence and/or accessory structures; 16. the propei-ty owner shall be responsible for submitting a certified arborist's report for approval by the City Arborist before a final Building permit is issued to address a recommended maintenance program for the three protected-size trees on site (the two Coast live Oaks next to the creek bank and the Magnolia in the front yard of 1544 Bernal Avenue) for at least three years following construction; failure to do this resulting in the loss of the protected trees shall require that the property owner replace the lost trees with trees of a size and species selected by the City Arborist; and 16. that before a demolition pernlit is issued Building Department for the existing single-family residence and/or accessory structures, the applicant shall apply for and be issued a Tree Removal pennit fi-oin the Parks and Recreation Department for the two Eucalyptus trees on site that will be removed. The survey shall show all property lines, property corners, easements, topographical features and utilities. (Required prior to the building permit issuance.) 2 � The site and roof drainage shall be shown on plans and should be made to drain towards the Frontage Street. (Required prior to the building permit issuance.) 3. The purpose of thi5 inspection was to determine general tree health and structure. The lot wili be divided into two lots and the tree irtformation can be used to place the proposed new home footprints to favor the more desirable trees. Each tree was assigned a number which connects this report to site plan numbering. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15303, Class 3—(a) construction of a limited number of new, small facilities or structures including (a) one single family residence or a second dwelling unit in a residential zone. 2. that any changes to the size or envelope of the basement, first or second floors, or garage, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to Planning Commission review; 3. that prior to scheduling the framing inspection, the project architect, engineer or other licensed professional stiall provide architectural certification that the architectural details such as window locations and bays are built as shown on the approved plans; if there is no licensed professional involved in the project, the property owner or contractor shall provide the certification under penalty of perjury; 4. that prior to final inspection, Planning Department staff will inspect and note compliance of the architectural details (trim materials, window type, etc.) to verify that the project has been built according to the approved Planning and Building plans; 5. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and installed on the portions of the roof not visible from the street; and that these venting details shall be included and approved in the construction plans before a Building permit is issuec�: 6. that the conditions of the City Engineer's and the Fire Marshal's November 25, 2003, memos, and the Recycling Specialist's November 26, 2003memo shall be met; 7. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame; 8. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management and Discharge Control Ordinance; 9. that prior to scheduling the foundation inspection a licensed surveyor shall locate the property corners and set the building envelope; 10. that prior to underfloor frame inspection the surveyor shall certify the first floor elevation of the new structure(s) and the various surveys shall be accepted by the City Engineer; 11. that during demolition of the existing residence, site preparation and construction of the new residence, the applicant shall use all applicable "best management practices" as identified in Burlingame's Storni Water Ordinance, to prevent erosion and off-site sedimentation of storm water runoff; 12. that the project is subject to the state-mandated water conservation program, and a complete Irrigation Water Management Plan must be submitted with landscape and irrigation plans at time of permit application; 13. that demolition of the existing structures and any grading or earth moving on the site shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 14. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge and provide certification of that height; 15. that the tree protection measures detailed in the February 13, 2003, Certified Arborist Report shall be established prior to construction and maintained throughout construction by the certified arborist and be inspected by the City Arborist before a demolition permit is issued by the Building Department for the existing single-family residence and/or accessory structures; 16. the property owner shall be responsible for submitting a certified arborist's report for approval by the City Arborist before a final Building permit is issued to address a recommended maintenance program for the three protected-size trees on site (the two Coast live Oaks next to the creek bank and the Magnolia in the front yard of 1544 Bernal Avenue) for at least three years following construction; failure to do this resulting in the loss of the protected trees shall require that the property owner replace the lost trees with trees of a size and species selected by the City Arborist; and 16. that before a demolition permit is issued Building Department for the existing single-family residence and/or accessory structures, the applicant shall apply for and be issued a Tree Removal permit from the Parks and Recreation Department for the two Eucalyptus trees on site that will be removed. 3 - � •It � -� .�.:... . . �.
