Since there was no appeal to or suspension by the City Council, the September 24, 2018, Planning
Commission approval of your application for Design Review became effective October 4, 2018. This
application was for a second story addition to an existing one-story duplex dwelling at 2108 Clarice
Lane, zoned R-2.
The September 24, 2018 minutes of the Planning Commission state your application was approved with
the following conditions:
that the project shall be built as shown on the plans submitted to the Planning Division date
stamped September 13, 2018, sheets A-1 through A-8;
2. that the simulated true divided lites for the new windows shall consist of dimensional
muntins on both the interior and exterior surface of the dual glazing with a dividing bar in
between the glazing not muntins in between the glass or on the interior only;
3. that any changes to building materials, exterior finishes, windows, architectural features,
roof height or pitch, and amount or type of hardscape materials shall be subject to Planning
Division or Planning Commission review (FYI or amendment to be determined by Planning
staf�;
4. that any changes to the size or envelope of the first or second floors, or garage, which
would include adding or enlarging a dormer(s), shall require an amendment to this permit;
5. that any recycling containers, debris boxes or dumpsters for the construction project shall
be placed upon the private property, if feasible, as determined by the Community
Development Director;
6. that demolition or removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be
required to comply with all the regulations of the Bay Area Air Quality Management District;

7. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall not
be modified or changed without the approval of the Planning Commission, or City Council
on appeal;
8. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that
these venting details shall be included and approved in the construction plans before a
Building permit is issued;
9. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
10. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2016 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
11. that prior to scheduling the framing inspection the applicant shall provide a certification by
the project architect or residential designer, or another architect or residential design
professional, that demonstrates that the project falls at or below the maximum approved
floor area ratio for the property;
12. prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural
certification that the architectural details shown in the approved design which should be
evident at framing, such as window locations and bays, are built as shown on the approved
plans; architectural certification documenting framing compliance with approved design
shall be submitted to the Building Division before the final framing inspection shall be
scheduled;
13. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height
of the roof ridge and provide certification of that height to the Building Divisian; and
14. that prior to final inspection, Planning Division staff will inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verify that the project has been
built according to the approved Planning and Building plans.
All site improvements and construction work will require separate application to the Building Department.
This approval is valid for one year during which time a building permit must be issued. An extension of
up to one year may be considered by the Planning Commission if application is made before the end of
the first year.

The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within

Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of more than 10,000
SF in areas where all public services and facilities are available and the area in which the project is located is not
environmentally sensitive.
Project Description: The subject property is an interior lot that contains a one-story duplex dwelling with an
attached garage and uncovered parking for each respective unit. The applicant is proposing to add a second
story to the duplex totaling 1,675 SF. The existing lot coverage is nonconforming since it exceeds the maximum
allowed lot coverage by 98 SF. With this project, there is no increase in lot coverage. There is no FAR
requirement for the R-2 zone, so the FAR was not calculated for the property.
With this application, the number of bedrooms will increase from three to four in Unit A and from two to four in
Unit B. Based on the existing bedroom count, a total of four and one-half parking spaces are required (rounded
up to five spaces). Based on the proposed bedroom count, a total of five parking spaces are required on-site, so
there is no increase in the number of parking spaces required. Three covered parking spaces are provided in the
existing garages and two uncovered parking spaces (9' x 20') are provided in the driveway area in front of the
garages. The code requires that 80% of the required parking spaces, or in this case four spaces, must be
covered. The existing on-site parking is nonconforming with respect to the percentage of required parking that is
required to be covered (60% existing). However, since there is no increase in the total number of parking
spaces required based on the proposed parking demand, a Variance is not required for this existing
nonconforming condition. All other Zoning Code requirements have been met. The applicant is requesting the
following application:

Staff Comments: None.
Design Review Study Meeting: At the Planning Commission Design Review Study meeting on August 27,
2018 the Commission had suggestions for the proposed project and voted to place this item on the regular
action calendar when all of the required information has been submitted (see attached August 27, 2018,
Planning Commission Minutes).
The following is a summary of Commission's suggestions with noted changes based on revised plans submitted
by the applicant on September 13, 2018:
■ Windows — though the existing windows have grilles in between the glass, simulated true divided lite
windows are preferred for the addition or consider proposing no grids at all.
The applicant is proposing fo match the existing windows with the grilles in between the g/ass. ln a letter
to the Planning Commission (received Sepfember 13, 2018), the homeowners stated that they are open
to considering a type of window that is approvable by the Commission.
■ Left Side Elevation — fa�ade is blank and flat, add more detailing like the right side elevation or consider
creating more articulation on the second floor.
Two dormers have been added to this elevation by bumping out fhe master bathrooms in each unif,
increasing the total floor area for the second floor by 25 SF.
■ Hardie Siding —would like a sample of the siding or address of site(s) in Burlingame that have used this
siding; clarify if siding will carry through all elevations or if there will be a stucco band in the middle on the
side elevations.
The applicant has changed their proposal to wood siding instead of Hardie siding.

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Suggested Findings for Design Review: That the architectural style, mass and bulk of the addition (featuring
hip roofs, proportional plate heights, wood corbels, and wood siding) is compatible with the existing structure and
character of the neighborhood, that no increase in parking demand is consistent with the garage and parking
pattern in the neighborhood, and that the architectural elements of the proposed structure are placed so that the
structure respects the interface with the structures on adjacent properties, therefore the project may be found to
be compatible with the requirements of the City's five design review criteria.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped
September 13, 2018, sheets A-1 through A-8;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staffl;

There were no questions of staff.
Acting Chair Kelly opened the public hearing.
Jaime Rapadas represented the applicant, with property owner Janice Samuelson.
Commission Questions/Comments:
> Can the uncovered parking spaces shown in the courtyard space be in tandem with the covered
parking in the garage? (Kolokihakaufisi: Yes, this is allowed.)
> New vinyl casement windows are proposed to match the existing window material, which is a type of
window we typically do not approve or encourage, the muntins are in between the g/ass. Was there any
desire or intent to change the character, even if it's just on the addition area and not match the existing
windows and get something with more substance? (Rapadas: We are matching the existing windows and
using the same grid system.)
> Concerned with matching windows with the existing windows that contain grids between-the-g/ass.
Encourage doing something more substantive on the addition area.
> Houses on Quesada Way sit higher than houses on Marco Polo Way, based on your location not
certain if the proposed addition may block views from your neighbor on Quesada Way. Have you shared
the plans with your neighbor? (Samuelson: Have not, thought that if the neighbor was concemed they
would have submitted a letter or come to the meeting.).
> Encourage you to present the plans to your neighbor since the proposed addition is up against their
rear property line and is the side that faces the bay.
> What is the type of siding proposed for the vertical siding on the second story? (Rapadas: lt will be
Hardie board, have used it on other projects when there is an elongated design, he/ps to reduce the bu/k.)
> Would be helpful to see samp/e of proposed siding.

Commission Discussion:
> Torn about the project, likes that owners are investing in the neighborhood. The massing has charm

to it and fits with concept of a duplex, but it lacks the additional charm in terms of detailing.
> Existing building has a certain quality and calmness to it because it is relatively simple and has some
nice brick highlights which appear fo be in good condition. However, the proposed materials on the
addition seem foreign. Vertical paftern of Hardie planks does not harmonize well with the brick. Don't
think fhere is a logic that says put brick on the second story, because fhen you're taking brick which is
normally at the base of a building and pufting it in a weird location on the facade.
> The corbel details, supporting second floor in the courtyard area, invoke a little bit of the existing
charm. But the /eft side elevation goes blank, looks like iYs just a layer added on top. It would help if it
had some additional charm and depth. Concern is that using the same windows, which appear flat, you
don't get any depth or shadows because the muntins are between the g/azing that you normally get with
simulated true divided lite windows. So if windows along the back facade a/so have muntins in between
glazing, that facade will also appear flat.
> Programmafically, the project works well. However, project is missing charm and character that it
needs to be successful.
> Vertica/ siding is shown throughout on the perspective above the belt course, but the e/evations show
the siding seeming to bracket the ends, but disappear in the middle.
> Really like the right side elevation, left side elevation is complete/y cold because it so flat.
> Don't think muntins befween-the-glass have ever been approved, if fact in recent project suggested
that the grids be removed entire/y because it looks cheap. Right side e/evafion does a nice job at not
being a wedding cake, the left side elevation not so much, is cold, flat and unfriendly. Need to work
through the details more, it's almost there with the right detailing.
> Question is whether or not to refer this project to a design review consultant, right on the cusp, not
sure which direction to take.
> Like the exposed brick, see it on many houses in fhe area and would like to see all the brick
elements remain.
> Second floor needs more work, but not sure iYs lacking to the point that it needs to be referred to a
design review consultant as long the applicant is open to changing the materials and design e/ements on
the second floor.
> Left elevation is up against a grove of trees and is the /east visible of fhe facades, appreciate thaf
there are not a lot of windows overlooking that neighbor on Quesada Way.
> Prefer simulated frue divided lite windows, not comfortable approving muntins in between glazing.
> Wants applicant to clarify if Hardie siding will be what is shown on the perspective or on the
elevations. Have never seen Hardie board applied vertically, concerned that it will look like T-111 siding
and whether it fits the level of quality in material we typically see in a project like this. Request that
applicant bring in a sample.
> Recently approved projects in the neighborhood, like the house across the street, have the /evel of
detailing desired and are consistent with the design guidelines.
Commissioner Sargent made a motion, seconded by Commissioner Tse, to place the item on the
Regular Action Calendar. The motion carried by the following vote:

of the bathrooms to add articulation along that facade; might also give some logic to how wood
siding could stop and terminate or continue around top course.

Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15301 (e)(2), which states that additions to existing structures
are exempt from environmental review, provided the addition will not result in an increase of more than 10,000
SF in areas where all public services and facilities are available and the area in which the project is located is not
environmentally sensitive.
Project Description: The subject property is an interior lot that contains a one-story duplex dwelling with an
attached garage and uncovered parking for each respective unit. The applicant is proposing to add a second
story to the duplex totaling 1,675 SF. The existing lot coverage is nonconforming since it exceeds the maximum
allowed lot coverage by 98 SF. With this project, there is no increase in lot coverage. There is no FAR
requirement for the R-2 zone, so the FAR was not calculated for the property.
With this application, the number of bedrooms will increase from three to four in Unit A and fro t�wo to four in
Unit B. Based on the existing bedroom count, a total of four and one-half parking spaces�are req�re� (rounded
up to five spaces). Based on the proposed bedroom count, a total of five parking spaces are required on-site, so
there is no increase in the number of parking spaces required. Three covered parking spaces are provided in the
existing garages and two uncovered parking spaces (9' x 20') are provided in the driveway area in front of the
garages. The code requires that 80% of the required parking spaces, or in this case four spaces, must be
covered. The existing on-site parking is nonconforming with respect to the percentage of required parking that is
required to be covered (60% existing). However, since there is no increase in the total number of parking
spaces required based on the proposed parking demand, a Variance is not required for this existing
nonconforming condition. All other Zoning Code requirements have been met. The applicant is requesting the
following application:

Design Review Study Meeting: At the Planning Commission Design Review Study meeting on August 27,
2018 the Commission had suggestions for the proposed project and voted to place this item on the regular
action calendar when all of the required information has been submitted (see attached August 27, 2018,
Planning Commission Minutes).
The following is a summary of Commission's suggestions with noted ch�nges based on revised plans submitted

■ Windows — though the existing windows h�ve grilles in between the glass, simulated true divided lite
windows are preferred for the addition or consider proposing no grids at all.
The applicant is proposing to match the existing windows with the grilles in between the g/ass. ln a letter
to the Planning Commission (received September 13, 2018), the homeowners stated that they are open
to considering a type of window that is approvable by the Commission.
■ Left Side Elevation — fa�ade is blank and flat, add more detailing like the right side elevation or consider
creating more articulation on the second floor.
Two dormers have been added to this elevation by bumping out the masfer bathrooms in each unit,
increasing the total floor area for the second floor by 25 SF.
■ Hardie Siding —would like a sample of the siding or address of site(s) in Burlingame that have used this
siding; clarify if siding will carry through all elevations or if there will be a stucco band in the middle on the
side elevations.
The applicant has changed their proposal to wood siding instead of Hardie siding.

Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Suggested Findings for Design Review: That the architectural style, mass and bulk of the addition (featuring
hip roofs, proportional plate heights, wood corbels, and wood siding) is compatible with the existing structure and
character of the neighborhood, that no increase in parking demand is consistent with the garage and parking
pattern in the neighborhood, and that the architectural elements of the proposed structure are placed so that the
structure respects the interface with the structures on adjacent properties, therefore the project may be found to
be compatible with the requirements of the City's five design review criteria.
Planning Commission Action: The Planning Commission should conduct a public hearing on the application,
and consider public testimony and the analysis contained within the staff report. Action should include specific
firidings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning
Commission. The reasons for any action should be stated clearly for the record. At the public hearing the
following conditions should be considered:

1. that the project shall be built as shown on the plans submitted to the Planning Division date stamped
September 13, 2018, sheets A-1 through A-8;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Pfanning staffl;

> Existing building has a certain quality and calmness to it because it is relatively simple and has some
nice brick highlights which appear to be in good condition. However, the proposed materials on the
addition seem foreign. Vertical pattern of Hardie planks does not harmonize well with the brick. Don't
think there is a logic that says put brick on the second story, because then you're taking brick which is
normally at the base of a building and putting it in a weird location on the facade.
> The corbel details, supporting second floor in the courtyard area, invoke a little bit of the existing
charm. But the left side elevafion goes blank, looks like rYs just a layer added on top. It would help if it
had some additional charm and depth. Concern is that using the same windows, which appear flat, you
don't get any depth or shadows because the muntins are between the glazing that you normally get with
simulated true divided lite windows. So if windows along the back facade also have muntins in between
glazing, that facade will also appear flat.
> Programmatically, the project works well. However, project is missing charm and character that it
needs to be successful.
> Vertical siding is shown throughouf on the perspective above the belt course, but the elevations show
the siding seeming to bracket the ends, but disappear in the middle.
> Really like the right side elevation, left side elevation is completely cold because it so flat.
> Don't think muntins between-the-glass have ever been approved, if fact in recent project suggested
that the grids be removed entirely because it looks cheap. Right side elevation does a nice job at not
being a wedding cake, the left side elevation nof so much, is cold, flat and unfriendly. Need to work
through the details more, iYs almost there wiih the right detailing.
> Question is whether or not to refer this project to a design review consultant, right on the cusp, not
sure which direction to take.
> Like the exposed brick, see it on many houses in the area and would like to see al! the brick

RESOLUTION APPROVING CATEGORICAL EXEMPTION,
DESIGN REVIEW
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been prepared and application has been made for Desi n
Review for a second story addition to an existinq one-story duplex dwellina at 2108 Clarice Lane.
Zoned R-2, Richard and Janice Samuelson propertv owners APN� 025-141-160;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
September 24, 2018, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this Commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and categorical
exemption, per CEQA Section 15301 (e)(2) of the CEQA Guidelines, which states that additions to
existing structures are exempt from environmental review, provided the addition will not result in an
increase of more than 10,000 SF in areas where all public services and facilities are available and
the area in which the project is located is not environmentally sensitive, is hereby approved.
2. Said Design Review is approved subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such Design Review is set forth in the staff report, minutes, and recording of
said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records of
the County of San Mateo.

that the project shall be built as shown on the plans submitted to the Planning Division
date stamped September 13, 2018, sheets A-1 through A-8;
2. that any changes to building materials, exterior finishes, windows, architectural features,
roof height or pitch, and amount or type of hardscape materials shall be subject to
Planning Division or Planning Commission review (FYI or amendment to be determined
by Planning staffl;
3. that any changes to the size or envelope of the first or second floors, or garage, which
would include adding or enlarging a dormer(s), shall require an amendment to this
permit;
4. that any recycling containers, debris boxes or dumpsters for the construction project
shall be placed upon the private property, if feasible, as determined by the Community
Development Director;
5. that demolition or removal of the existing structures and any grading or earth moving on
the site shall not occur until a building permit has been issued and such site work shall
be required to comply with all the regulations of the Bay Area Air Quality Management
District;
6. that prior to issuance of a building permit for construction of the project, the project
construction plans shall be modified to include a cover sheet listing all conditions of
approval adopted by the Planning Commission, or City Council on appeal; which shall
remain a part of all sets of approved plans throughout the construction process.
Compliance with all conditions of approval is required; the conditions of approval shall
not be modified or changed without the approval of the Planning Commission, or City
Council on appeal;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a
single termination and installed on the portions of the roof not visible from the street; and
that these venting details shall be included and approved in the construction plans
before a Building permit is issued;
8. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects
to submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
9. that the project shall meet all the requirements of the California Building and Uniform
Fire Codes, 2016 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:

10. that prior to scheduling the framing inspection the applicant shall provide a certification
by the project architect or residential designer, or another architect or residential design
professional, that demonstrates that the project falls at or below the maximum approved
floor area ratio for the property;
11. prior to scheduling the framing inspection the project architect or residential designer, or
another architect or residential design professional, shall provide an architectural
certification that the architectural details shown in the approved design which should be
evident at framing, such as window locations and bays, are built as shown on the
approved plans; architectural certification documenting framing compliance with
approved design shall be submitted to the Building Division before the final framing
inspection shall be scheduled;
12. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the
height of the roof ridge and provide certification of that height to the Building Division;
and
13. that prior to final inspection, Planning Division staff will inspect and note compliance of
the architectural details (trim materials, window type, etc.) to verify that the project has
been built according to the approved Planning and Building plans.
