Previous Use: Private, non-profit school for elementary -aged children with and without special education needs. Proposed Use: Same. Allowable Use: Private school requires a conditional use permit. History: The Hope Technology Group is a private non-profit school which provides computer -based learning for elementary school aged children with and without special education needs. On January 8, 2001, the Planning Commission approved a conditional use permit for the operation of a non-profit school on an existing school site (see conditions of approval, dated January 18, 2001). The non-profit school is located on the lower floor of an existing building on the Franklin Elementary School site. On May 13, 2002 the Planning Commission approved an amendment to the conditional use permit to alter the approved the class schedule and to increase the number of persons on site at any one time. Summary: The applicant, Hope Technology Group, is requesting a conditional use permit amendment to add 960 SF of portable classroom space to the previously approved private school use. The space will be provided in a portable building (labeled A on the November 27, 2002 plans) located East of the Hope Technology permanent building. Franklin Elementary School formerly used both existing portable buildings as classrooms. Hope Technology Group proposes to assume the classroom use in building A and Franklin School will continue the existing classroom use in building B. With the proposed amendment, the total floor area for the Hope Technology Group School would increase from 4,252 SF to 5,212 SF. The total approved number of persons on site at any one time, the total number of approved classes, the bell schedule, and the pick-up/drop-off times would not be altered with the proposed amendment. This project meets all other zoning code requirements. Conditional Use Permit Amendment 2303 Trousdale Drive Staff Comments: See attached. Planning staff would note that attached to this staff report for your information is a handout provided by the school district, titled Guidelines for Leasing Franklin School, developed by the school community in 1984. This handout lists conditions for leasing the school property that were developed in 1984, pursuant to the vacancies created in many public schools. The City of Burlingame has received communication from the Superintendent and Principal for Franklin School, both of whom acknowledge that they support the changes proposed by Hope Technology (see letters dated April 16, 2002 and April 19, 2002). The Planning Department has received no complaints regarding the operation of Hope School since it was initially approved in January 2001. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered (the amendments to the original conditions are shown in italics): Conditions: 1. that the Hope Technology School shall be limited to the 5,212 SF shown on the plans submitted to the Planning Department and date stamped November 27, 2002, sheets A-2, A-3, A-6 and A-7; including 4,252 SF of permanent building space and 960 SF of portable classroom space; 2. that the operation of the school classes shall follow the schedule indicated by the charts in the staff report for the meeting date of May 13, 2002, and that any changes to this schedule, including revising, shall require an amendment to the conditional use permit; 3. that the total number of persons on site at any time, including school staff, students, and volunteers, will be limited to 62 persons; 4. that this conditional use permit shall be reviewed upon complaint and that the conditional use permit shall expire in July 2003; 5. that the conditions of the Fire Marshal's memo of December 2, 2002, shall be met; and 6. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19.
