Dear Mr. Mount,
Since there was no appeal to or suspension by the City Council, the Apri19, 2001 Planning Commission approval
of your application for a sign exception became effective April 16, 2001. The sign exception was for a 15 SF
sign, which would exceed the maximutn number of signs and maximum sign area at 2303 Trousdale Drive,
zoned R-1.
The Apri19, 2001, minutes of the Planning Commission state your application was approved with the following
conditions:
that the signs shall be installed as shown on the plans submitted to the Planning Department and date
stamped March 29, 2001, (8%z" x 11", sheets 1& 2, including a color rendering and sheet SF-1, site

2. that any increase in the number or area of the signs on the primary frontage, which exceed the sign code
requirements in effect at the time of application, shall require an amendment to this sign exception;
3. that the sign shall be permanently attached to the brick wall of the building at 2303 Trousdale Drive by
a means approved by the Building Deparhnent; and
4. that the proj ect shall meet all the requirements of the municipal code and of the 1998 edition California
Building and Fire Codes as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.

had a friend who is a contractor do the work. Commission inquired about a vapor barrier in the slab and
stated that it may be a problem to legalize the work, need to check with the Building Official. CP Monroe
further clarified that even if approved by the Commission it may not be possible to use the space if you
cannot meet the Building Code, would need to remove all. Commission asked CA Anderson if they can
limit the use of the accessory structure and the hours of use. As a neighbor, have no problem with the
structure being used as an office and storage. C. Luzuriaga closed the public hearing.
Commission discussion: no objection by the neighbors to this project, the way the property is situated, being
a corner lot is like this accessory structure is a separate house, usually the concern with these types of
situations is that the accessory structure is located at the rear of the lot right next to a number of property
lines; the problem is that if the property changes hands the neighbors need to be protected; adding the
following conditions would ensure protection of the neighbors, 1) conditional use permit is to be reviewed
upon complaint, and 2) hours of use be limited to between 6:00 a.m. and 12 midnight. Commission felt that
limiting hours of use would be too restrictive and nit-picky for such a small space; if complaint comes in
on the use of the structure then Commission can discuss limiting the hours of use. Commission agreed that
limiting use to office only was restrictive enough. Commissioner suggested limited office to personal office
only, not recreation room. It was noted that even with the loss of a parking space, the parking requirement
is met and exceeded. Even though the use may be harmless under these circumstances, there is concern that
people will think they can do illegal work and change uses without approval then come ask for approval after
the fact. Add condition that the existing square footage per use remain fixed and that the only utility be
electricity.
Chauman Luzuriaga moved to approve the application, by resolution, with the following conditions: 1) that
the accessory structure shall be built as shown on the plans submitted to the Planning Department and date
stamped March 28, 2001; with only electricity service to the building no water, sewer.or gas connections;
2) that the accessory structure shall never be used for accessory living, recreation or sleeping purposes and
shall never include a kitchen, uses shall be limited to one covered parking space approximately 247 SF,
measuring 11'-4" by 21'-9", a personal office not to exceed 159 SF in area, and storage space not to exceed
137 SF in area; 3) that any permits or work required to make the storage, office, and parking spaces meet
all current Building and Fire codes for an R-3 rated structure (CBC) shall be issued within 30 days of the
effective date of this action and all work shall be inspected and finaled, including occupancy permit, by the
CBO within 45 days of issuing a permit. The owner shall receive a final inspection and Certificate of
Occupancy from the City of Burlingame Building Department before the storage or office spaces in the
accessory structure are occupied by family members or guests; 4) that the conditions of the Chief Building
Official's September 11, 2000, and the Fire Marshal's September 11, 2000, memos shall be met; and 5) that
the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as
amended by the City of Burlingame. C. Keighran seconded the motion.
Chairman Luzuriaga called for a voice vote on the motion to approve. The motion passed on a 5-0-0-2
(Cmsrs. Bojues and Osterling absent). Appeal procedures were advised. This item concluded at 8:04
p.m.

Chairman Luzuriaga opened the public hearing. Doran Klein, the applicant and designer, explained that he
met with the Design Review Consultant and feels that they have resolved a lot of the issues that the
Commission had regarding this project. There were no further comments from the floor and Chairman
Luzuriaga closed the public hearing.
C. Vistica moved to approve the application, by resolution, with the following conditions: 1) that the project
shall be built as shown on the plans submitted to the Planning Department date stamped March 28, 2001,
sheets A1 through A6, with a first floor ceiling height of 9'-0" and a second floor ceiling height of less than
12'-0"; and that any changes to the footprint or floor area of the building shall require and amendment to this
permit; 2) that any changes to the size or envelope of the basement, first or second floors, which would
include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing
the roof height or pitch, shall be subject to design review; 3) that the conditions of the City Engineer's
January 16, 2001, memo shall be met; 4) that the project shall comply with the proposed demolition and
construction recycling ordinance recently approved by the City Council; 5) that the project shall meet all
the requirements of the California Building Code and Califomia Fire Code, 1998 edition, as amended by
the City of Burlingame. C. Keighran seconded the motion.
Discussion on the motion: front setback variance is justified based upon the irregular shape of the lot, only
a minor encroachment into the front setback area; Design Review helped this project and it seemed to be
a good learning process.
Chairman Luzuriaga called for a voice vote on the motion to approve. The motion passed on a 5-0-0-2
(Cmsrs. Bojues and Osterling absent). Appeal procedures were advised. This item concluded at 7:45

6. 1201 MILLS AVENUE — ZONED R-1— APPLICATION FOR CONDITIONAL USE PERMITS FOR
OFFICE USE IN AN EXISTING ACCESSORY STRUCTURE AND A WINDOW WITHIN 10' OF A
PROPERTY LINE, AND A SPECIAL PERMIT TO REDUCE THE NUMBER OF ON-SITE
PARKING SPACES (GRACE HEXTRUM, APPLICANT AND PROPERTY OWNER)
Reference staff report, 04.09.01, with attachments. Planner Keylon presented the report, reviewed criteria
and Planning Department comments. Five conditions were suggested for consideration. Commission had
no questions of staff.
Chairman Luzuriaga opened the public hearing. Grace Hextrum, 1201 Mills, property owner, Brenda
Atkinson, 452 Laguna, presented the project and explained that the Fire Marshal inspected the accessory
structure last August. She stated that there is no bathroom, no kitchen or plumbing in the accessory
structure, and that she just wants to keep it as an office. There are no outside changes, the exterior was
actually cleaned up a bit. The applicant presented photos of the structure to the Commission, showing that
4 small cars could be parked uncovered in front of the accessory sfizcture; most homes in her neighborhood
have only one car garage. She presented 14 signatures from her neighbors in the support of the project,
including her adjacent neighbor on Laguna, as well as the neighbor on the other side. The applicant
explained that her home dates back to the 1930's, and has very small bedrooms. She has a baby also, and
there is no room for storage or an office. She explained that there would be no noise generated by the
proposed use, she really would like to keep the office. The Commission inquired about how this conversion
happened without permits? The applicant explained that her step son used to hang out there with his friends
and when she was working out of town, the construction was done by her now ex-husband and his son who

History: On January 8, 2001, the Planning Commission approved a conditional use permit to allow a
private, non-profit school for elementary-aged children with and without special educational needs at
2303 Trousdale Drive. The non-profit school is located in an existing building, formerly used as
school district administrative offices. The school will share the Franklin Elementary School site.
There was no signage approved with the conditional use permit approved on January 8, 2001.
Summary: The applicant is requesting a sign exception to the number of signs and maximum sign
area allowed in an R-1 zone. A sign permit is required because this is a private school. In the R-1
zone, there is a maximum of one sign allowed per frontage and a maximum sign area of 15 SF per
parcel. There is an existing pole sign for Franklin Elementary School on site. This sign totals 32 SF.
Public schools are exempt from the city's sign code.
The applicant is proposing two non-illuminated signs in addition to the existing pole sign on site. The
first proposed sign measures 3' x 1' and has the following copy: "Hope Technology School Employee
Parlcing". This sign will be located on the fence surrounding the parlcing lot at the northwest corner of
the property.
The second proposed sign is a wall sign that measures 3' x 5' and has the following copy "Hope
Technology School HTS". This sign will be located on the building at the northwest corner of the lot.
The height to the top of the sign ineasures 11'-3" from the sidewalk.

Staff Comments: See attached. Staff would note that the proposed revisions to the sign code, which
will be reviewed by the Planning Commission in April 2001, would establish a set of institutional sign
standards in the R-1 zone. The current sign exception proposal would not be necessary under the
proposed revised sign code, since the new regulations would allow 50 SF of signage in a total of 3
signs, no more than 16'-0" off the ground for a wall sign.
Required Findings for Sign Exception: In order to grant a Sign Exception relating to height, area,
location or number of signs the Plamling Coinmission must apply the following circumstances (Code
Section 25.06.110 a-b):
(a) any exception granted shall be subject to such conditions as will assure that the adjustment
thereby authorized shall not constitute a grant of special privilege inconsistent with the
limitations upon other properties in the vicinity and the district in which the subject property is
situate; and
(b) because of special circumstances applicable to the subject property, including size, shape,
topography, street frontage, location or surrounding land use; the size or height of the building
on which the sign is to be located; the classification of the street or highway on which the sign
is located or designed primarily to be viewed from, the strict application of zoning regulations
is found to deprive subject property of the privileges enjoyed by other properties in the vicinity
and under identical zone classification.
Planning Commission Action: The Planning Commission should hold a public hearing. The reasons
for any action should be clearly stated. At the public hearing the following conditions should be

Dear Ms Lewit:
I am writing on behalf of Erudite Technology Group, Inc. (d.b.a. Hope Technology
Group) for the purpose of applying for a Sign Exception for the property located at 2302
Trousdale Drive, Burlingame, California; APN: 025-130-070. This request is made
pursuant to Chapter 22.06 of the City of Burlingame Municipal Code. The subject
property is part of Franklin Elementary School, which is owned by the Burlingame
Elementary School District.
On January 8, 2001 the City Planning Commission approved our application for a
conditional use permit to operate a private nonprofit school in the lower portion of an
existing building on the Franklin Elementary School campus. That decision became
effective January 17, 2001. Since that time we have been completing the necessary
renovations, with the goal of commencing school operation in early April. Part of the
renovations was to include installation of our school sign.
We have recently learned that it will be necessary for us to obtain a Sign Exception in
order to install a permanent sign at our school site. Hence the purpose of this application.
We have also submitted, pursuant to Chapter 22.54, a Sign Permit Application requesting
that the City Planner grant us permission to install a temporary wall sign at the location,
and that we be allowed to use that sign pending the outcome of the hearing on this
application. In addition, we will be installing a directional sign on the fence at the entry to

the employee parking lot. As we understand it, this sign is exempt under Chapter 22.54.
A color copy of that sign is being submitted with this application.
Proposed Sign Exception
We have reviewed the relevant provisions of Chapter 22.10 covering R-1 Residential
Districts, which are applicable to our school site location. As we understand it, Franklin
Elementary School, which already has a sign, is limited under these regulations to one
sign with a total square footage per parcel of fifteen feet.
We are seeking a sign exception to install our own sign of up to fifteen square feet on our
leased premises. We are proposing to attach the sign to the building as a wall sign. In
order to do so we will need exceptions for the number of signs and the square footage per
parcel (Chapters 22.10.020 and 22.10.030).
By submitting this application we agree to comply with the remainder of the R-1
regulations. The Superintendent of the Burlingame Elementary School District has
approved the location, size and colors of the sign. The Principal, Ms. Lisa Booth, has also
indicated that she has no objection to any sign approved by the District.
We believe that a Sign Exception is necessary for the following reasons: 1) we have a
premises agreement with the Burlingame Elementary School District in effect through
June 30, 2002 for the purpose of operating a private nonprofit school on the Franklin
Elementary School campus; 2) the Burlingame City Planning Commission approved our
use of the premises for that purpose effective January 17, 2001; 3) a separate sign
identifying our school site will assist our parents, staff and volunteers in locating the
program and will make traffic flow to and from Franklin Elementary School and our
program much smoother; 4) the sign we install will be compatible with the R-1
regulations, in terms of size, location, composition, etc. and will not change the character
of the neighborhood; and 5) if a separate sign is not approved, the school will lose it
distinctness as a separate entity, which would impact us financially and substantially
diminish the value of the premises and our agreement with the District.
This application also includes a site plan, a building elevation drawing showing the
location of our proposed sign to scale and a photograph of the existing sign. A color copy
of our proposed sign is being submitted with this application. We have also enclosed our
check in the amount of $235.00 for processing the Sign Exception and our application for
a temporary sign.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for si�n

NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section: 15311 - Accessory Structures, Class 11, construction or placement of minor
structures accessory (appurtenant to) existing commercial, industrial, or institutional facilities, including
but not limited to (a) on-premise signs is hereby approved.
2. Said sign exception is approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such sign exception are as set forth in the minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
