A Negative Declaration has been filed (PdD-228P, posted February 14, 1980) with the determination that the snack bar will not have a significant effect on the environment. The reasons for this conclusion were: "The modest floor area of this shop and limited seating would seem to confirm the applican t's intent to provide services to businesses in the immediate area. Little drive-in traffic is expected. The property owner feels that the 171 on-site parking sr�aces will be adequate, since most lunch time customers will be employees presently working within the 60,000 SF office building". Copies of the application were circulated to the Department of Public Works and Chief Fire Inspector. No adverse comments have been received. The February 19 memo from the Chief Fire Inspector advises that the Fire Department has no objection to this cafe, provided that no cooking is done until an approved ventilation system for "grease laden vapors" is provided together with an automatic fire extinguishing system. (Mr. Douveas aresently uses a microwave oven to heat food, and has no plans to install a stove in the cafe.) The Traffic Engineer reports that "as there is an excess of empty parking stalls on-site during normal working hours ... I see no problem with oarking or traffic". It has been Burlingame's policy to permit coffee shops in the M-1 District when their services support other permitted businesses in the immediate area. Two issues are raised by this application: one, are the proposed on-site arrangements satisfactory? (for example, floor plan details, fire and building code conformance, and support for this service from other firms in this building); and two, will the cafe be compatible with other nearby businesses? From the materials filed with this application, and staff comments received, it appears that La Petite Cafe meets the first of the above tests. The second issue - the compatibility of this shop with other nearby businesses - has two parts: one, the service this shop will qrovide to these businesses (which appears to be consistent with our present policies); and two, the competition this new cafe will offer to the other coffee shops at 1461 Bayshore Highway, 833 Mahler Road and 875 Mahler Road (see attached location alan). It is staff's recommendation that free competition be allowed; no significant adverse effects to the community or employees of industrial and business firms in this district are likely to result from this competition*. *In 1978 the Commission listened to a request that the number of new racquetball clubs be limited to what the market could absorb; that request was refused with the explanation that "if the use if found suitable in the zone and codes are met, the Commission does not make decisions on business competition" (Commission minutes 7/24/78). -2- For the above reasons, staff recommends that this Special Permit be approved. Recommended conditions for Commission review at the public hearing are: 1. that the permit be approved to John Douveas, and be nontransferable; 2. that the size and location of the coffee shop be consistent with the plan date stamped January 30, 1980; 3. that not more than 6 tables/20 seats be available for customer use; 4. that the hours of operation not exceed 8:00 A.M, to 4:00 P.M.; 5. that the code req uirements identified in the February 19, 1980 memo from the Chief Fire Insoector be observed; and 6. that the permit be subject to review in one year and be subject to possible modification at that time.
