RESOLUTION-37-99
RESOLVLD, by the Planning Commission of the City of Burlingame that:
WHL-'I:EnS, a categorical exemption has been proposed and application has been made for a

WHERLAS, said matters were lleard by the Planning Commission of the City of Burlingame on
March 22, 1999 , at which time it reviewed and considered the staff report and all other written materials
and testimony presented at said Ilearing;
NOW, `I'HEREFORE, it is RESOLVED a»d DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this com�»ission, it is hereby found that there is no substantial evidence that the
project set 1�orth abo��e ���il] have a significant effect on the environment, and categorical exemption, per
CEQA Article 19, Section 15301, existing Facilities, class 1(e)(2), Additions to existing structures provided
that the addition �vill not result in an increase of more than 10,000 SF, and if all public facilities are
available for maximum development permissible in the general plan, and the site is not in an
environmentally scnsitive area is hereby approved.
2. S<iicl p�u-king variance and conditional use permit is approved, subject to the conditions set
forth in Exhibit °A° attached hereto. Findings for sucll parking variance and conditional use permit are
as set forth in the minutes and recording of said meeting.
3. it is tu�-the.�� directed that a certitied copy of this resolution be recorded in the official records
of the Counry ��1' S<<n M<iteu.

EXHIBIT "A"
Conditions of approval categorical exemption, parking variance and conditional use permit
851 Burlway Road
effective April 5, 1999
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped February 10, 1999, Sheets A-02 through A-13, and date stamped
March 16, 1999, sheet A-1, parking layout plan and shall provide a total of 170 parking
spaces, 134 standard, 30 compact and 6 disabled accessible spaces, for a 69 space
parking variance;
2. that the storage building with 6 covered parking spaces may be retained on the site, and
the 6 covered parking spaces within the storage building shall never be converted to
another use;
3. that the existing lobby (net usable space as shown on Table A presented by the applicant)
areas and corridors shall not be converted to leasable office space;
4. that should the building be demolished (50% or substantial cost replacement value, in the
future, it shall be rebuilt to the building codes in effect at that time; and
5. that any improvements for the use shall meet all California Building and Fire Codes,
1995 Edition as amended by the City of Burlingame.

Unusable area or square footage is normally referred to as the common area, and includes
lobbies, corridors, elevators, restrooms and . stairwells. The City of Burlingame, in
addition to common area, also includes mechanical rooms in their calculation of gross area
of a building which are also unusable for leasing purposes.
