MEMO TO: PLANNING COMMISSION

SUBJECT: SPECIAL PERMIT FOR AN ADDITION TO AN EXISTING DETACHED GARAGE
AT 1408 CABRILLO AVENUE, ZONED R-1
Mr. Jack Gollier, property owner and Darren's Designs, applicant and
designer, are requesting a special permit for an addition to an
existing garage at 1408 Cabrillo Avenue, zoned R-1. The existing
detached garage is to be expanded in width by 3' on the east wall. The
expansion creates 109.2 SF of new garage space added onto the existing
436.8 SF detached garage which brings the total square footage to 546
SF. Any accessory structure which is 500 SF or greater is required to
have a special permit (C.S. 25.60.010-b). The existing three bedroom,
two bath, one story residence is also being remodeled and conforms to
current zoning code requirements.
Staff Comments
City staff have reviewed this request. The Fire Marshal notes (May 2,
1991 memo) that all walls within 3' of the property line will have to
be of one hour construction. The City Engineer notes (May 28, 1991
memo) that a site survey will be required, since the garage is within
12" of the property line, to verify the exact location. The Chief
Building Inspector comments (June 3, 1991 memo) that all walls within
3' of the property line will have to be of one hour fire construction
with no openings. He also notes that all electrical boxes located in
the property line walls will have to be one hour rated.
Applicant's Letter
In his special permit application date stamped April 30, 1991 the
applicant indicates he would like to extend the existing garage from
12' to 15' so that he can store his boat inside. He further indicates
that the aesthetics of the new structure will match�the existing house
and will be in proportion with the house.
Findings for a Special Permit
In order to grant a special permit the Planning Commission must find
that the following conditions exist on the site (C.S. 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of this
title;

(c) the planning commission may impose such reasonable conditions or
restrictions as it deems necessary to secure the purposes of this
title and to assure operation of the use in a manner compatible
with the aesthetics, mass, bulk and character of existing and
potential uses on adjoining properties in the general vicinity.
Study Questions
At the June 10, 1991 Planning Commission study meeting (Planning
Commission June 10, 1991 minutes) the Commission asked three questions:
1. Is the garage in the rear one-third of the lot?
The garage is 36'-4" long within the rear one-third of the lot
(120'-0" x.33 = 40'0" or rear one-third of lot).
2. Dimension from outside face of the garage wall to the property
line?
The applicant will answer this question at the public hearing.
3. Where is the eave ventilation?
The applicant will answer this at the public hearing.
Planning Commission Action
The Planning Commission should hold a public hearing. Affirmative
action should be by resolution and should include findings. The
reasons for ariy action should be clearly stated for the record. At the
public hearing the following conditions should be considered:
l. that the garage shall be built as shown on the plans submitted to
the Planning Department and date stamped May 31, 1991 Sheets 1 and
2;
2. that the garage shall provide a 10' x 20' space for the required
covered parking space;
3. that the Fire Marshal's May 2, 1991 memo, the City Engineer's May
28, 1991 memo and the Chief Building Inspector's June 3, 1991 memo
shall be met; and
4. that the garage shall be built to meet all the requirements of the
Uniform Building and Uniform Fire Codes as amended by the City of
Burlingame.

The CITY OF BURLINGAME PLANNING COMMISSION announces the
following public hearing on Monday, the 24th day of June, 1991, at
7:30 P.M. in the City Hall Council Chambers located at 501 Primrose
Road, Burlingame, California. A copy of the application and plans
may be reviewed prior to the meeting at the Planning Division at

RESOLUTION APPROVING SPECIAL PERMIT
RESOLVED by the Planning Commission of the City of Burlingame
that:
WHEREAS, application has been made for a special permit
for an addition to an existing detached garaqe

WHEREAS, this Commission held a public hearing on said
application on June 24 , 1991 , at which time it reviewed
and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this
Planning Commission that said special permit is approved, subject to
the conditions set forth in Exhibit "A" attached hereto.
It is further directed that a certified copy of this
resolution be recorded in the official records of the County of San
Mateo.
