This application was to allow the plate height to exceed nine (9) feet above grade for an accessory structure at 1428 Cabrillo Avenue, zoned R-1. The April 12, 2021, minutes of the Planning Commission state your application was approved with the following conditions: �a 3 4 5 C� that the project shall be built as shown on the plans submitted to the Planning Division date stamped March 30, 2021; interior or exterior, shall require a demolition permit; and that if the accessory structure is demolished or the envelope changed at a later date the Conditional Use Permits shall be void or shall be amended to reflect the changes; that any recycling containers, debris boxes or dumpsters for the construction project shall be placed upon the private property, if feasible, as determined by the Community Development Director; that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, that the project shall meet all the requirements of the California Building and Uniform Fire Codes, in effect at time of building permit submittal, as amended by the City of Burlingame. �� Register online to receive City of Burlingame e-mail updates at www.burlingame.org �m DocuSign Envelope ID: 19DDDACE-5818-43F9-83C7-3C84DA183648 April 23, 2021 1428 Cabrillo Avenue Page 2 All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. An extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law. The legal status of your new detached accessory living unit at 1428 Cabrillo Avenue, zoned R-1, is subject to the following conditions of approval: that the project shall be built as shown on the plans submitted to the Planning Division and date stamped March 30, 2021 and that the accessory dwelling unit shall be restricted to no more than 850 SF (for studio/one-bedroom units) or 1,000 SF (fortwo- bedrooms or more units); 2. that prior to issuance of a building permit for the new accessory dwelling unit, a deed restriction shall be filed with the County Recorder. The accessory dwelling unit requirements are not being met; or b. The accessory dwelling unit is no longer used for residential purposes; or c. The parking required is no longer provided; or d. The primary single family dwelling on the site is purposely demolished. This approval is valid for one year during which time a building permit must be issued.
