DATE 5 A -6-P�- �"V f ���v7 11/4/85 sue�ecT: APPEAL OF PLANNING COMMISSION ACTIOIV ON A SPECIAL PERMIT FOR AN INSURANCE REPLACEMENT AUTO RENTAL AGENCY AT 851 BURLWAY ROAD RECOMMEiVDATION : City Council hold a public hearing and take action. The following conditions were considered by the Planning Commission: 1. that the conditions of the City Engineer's August 7, 1985 memo shall be met; 2. that the fleet size operated from this site shall be limited to no more than 25 cars and that this car rental agency shall be open 8:00 A.M. to 5:00 P.M., Monday through Friday, and have no more. than two employees; 3. that no car repairs or car maintenance shall take place on site and no more than five rental cars shall be parked on site at one time; 4. that no car rental car deliveries shall be made at this site and no car transport trucks shall be unloaded or loaded at this site; 5.. that the car rental lease agreement„ shall be written in the City of Burlingame; and 6. that this use permit shall be revi�wed in nine months (May, 1986) or on receipt of any complaint regarding its operation on the site of 851 Burlway Road. Action Alternatives: 1. uphold the Planning Commission's denial of this special permit request for an auto rental agency at 851 Burlway Road; 2. reverse the Planning Commission action and grant the use permit with conditions for an auto rental agency at 851 Burlway Road. Affirmative action should be accompanied by a clear statement of the reasons for the action and should be taken by resolution. BACKGROUND: Agency Rent-A-Car is requesting a special permit to operate an insurance replacement car rental agency from an office building at r • � ' -2- 851 Burlway Road (Code Sec. 25.42.030). This car rental agency rents cars to people while their own vehicles are in the shop for repairs. The agency will rent 365 SF of office area in the building and wou ld park three rental cars on site, plus those non-rental cars driven by the employees. The business would employ three people full time on site and operate from 8:00 A.M. to 5:00 P.M., Monday through Friday. During Planning Commission review we received a letter from the property owner agreeing to designate four on-site parking spaces to this tenant. The applicant also noted during review that they would be willing to guarantee that all rental cars in excess of three would be removed to either their San Carlos or Daly City locations within a fixed time, e.g., four or eight hours. At their meeting of September 23, 1985 the Planning Commission held a public hearing and voted 6-0 (Commissioner Leahy absent) on a motion to deny the special permit. The reasons for the Commission's action included the number of car rental agencies in the city, difficulty of enforcement on this multiple use site, the fact that parking on site does not now meet current cod� (1:300 gross square feet, approved 1:400 gross square feet), current demand for parking on this site is heavy, and because the parking demands of this use exceed the number designated by code (use by this business 6, number based on original parking of 1:400, 1). Because of the parking demands of this use this business could only operate at this location at the expense of other tenants (Planning Commission minutes, September 23, 1985). CP noted applicant's sugqestion that condition #2 be changed to require all cars on the lot exceeding the allotted four be moved to the San Bruno or Daly City locations within eight hours. Commission discussion: the fact that if the applicant's suqgested condition were allowe3 it would apply to any new user in the same location; parking for the full time employees and for visitors. Brian Cochran, Amerex Rent A Car (applicant) advised the employees drive company cars which are not parked on site all day; office is open all day with an office manager on site; two other employees, a sales representative and a delivery person, are there only 15 minutes at the beginning of the day; the delivery person is out all day delivering cars to body shops. He estimated they hav� five visitors per day, five minutes per visit. Chm. Garcia declared the public hearing open. Ther� were no audience comments and the hearing was closed. Further Commission discussion: location of car rental agencies in the city; enforcement of conditions of the permit; on-site parking for this building does not meet present code requirements; concern about sufficient parking for this business and its visitors now and in the future, or for any future car rental us� at this location; because parking requirement was less than current and spaces from that limited number are designated to this use, do not believe this use can operate in the space available to them except at the expens� of the other tenants in the building. Giomi commented that Commission has looked at several applications in office buildings with an intense use such as this; a landlord may assign spaces but it would affect other tenants and compound the parking problem on site and in the surrounding area. Roy Santos, office manager representing Brian Cochran, district manager, Amerex Rent-A-Car addressed Commission: they have been operating from this site for a year, have received no complaints from tenants of the building; most cars are delivered to several body shops in the bay area, they are left there and are not brought back to the office site; Amerex uses three on-site parking spaces per day at the most; this office is used only as a reservation and dispatch center. Chm. Garcia opened the public hearing. There were no audience comments and the hearing was closed. Responding to Commission question, applicant stated they could not conform to the condition requiring all lease agreements be written in the City of Burlingame; regarding limitation of the fleet size to 25, he could see no reason why they should be limited to 25 since even with a 90 car fleet most cars would not be in the parking lot. Staff advised 25 was an arbitrary number, since these permits run with the land it is a control on the volume of this and future businesses. The agency will operate from a 365 SF office area within the building, no fleet size was indicated but a maximum number of cars parked on site of five was indicated. The company would employ two people full time. The business would operate from 8:00 A.M, to 5:00 P.M, City Staff Review City staff have reviewed this request. The Chief Building Inspector (July 29, 1985 memo) and the Fire Marshal (July 29, 1985 memo) had no comments. The City Engineer (August 7, 1985 memo> notes that the use should not be allowed if the parking on site cannot accommodate all parking required for the fleet and employees. Peak hour traffic generation because of the use is not a factor. Further the City Engineer requires that parking stalls be designated for this use but only after a parking count with floor area (by use) is made. Planning staff would note that this use as Droposed would occupy 365 SF of an existing office building and use Monday through Friday seven on-site parking spaces. The parking requirement for this building at the time of construction was one space for every 400 gross square feet, which is less than the current requirement for office parking of 1:300. As a result this use would consume the equivalent parking to serve 2,800 gross square feet of the building. It is, of course, difficult to know the average occupancy by floor area of the building, but this building begins with less parking than now required. Certainly the on-site parking will not be adequate for the employees of other businesses in the building and their visitors, if individual uses are allowed to consume more parking than required by their employees. A note on fleet size. If the applicant can run 98� of his fleet in the field and have only three cars on site on average (not to exceed five) he can theoretically operate a 150 car fleet from the site. In the past we have strictly regulated fleet size to something considerably less than that. The applicant does not state the fleet size, merely not?s that if cars are not in demand they will be shipped to a different area. A basic question is where will they be stored as they accumulate for relocation. Staff feels it might be more appropriate to regulate fleet size from this office. We tried to reach the applicant to discuss this issue but could not reach anyone at either number given us. -2- Past experience indicates that car rental agencies located on office sites frequently cause conflicts with other tenants. In addition considerable staff time is consumed pursuing complaints which result from incompatibility of the car rental use with other uses on the site. A�plicant's Letter In her letter of July 15, 1985 Virginia Goodwind states that this agency is an insurance replacement vehicle rental company. They deliver cars to customers. They either tow a car to the pickup site or use two cars to make delivery. When cars are not rented they are transferred to other locations where they can be rented. The rented car is returned to the place it was delivered. She reports that they do have two cars on the site of the office at all times. She notes in her second letter that there is no assigned parking on the site specified in their lease. Study Questions At the study meeting the Planning Commission asked a number of questions (Planning Commission minutes, August 12, 1985). One of these questions is addressed in the applicant's letter of July 15. The lease does not address designated on-site parking. The remaining questions should be asked of the applicants at the meeting since staff was unable to reach either of them. The questions were: (1> what does the applicant propose to do with the five rental cars and two employee cars if there is no designated on-site parkinq and (2) what are the operating conditions (area leased, parking available, etc.) of this company at their other locations? Planninq Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: l. that the conditions of the City Engineer's August 7, 1985 memo shall be m�t; 2. that the fleet size operated from this site shall be limited to no more than 25 cars and that this car rental agency shall be open 8:00 A.M, to 5:00 P.M., Monday through Friday, and have no more than two employees; 3. that no car repairs or car maintenance shall take place on site and no more than five rental cars shall be parked on site at one time; 4. that no car rental car deliveries shall be made at this site and no car transport trucks shall be unloaded or loaded at this site; -3- 5. that the car rental lease agreement shall be written in the City of Burlingame; and 6. that this use permit shall be reviewed in nine months (May, 1986) or on receipt of any complaint regarding its operation on the site of 851 Burlway Road. We deliver cars to body shops, homes, and workplaces of our customers. Our vehicles are often towed to the site of the rental. We also dispach two vehicles for one delivery in order to avoid the time necessary to tow. Most of our vehicles are rented every day. We have been operating at a 98/ utilization for the last six months. Thi�s means that �3/ of our fleet is not on site. The other 2/ consists of cars that are out of service and located. at service shops in the area. In the event we do not rent all of our cars out for a particular day, we transfer the cars to other locations where they will be rented for that day. When the customer is finished using the car they leave it parked at the same place it was delivered (usually a body shop). When we have another customer that needs a car we then pick up the car take it to a car wash and deliver it to the next site. This project should provide all parking for both storage of vehicles and for employees. Since the peak traffic period for this use is probably not during normal peak hours, the traffic demand is probably not much different than office use, at least for this number of vehicles (2- 5). Traffic demand therefore is not a specific concern. Staff recommends that this application be conditioned on the following: l. That sufficient parking spaces be assigned and signed for this use, both storage and employee.
