REPORT ON POSSIBLE PURCHASE OF A PORTION OF THE FRANKLIN SCHOOL
PROPERTY, 1825 TROUSDALE AVENUE, FOR A PUMP STATION
RECOMMENDATION:
Consider on possible purchase of a portion of the Franklin School site at 1825 Trousdale Avenue.
DISCUSSION:
9s part of the City's reconstruction and master plan for water service, a new pump station is needed in the �
��ousdale Avenue area to deliver enough water to provide peak flow for consumers and fire protection flow at
the same time. Presently, the City does not have the capacity to provide both at the same time. The proposed
pump station would be located in the southwest corner of the school property and would replace the existing
station located site. Logistically, the City will have to keep the existing Trousdale pump
station in service until this new pump station is completed; therefore an additional 1,500 square feet is required
to build the new pump station.'
This new pump station will also provide sufficient pressures so that the City will be able to take the
pump station out of service.
The appraisal has been prepared and is ready for presentation in closed session.
In closed session, the Council can discuss the appraisal and instruct the City Manager and the Director of Public
Works on how to proceed further, if the Council wishes.

Request: The City of Burlingame Public Works Department is requesting that the Planning Commission
make a determination that the proposed purchase of a 1500 SF portion of the Franklin Elementary School
property at 2385 Trousdale Drive for expansion of the Trousdale Pump Station is consistent with the
Burlingame General Plan per Section 65402 of the California Government Code.

General Plan: Institutions — Elementary School; Low Density Residential
Adjacent Development: Elementary School, Single Family Residences

Zoning: R-1
CEQA Status: The expansion of the water pump station is a part of a larger project proposed by the
Public Works Department to improve water service to the northwest portions of the community. A
mitigated negative declaration (ND-540-PW) has been prepared for this larger proj ect, which is referred to
as the Trousdale Pump Station and Transmission Main proj ect. Refer to the attached Mitigated Negative
Declaration (ND-540-PW).
Previous Use: Portion of Open Space for Franklin Elementary School
Proposed Use: Expansion of existing Trousdale Pump Station located directly west of the site.
Allowable Use: Public utility structures or installations when found to be necessary for the public health,
safety, convenience and welfare are a conditional use in the R-1 zoning district. However, California
Government Code Section 53091 states that zoning requirements do not apply to the location or
construction of facilities for the production, generation, storage, treatment and transmission of water.
Summary: The City of Burlingame Public Works Department, as a part of a larger project to improve
water service to northwest Burlingame, is proposing to acquire a 1500 SF portion of the Franklin
Elementary School property at 1825 Trousdale Drive adj acent to the existing Trousdale Pump Station. As
a part of the reconstruction and master plan for water service, a new pump station is needed in this area to
deliver enough water to provide peak flow for consumers and fire protection flow at the same time. The
new pump station would be located on the 1500 SF property to be acquired from the school district. The
City will have to keep the existing pump station in operation until the new pump station is completed.
Therefore, the additional property is needed to build the new pump station. Once the new pump station is
in operation, the existing pump station will be removed and a new access driveway and transformer will be
installed. The site will be landscaped and the new pump station will include noise abating features.
California Government Code Section 65402 requires that a public agency shall not acquire real property for
any public purpose until the location, purpose and extent of the use has been reviewed and reported for
conformity with the adopted general plan by the local planning agency. In this case, the Burlingame
General Plan designates the Franklin Elementary School site for Institutional Use, Elementary School.
The adj acent pump station and surrounding residential area are designated for low density residential use.

Determination of General Plan Consistency 2385Trousdale Drive
The R-1 zoning, which implements the General Plan for the property to be acquired as well as the existing
pump station, allows public utility installations with a conditional use permit.
The Burlingame General Plan Land Use Element specifies that the regulations for institutional uses should
permit the continuation of existing uses, with changes in institutional use requiring City authorization. The
purpose of this policy is to ensure that potential sites for future public uses are not removed from public
use. The proposed proj ect would convert a minor portion of the school grounds to pump station use. Both
of these uses are institutional in nature and are meant to provide necessary services to the surrounding
residential community. No potential sites for parks or buildings would be lost to potential public use, and
the property would remain in public ownership. The distribution of water to the surrounding residential
area is an essential public service and, therefore, the use of this site for a pump station is consistent with
both the institutional and adj acent low density residential land use designation. The pump station will be
designed so that it is consistent with the City's noise ordinance and other impact regulations.
Findings: Planning Commission must find that the proposed site and use are consistent with the General
Plan which allows public utility installations and with the zoning which implements the policies of the plan
(Government Code Section 65402).
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should include findings regarding the compatibility of the proposed use of the site with the General
Plan. The reasons for any action shall be clearly stated for the record. There are no conditions proposed
since this is a determination of general plan consistency.

It is recommended that Council concur with the Commission and approve the
attached Tentative and Final parcel Map for lot line adjustment purpose.

1. The Burlingame Intermediate School shall continue to maintain the trees
and landscaping in the traffic island.
BACKGROUND:
This map action has been postponed upon Kavanagh Engineering's request
because Mr. Kavanagh thought that a resolution would be needed for the
street dedication. He has since.informed the City that no resolution is
needed because the intended easement was never granted to the City (see
attached letter). The Planning Commission reviewed the attached Staff
reports and map at their May 9, 1994 meeting and recommended that Council
approve this application. The purpose of this request is to construct new
buildings that would have crossed the existing property line. The City does
not review school developments and no building permit will be issued. This
lot line adjustment should be considered as both a Tentative and Final
Parcel Map and staff will see that the Final Map is recorded.
This is a lot line adjustment where no City controlled building or zoning,
utility, investments or easement issues are involved. The State Map Act does
not allow any conditions of approvals to be placed on the lot line
adjustment.

Today we received a call from Ed Webster. He had reviewed their
files, particularly the Title Report for BIS and Franklin Schools
(our RSK-7) as submitted to the city 4-27-94. His comments are
summarized as follows:
1. NO RESOLUTION IS NEEDED BY THE CITY OF BURLINGAME. Mr.
Webster said the city has no interest in the intended easement.
It was never granted to the city.
2. EXISTING 30' INGRESS & EGRESS EASEMENT BURLINGAME
INTERMEDIATE SCHOOL DISTRICT. This easement shown on the
subdivision map "Mills Estate No. 3" was created for the benefit
of the School District when the BIS site was purchased. It
merged with fee title; in other words became void, when the
School District bought the adjacent Block 12 for Franklin School.
3. EXISTING 25' P.G. & E. EASEMENT. This easement shown on
"Mills Estate No. 3", and as mentioned in note M-6 on our
Tentative Parcel Map", was quitclaimed (the portion not in
Quesada Way) by P.G, & E. per deed recorded 5-24-57 3224 O.R.
235. This will be clarified on the final map.
We understand the tentative and final map will be on the consent
calendar for the City Council, Monday, 6-6-94.

This request is to relocate the property line between Burlingame
Intermediate School, Parcel A, and Franklin Elementary School,
Parcel B. Burlingame School District owns both parcels now and the
purpose of this lot line �djustment is to construct'�new buildin s
that would have crossed the existing property line This request
also will dedicate a portion of Quesada Way not now dedicated to
the City. This portion of land includes a landscape island and
portion of street. The City does not maintain the trees and
landscaping in the traffic island but does maintain the street. The
staff recommends that the school still maintain the landscaped area
after the street dedication. -
The Planning, Building and Fire Department have reviewed this
proposal and have no comments on this application. This Parcel Map
application is classified under Categorical Exemptions, Section
15305. .Section 5 consists of "Minor alterations in land use
limitations in areas with an.average slope•Qf less tiian 20�....

f. TENTATIVE AND FINAL PARCEL MAP FOR LOT LINE ADJUSTMENT BETWEEN
FRANKLIN SCHOOL AND BURLINGAME INTERMEDIATE SCHOOL AT TROUS-
� DALE DRIVE AND QUESADA WAY
Public Works memo of June 1 recommended council concur with the Planning Commission
and approve the map for lot line adjustment with the condition that the school district
continue to maintain trees and landscaping in the traffic island.
g. OUT OF STATE TRAVEL FOR POLICE OFFICER
Police Chief's memo of May 27 recommended approval to send Officer Nakiso to an out of
state training session August 1 through 12 in Georgia. Officer Nakiso is the School Liaison
Officer and this training is to teach the G. R. E. A. T. (Gang Resistance Education and
Training) program which is an eight week session for seventh graders and four week session
for third and fourth graders that Officer Nakiso will teach in Burlingame schools. There is
no cost other than transportation and his salary while there. The school district approves of
the concept.

City Attorney's memos of May 17 and May 16 recommend denial of claims for (1) trip and
fall and (2) attorney costs incurred during enforcement of dish antenna regulations.
Councilman Harrison moved approval of the Consent Calendar. The motion was seconded by
Councilwoman Knight and carried unanimously.
COUNCIL COMMITTEE REPORTS
Councilwoman Knight reported meetings of the legislative committee, ITSMA, Chamber transporta-
tion committee regarding a shuttle bus, train centennial, communiry picnic, Council of Cities bylaws
where a council member of another city suggested Council of Cities have a subcommittee for
BART, and she attended an Eagle Scout celebration. Councilman Harrison reported on CCAG.
Councilman Spinelli reported on the Airport Roundtable and noisy planes. Mayor O'Mahony
attended a restaurant association's conference at a local hotel; she liked the idea of a BART
subcommittee for the Council of Cities. Councilman Pagliaro said he called the airport noise line
and received a report back that the noise event he called about happened on Runway One at a
certain time; he said he would also like to hear which airline and rype of plane had created the
noise; he asked Councilman Spinelli to bring that idea before the Roundtable.
OLD BUSINESS
Councilman Pagliaro mentioned the Park and Recreation Commission discussed rollerblade hockey,
getting insurance was a question.
NEW BUSINESS
Councilman Spinelli called up for council review the 1157 California special permit amendment and
parking variance for the American Gnostic Church approved by the Planning Commission.

Council had questions on "a" regarding hotel tax security bond and why hotel gets in erest from
ta�ces collected; "b" informing public about storm water management; "c" fees for use,of playing
fields; and "e" new company for rodent control.
a. REINTRODUCT�ON OF ORDINANCE 1498 REQUIRING TRANSIENT OCC.UPANCY
TAX SECURITY BOND
City Attorney's memo of May 13 recommended council reintroduce this ordinance. In
February council introduced Ordinance 1498; the hotels expressed concerns and the City
Attorney agreed to meet and negotiate. This ordinance will give the Finance Director the
discretion to require deposits of taxes as frequently as weekly or daily and into a city bank�
account, and a tax bond would be required for all but our smallest hotels. The ordinance
would take effect immediately upon adoption as allowed by Government Code for ordinances
regarding taxes.
b. INTRODUCTION OF ORDINANCE 1503 ADOPTING A STORM WATER MANAGE-
MENT AND DISCHARGE CONTROL PROGRAM
Public Works memo of May 26 recommended council introduce this ordinance adding
Chapter 15.14 to the city code. The EPA imposed regulations that mandate local govern-
ments to control and reduce the amount of storm water pollution into streams and the bay.
Under CCAG the San Mateo Countywide Storm Water Management Plan was developed and
submitted to the Regional Board which adopted the plan and issued the NPDES permit. The
plan describes tasks that will be undertaken during the first five years of the permit. This
ordinance gives the city the authority to require controls to reduce discharge of pollutants.
c. RESOLUTION 33-94 AUTHORIZING AGREEMENT FOR USE AND MAINTENANCE
OF FRANKLIN SCHOOL ATHLETIC FIELD
City Manager's memo of May 13 recommended council approve the agreement with the
school district for the city to improve the elementary school field for soccer and softball use;
the city will spend $200,000 for improvements to the field and share maintenance with the
ciry paying 60 percent of that cost. The district agrees to allow the city use of the field for
20 years. The city is reviewing possible field use fees to cover a portion of the costs. �
d. RESOLUTION 34-94 AUTHORIZING CONTINUANCE OF THE SENIOR NUTRITION
PROGRAM
Recreation Director's memo of May 25 recommended council approve a resolution authoriz-
ing the City Manager to apply to continue the senior luncheon program. The net cost to the
city is estimated to be $7,928. ,
e. RESOLUTION 35-94 AUTHORIZING AGREEMENT FOR RODENT CONTROL IN
CREEKS AND DRAINAGE AREAS - CP 917
Public Works memo of June 1 recommended council approve a contrac� with Dewey Pest
Control in the amount of $16,648. The County has negotiated this contract on behalf of the
county and other cities.
