Categorically Exempt per Section: 15301 - Existing Facilities, Class 1(a), Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances. Previous Use: Private, non-profit school for elementary-aged children with and without special education needs. Proposed Use: Same. Allowable Use: Private school requires a conditional use permit. History: The Hope Technology Group is a private non-profit school to provide computer-based learning for elementary school aged children with and without special education needs. On January 8, 2001, the Planning Commission approved a conditional use permit for the operation of a non-profit school on an existing school site (see conditions of approval, dated January 18, 2001). The non-profit school is located on the lower floor of an existing building on the Franklin Elementary School site. Hope Technology Group is requesting to amend their use permit to alter their class schedule by adding a class and having all classes begin at the same time, and to add 21 more students and staff to the school's operations. Summary: The applicant, Hope Technology Group, is requesting a conditional use permit amendment to alter the approved the class schedule and to increase the number of persons on site at any one time. The January 8, 2001, approval allowed a maximum of 41 persons on site at any one time. Hope Technology notes that in practice, the exact numbers of staff and students did not conform to the approved numbers. The approval allowed 17 staff and 24 students, when in practice there were 15 staff and 26 students. The maximum number of persons on site was still 41. The total number of people, including students and staff, was distributed between three classes. The school would now like to increase the maximum number of students in their existing three classes, as well as add an additional class, and also to increase the number of staff inembers on site. The total number of persons on site at any one time would increase by 21 persons, from 41 to 62. The additional class for the school requires a change to the schedule approved with the January 8, 2001 permit. With the approved use permit, three classes were staggered to start at 15-minute intervals and to end with at least an hour between each class. With the proposed amendment, the four proposed classes would start and end at the same time. With the revised four classes, there would be 18 staff (instructors and administrators) on site with 44 students, who all could arrive and depart at the same time. Compared to the approved permit, this represents an increase of 21 persons on site at one time (from 41 to 62). Compared to the current practice of the school regarding the mix of staff and students, the number of staff will increase by 3 persons (from 15 to 18) and the number of students will increase by 18 persons (from 26 to 44), for a total of 62 persons arriving and departing at the same time. Students will proceed to the Hope Technology school building via an existing covered walkway. Students may also, by prior arrangement, be met at the drop-off area and escorted by a staff inember to the classes. There is no proposal to expand the classroom area or to alter the existing building with the proposed application. There are no proposed changes to the approved parking on site designated for Hope Technology, 5 standard and 1 disabled parking spaces. This project meets all other zoning code requirements. Staff Comments: See attached. Planning staff would note that attached to this staff report for your information is a handout provided by the school district, titled Guidelines for Leasing Franklin School, developed by the school community in 1984. This handout lists conditions for leasing the school property that were developed in 1984, pursuant to the vacancies created in many public schools. The City of Burlingame has received communication from the Superintendent and Principal for Franklin School, both of whom acknowledge that they support the changes proposed by Hope Technology (see letters dated April 16, 2002 and April 19, 2002). Study Meeting: At the April 22, 2002, Planning Commission study meeting, the Commission asked the applicant to address the following questions regarding the proposed amendment to the conditional use permit and the item was set for the consent calendar on May 13, 2002: • what time do the Franklin Elementary classes begin in the morning? • where will computer lab displaced by the new classroom be located ? • how does the additional traffic from Hope Technology affect the congestion experienced at Franklin School in the mornings now? • does the Franklin principal know about the proposed changes for Hope Technology? • have there been any complaints about the current student pick up/ drop off practices? In response to the Commission's concerns, the applicant has submitted a letter date stamped May 3, 2002 and a schedule of classes for Franklin Elementary school date stamped April 23, 2002. The schedule for Franklin School classes has remained the same for the past two years. Only the Hope Technology class schedule will be altered with the proposed changes, with all classes designated to start and end at the same time where the prior conditional use permit approved staggered start and end times. The letter states that the computers in the lab that will be replaced by a classroom will be distributed throughout the Hope Technology classrooms. The letter states that the proposed start and end times for Hope Technology classes are the same for all Hope classes; approximately 37 Hope students will arrive and depart at the same time where with the current approval approximately 8 Hope students arrive and departat the same time. However, Hope class start and end times are still staggered with the Franklin School times. The letter from Hope Technology states that under the current conditional use permit the school has had 2 parking complaints, both of which were the result of special one-time programs run on the weekends or after school. These complaints related to street parking along Trousdale drive. Planning staff would add that no complaints regarding the conditional use permit for Hope Technology have been received in the Planning Department since the permit was issued in January 2001. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): � � Conditional Use Permit Amendment 2303 Trousdale Drive (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Findings: Based on the fact that the children being dropped off for the proposed private school use will use traffic circulation areas established by the public school use, that the proposed amended schedule has staggered start and end times for classes to alternate with the public school schedule, that the proposed amended use is similar to other educational uses permitted on site, and that the number of staff and students will be limited by the conditions of approval, the proposed use is found compatible with the required findings for a conditional use permit. Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: Conditions: 1. that the Hope Technology School shall be limited to the 4,252 SF shown on the plans submitted to the Planning Department and date stamped April 1, 2002, sheets SD-1 to SD-3; 2. that the operation of the school classes shall follow the schedule indicated by the charts in the staff report for the meeting date of May 13, 2002, and that any changes to this schedule, including revising, shall require an amendment to the conditional use permit; 3. that the total number of persons on site at any time, including school staff, students, and volunteers, will be limited to 62 persons; 4. that this conditional use permit shall be reviewed upon complaint and that the conditional use permit shall expire in July 2003; 5. that the conditions of the Fire Marshal's memo of April 1, 2002, shall be met; and 6. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. When do Franklin School classes start? Franklin Elementary School is on a split schedule, which means different grades and classes report at different times. The current schedule is: 1. Kindergarten: Early Group: 8:15 to 11:35 (leaves at 11:50); Late Group: 9:55 to 2:00 (leaves at 1:50). 2. Grades 1-3: Early Group: 8:30 to 1:50; Late Group: 9:30 to 3:00 (Monday, Wednesday, Thursday and Friday); All grades 1-3: 8:30 to 2:00 (Tuesday). 3. Grades 4-5: All students: 8:30 to 3:00 (Monday, Wednesday, Thursday and Friday); All students: 8:30 to 2:00 (Tuesday). Franklin School has kept the same schedule for two years. Since they do not have to share transportation with other schools, we do not expect the schedule to change next year. If it does we will adapt to their schedule. What are the plans for the computer lab? The space currently occupied by the computer lab will be the new classroom. The existing computers and programs will be distributed to each of the classrooms. All the current technology will be used, as well as any new technology, with the students in those settings. When the school started its pilot program, we talked at length with Ms. Booth about the starting times and our desire to use the Franklin drop off and pick up area for our arrivals and departures. She was agreeable and we have used that schedule for the past year. We have worked together to make sure that we have a smooth situation for both schools. Is there traffic congestion now at Franklin School? If so, will the proposal affect it adversely? During the day, the most likely time for congestion is when students from the Franklin Elementary School are arriving and departing, and when children and/or their parents are walking across the street and the crossi.ng guard is stopping traffic on Trousdale Drive. Much of that congestion happens as parents negotiate the parking lot access from Trousdale and are held up at crosswalks by pedestrians. This is aggravated when the weather is cloudy or wet, as more people drive and they are not in their normal pattern. Currently our arrivals and departures are from 9:10 to 9:15 in the morning and 2:10 to 2:20 in the afternoon. We staggered our time with Franklin School to make sure that we did not increase congestion for the parents, or hold up their routine. We do not believe our additional students will have a significant impact on the traffic flow at Franklin. We currently have 26 students. Next year we will have a maximum of 44. Franklin has more than 400 students. If necessary, however, next fall we will schedule our arrival at 9:00, which would put it in the middle of the Franklin School arrivals. We propose to keep our dismissal time the same (2:10 to 2:20) to avoid the early afternoon dismissals at Franklin, but we could push it back 10 minutes to provide even more separation. Again, we will adapt our schedule as needed. Currently 19 of our 26 students arrive and depart from the Franklin drop off and pick area. The remaining students have special drop off and pick up arrangements using the handicapped areas. If those arrangements continue and we maximize the number of students next year, then 37 of our 44 children will use the Franklin drop off and pick up site. What problems have we hrzd? When? Did they occur during oz�r regular program or some special event? As far as we are aware, we have had no scheduling problem with Franklin School. We have had 2 complaints last year in April and June, during special programs that were run on weekends, or after school. We had an open house one Saturday and a resident asked us to move a car parked in front of her house. It was a public street. In July, we had a parent group meeting in the afternoon, after hours and again, someone asked us not to park in front of their house. Generally, homeowners on the North side of Trousdale Drive are very particular about access to curbside parking in their neighborhood, and as a result we have instructed all staff and parents to park along the school (South side) and field curb on Trousdale Drive and Quesada. The subject property is part of Franklin Elementary School, which is owned by the Burlingame Elementary School District. The existing permit was granted by the Burlingame Planning Commission on January 8, 2001 and became effective January 17, 2001. Back�round On November 14, 2000 the Burlingame Elementary School District Board of Trustees approved leasing the premises to Erudite Technology Group for the purpose of operating a private, non-public school. We have operated Hope Technology School on the Franklin Elementary School premises since April 1, 2001. On March 19, 2002, the School Board approved renewal of our lease for an additional year, effective July 1, 2002. Reason for Amended Application Under the terms of the Conditional Use Permit, a copy of which is attached, if any of the conditions change we are required to come back before the Planning Commission. Due to our plans to add an additional 3rd and 4th grade classroom during 2002-2003, we believe that item 4 requires modification. The total number of students, staff and volunteers at the school will increase from 41 to 62 (12 additional students, lteacher and 1para-educator). It is an exemplary school for elementary-aged children with and without special needs, which capitalizes on best practices and the use of technology. The school provides an integrated approach to special education, as well as a full inclusion program for those children with special needs who can best be served by this setting. Our program contains: Classroom Structure Our classes have intense programs involving a variety of therapies for children with special needs. The program incorporates intensive language instruction, functional skills training, specialized handwriting instruction, an individualized curriculum, one-to-one tutorials, and the use of computer technology tailored to the specific needs of each child. With an eclectic and holistic approach to education the curriculum includes TEACCH, PECS, Applied Behavior Analysis, and Handwriting Without Tears. The class size is small, with a high teacher to student ratio. All children have access to onsite physical and occupational therapy services and benefit from consultations with speech professionals as needed. Our classes follow typical curriculum for children, with added technology strands for education. The regular education kindergarten through 4th grade program emphasizes a multi-age approach to education and provides access to tutorials in the latest technologies. All children have opportunities to learn together through the school's full inclusion program. This includes children with special needs who are added to the program where appropriate. This provides a unique environment that promotes social- emotional growth, while receiving high-level instruction with an eclectic educational curriculum. Class Start and End Times In order to maximize the use of the facility and to control the impact that our school has on the community and Franklin Elementary School, we developed a staggered start and end schedule ("bell schedule") with Franklin Elementary School. At the time, we understood it might be necessary for us to adjust the schedule to accommodate each other's needs and to avoid congestion as we actually used the space. Having that flexibility built into the current Conditional Use Permit has worked well for both school programs. The staggered schedule reduced the traffic flow around the start and close of the regular school day and spread out the traffic impact, by collecting students around the Franklin schedule. We will continue to work cooperatively with Franklin staff to develop a new staggered schedule, which meets their needs as well as ours. And we request that the Planning Commission give us the same flexibility in our amended application. If the Planning Department wants notice of changes in the bell schedule we will do so. Since the proposed amendment for use of the leased premises involves continued operation of a private, nonpublic school site, it is compatible with the existing school use, which is an appropriate conditional use within an R-1 Residential District. Staff, parents and volunteers, as necessary currently use street parking on Trousdale Drive in front of the school. However, Franklin Elementary School has its own staff parking lot and drop off and pick up area off-street. We do not propose to make any exterior structural changes to the school building. Nor do we anticipate making any internal modifications at this time to add the additional classroom. However, if modifications become necessary we will submit them to the appropriate City department for approval. Our use of the property will not change the character of the neighborhood, nor will it increase police or fire protection responsibilities, add additional public health concerns, or prevent access to the property, including the athletic field, by neighbors or members of the public who currently use it. The leased premises have previously been used as a school, or have been occupied by either District administrative staff (for District offices) or private entities under lease to the District, including Hope Technology School for the past year and one-half. In addition, with ADA compliance the premises are accessible for elderly and handicapped persons, should they visit the facility. There is also a social benefit to the community by having our school for exceptional children continue to operate at this location. Issues to be Addressed in the Amendment Parking The parking area which is part of the leased premises, and which was previously approved by the Planning Commission, currently contains 5 parking spaces and 1 handicapped parking space. The lot was designated as a staff parking lot and has been used as such. At the time the parking plan was approved, we were required to reduce the number of spaces from 9 to 5 to address the non-conforming use problem and improve traffic flow. This has resulted in some of our staff having to park on the South side of Trousdale Drive, in front of the athletic field. Parents and volunteers who come to the school also park in the same area on Trousdale Drive, or on Quesada. Although we expected 12 staff and volunteers to need on-street parking, in actual practice we have needed much less. Many of our staff and volunteers commute together, take public transportation, walk or are dropped off at the school. As a result we have not used more than 4 to 5 on-street parking spaces, on average, to accommodate our current group configuration (17 staff and volunteers). During the Summer program we have 1 less staff person on campus. Also, because staff time at the school varies each day, depending on the schedule and the needs of the children for particular therapies, the number of staff and volunteers onsite decreases during the day. For example, at least 6 of our staff and volunteers leave the school each day with the children, and some volunteers are there for only two or three hours at a time and not every day. This further helps to reduce the number of on-street parking spaces needed. Increased Staff, Students and Volunteers In submitting the amendment, we have attempted to estimate as accurately as possible the number of employed staff, volunteers and students we expect onsite. Again we want to make it clear that these are our best projections based on the information we have at this time. As we develop our programs, and especially if we are certified by the State Department of Education as a nonpublic schooUagency, we may need to reconfigure staff in a way where we add a teacher to a class, move volunteers from one class to another, have more staff in one class than another, etc. We may also be asked by the School District or the Department of Education to take an additional child or two. So long as we meet the Education Code requirements for our programs, but do not exceed the maximum number of persons on site (62 in year 2002-2003), we again request that the Planning Commission give us the same flexibility in our amended application to make these internal changes (vary the staff, volunteers and students). If the Planning Department wants notice of these modifications we will do so. I should note that the Administrator would be onsite for the entire program and is not assigned to any one class. It should also be noted that the Physical Therapist and the Occupational Therapist are volunteers, and they will split their time between classes, as part of the full inclusion services for students requiring their services. Drop Off and Pick Up For student drop off and pick up we will continue to use the existing drop off and pick up area on the premises of Franklin Elementary School. The current plan is working, with our staggered class schedules set so that they will not conflict with the start and end times for classes at Franklin School, and Ms. Lisa Booth, the Principal, has agreed to continue the plan for next year. The actual location of the drop off and pick up area is toward the East end of the lot near the Multi-Purpose Room and the Administration Wing. We have a maximum of twelve to twenty students arriving or being picked up at any given time. We will continue to make arrangements to have staff ineet and escort children to the classroom, for those children who need assistance and whose parents make advance arrangements. The pedestrian walkway is from the drop off and pick up area, along the sidewalk, through the covered area between the Multi-Purpose Room and Administration Wing, going East under the covered walkway running along the Multi-Purpose Room, down the covered stairs to our school site. By parking toward the East end it provides more than adequate space along the curb, from East to West, for drop off and pick up. It also shortens the walk to the classroom for students, staff and parents. Since our current and proposed student population does not include children with physical handicaps, the students will continue to use the covered walkway and stairs to walk from the drop off area to their classrooms. Wheel chair access and a ramp will not be required. School District Considerations As part of the approval process, we are required to address the following Guidelines for Leasing Franklin School, adopted by the Burlingame Elementary School District Board of Trustees in 1984. First, we are a nonprofit corporation and as such we are an acceptable use under the Guidelines. We will continue to operate as a private school and may also seek certification from the State Department of Education as a nonpublic, nonsectarian school. Therefore, our business is compatible with Franklin Elementary School and the neighborhood location. Our program is available for students from the Burlingame Elementary School District; however, our plan does not currently include students from the District. If we pursue certification from the State Department of Education, we will offer our services to the District for any students requiring special education and related services, which the District requests us to consider. Our students arrive and leave at staggered times, attend class in their own separate classrooms on campus, have lunch and play activities in their own enclosed areas apart from the Franklin School children and do not interrupt, interfere with, compete with or create unsafe conditions for Franklin School or its students. Second, as explained above, our operation will not create undue traffic in and around the school areas. We will continue to stagger our class start and end times, as well as our drop off and pick up times to ameliorate traffic flow problems. Also our small class sizes reduce the number of students involved in the program. Third, our parking plan should adequately address staff parking issues. The children are elementary students who do not drive and their parents will drop them off and pick them up. Although we will add another classroom, we will only add one additional staff member and one volunteer. That should not create additional unreasonable or excessive on-street parking concerns. Fourth, since we have small class sizes and our children are in self-contained classrooms, in the bottom level of the building we occupy, the noise from their school activities is minimal and not disruptive to the regular instructional program. This is also true with regard to their lunch and play activities. The children are in a fenced area and we schedule their activities so as to not overlap or interfere with Franklin School and its students. Fifth, all the classrooms included in our permit are located in the same building, on the ground floor level, next to one another. This includes the bathrooms. Proposed Use: Same. Allowable Use: Private school requires a conditional use permit. History: The Hope Technology Group is a private non-profit school to provide computer-based learning for elementary school aged children with and without special education needs. On January 8, 2001, the Planning Commission approved a conditional use permit for the operation of a non-profit school on an existing school site (see conditions of approval, dated January 18, 2001). The non-proiit school is located on the lower floor of an existing building on the Franklin Elementary School site. Hope Technology Group is requesting to amend their use pertnit to alter their class schedule by adding a class and having all classes begin at the same time, and to add 21 more students and staff to the school's operations. Summary: The applicant, Hope Technology Group, is requesting a conditional use permit amendment to alter the approved the class schedule and to increase the number of persons on site at any one time. The January 8, 2001, approval allowed a maa�imum of 41 persons on site at any one time. Hope Technology notes that in practice, the exact numbers of staff and students did not conform to the approved numbers. The approval allowed 17 staff and 24 students, when in practice there were 15 staff and 26 students. The maximum number of persons on site was still 41. The total number of people, including students and staff, was distributed between three classes. The school would now like to increase the maximum number of students in their existing three classes, as well as add an additional class, and also to increase the number of staff inembers on site. The total number of persons on site at any one time would increase by 21 persons, from 41 to 62. The additional class for the school requires a change to the schedule approved with the January 8, 2001 permit. With the approved use permit, three classes were staggered to start at 15-minute intervals and to end with at least an hour between each class. With the proposed amendment, the four proposed classes would start and end at the same time. With the revised four classes, there would be 18 staff (instructors and administrators) on site with 44 students, who all could arrive and depart at the same time. Compared to the approved permit, this represents an increase of 21 persons on site at one time (from 41 to 62). Compared to the current practice of the school regarding the mix of staff and students, the number of staff will increase by 3 persons (from 15 to 18) and the number of students will increase by 18 persons (from 26 to 44), for a total of 62 persons arriving and departing at the same time. Students will proceed to the Hope Technology school building via an existing covered walkway. Students may also, by prior arrangement, be met at the drop-off area and escorted by a staff inember to the classes. There is no proposal to expand the classroom area or to alter the existing building with the proposed application. There are no proposed changes to the approved parking on site designated for Hope Technology, 5 standard and 1 disabled parking spaces. This project meets all other zoning code requirements. Planning staff would note that attached to this staff report for your information is a handout provided by the school district titled Guidelines for Leasing Franklin School developed by the school community in 1984. This handout lists conditions for leasing the school property that were developed in 1984, pursuant to the vacancies created in many public schools. The City of Burlingame was not involved in creating these guidelines. The City has received no direct communication from representatives of Franklin School about how the present program is working with their on-site program.
