Dear Mr. I,yons,
Since there was no appeal to or suspension by the City Council, the March 22, 1999 Planning
Commission approval of your parking variance and conditional use permit became effective April 5,
1999. This application was to allow an increase in the floor area of an existing office building at 851
Burlway Road, zoned O-M.
The March 22, 1999 minutes of the Planning Commission state your application was approved with the
following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped February 10, 1999, Sheets A-02 through A-13, and date stamped March 16, 1999, sheet
A-1, parking layout plan and shall provide a total of 170 parking spaces, 134 standard, 30 compact
and 6 disabled accessible spaces, for a 69 space parking variance;
2. that the storage building with 6 covered parking spaces may be retained on the site, and the 6
covered parking spaces within the storage building shall never be converted to another use;
3. that the existing lobby (net usable space as shown on Table A presented by the applicant) areas and
corridors shall not be converted to leasable office space;
4. that should the building be demolished (50% or substantial cost replacement value, in the future,
it shall be rebuilt to the building codes in effect at that time; and
5. that any improvements for the use shall meet all California Building and Fire Codes, 1995 Eciition
as amended by the City of Burlingame.

All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be issued.
One extension of up to one year may be considered by the Planning Commission if application is made
before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.
Erection of the signage will require separate application to the Building Department.

Unusable area or square footage is normally referred to as the common area, and includes
lobbies, comdors, elevators, restrooms and . stairwells. The City of Burlingame, in
addition to common area, also includes mechanical rooms in their calculation of gross area
of a building which are also unusable for leasing purposes.
