CEQA Status: Article 19. Categorically Exempt per Section: 15301 - Existing Facilities, Class 1,
operation of existing private structures involving negligible or no expansion of use beyond that
previously existing.
Ordinance: In October 1999, the City Council adopted Ordinance 1619 which makes all food
establishments in the Burlingame Avenue commercial area, Subarea A, and the Broadway commercial
area conditional uses. The City Council also adopted Resolution 111-1999, which includes a Food
Establishment by Type Table establishing the location, type and seating area for each food establishment
in each commercial area. Some of the existing food establishments within these areas already have
conditional use permits for take-out, delivery services and/or expansions. The ordinance requires that
these establishments obtain amendments to their existing conditional use permits to reflect the
requirements of the new ordinance.
In order to facilitate for merchants and property owners the transition to the new requirements and to
provide them with an opportunity to clarify their establishment's operation, the City has initiated the
conditional use permit application at no cost to the owner or merchant.
Summary: In January 1996, the Planning Commission approved a conditional use permit for take-out
food for World Wrapps at 1318 Burlingame Avenue (February 6, 1996 approval letter and January 22,
1996 P.C. Minutes). In March 1999, the Planning Commission approved a conditional use permit
amendment to allow expansion of the seating area (March 16, 1999 approval letter and March 8, 1999
P.C. Minutes). Since World Wrapps currently has a conditional use permit for take-out food and
expansion of seating area, this application is for an amendment to the existing conditional use permit
as required by Ordinance 1619. The Food Establishment Table by Type defined the food establishment
located at 1318 Burlingame Avenue as follows:

The current food establishment located at 1318 Burlingame Avenue, World Wrapps, is classified as a
Specialty Shop with 434 SF of on-site seating. In the July 1998 survey for World Wrapps, it was noted
that at this premise food is ordered and paid for before consumption and that food is served on plastic
and ceramic plates with plastic and metal flatware. During the public hearings on the ordinance and
implementing tables, the information on the survey gathered by Planning staff was not disputed by the
merchant or property owner.

Staff Comments: The City Engineer, Chief Building Official and Fire Marshal reviewed the ordinance
and classifications and had no comments. Changes to tenant improvements will require additional city
review.
Criteria for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning
Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in accord with the Burlingame general
plan and the purposes of this title;
(c) the Planning Commission may impose such reasonable conditions or restrictions as it deems
necessary to secure the purposes of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining
properties in the general vicinity.
Findings for This Conditional Use Permit: Since the current regulations limit the number of food
establishments to those in the area as of November 1999 and then as approved by City Council
Resolution No. 111-1999 on October 18, 1999, and this business meets those criteria and the business
will operate within the limits established by that ordinance, the use will not be detrimental to the city's
objective of promoting pedestrian oriented retail activity in this commercial area and will be in
compliance with the general plan for the area; and since the business shall be required to comply with

all the city regulations including providing trash receptacles and litter maintenance in the surrounding
area, signage, meet building code requirements, and adhering to the County health requirements, the
operation will be compatible with the character of the commercial area.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative
action should be taken by resolution. The reasons for any action should be clearly stated for the record.
At the public hearing the following conditions should be considered (conditions from the previous
conditional use permit are in italics, changes to these are shown in standard type face):
that this business location, occupied by a specialty shop with 434 SF of on-site seating may be
replaced by another specialty shop at the same location within the same or less square footage
subject to the conditions of the existing conditional use permit, or shall be allowed to change to
a different type of food establishment with a new conditional use permit; and that if this specialty
shop food establishment is changed to any other type of food establishment classification, this site
shall not return to specialty shop use;
2. that the 434 SF area of on-site seating of the specialty shop may be enlarged only by an amendment
to this conditional use permit;
3. that an amendment to this conditional use permit shall be required for delivery of prepared food
from this premise;
4. that there shall be no food sales allowed at this location from a window or from any opening within
10' of the property line;
5. that if this site is changed from any food establishment use to retail or any other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become void;
6. that the project shall be built as shown on the plans submitted to the Planning Department and date
stamped February 1, 1999, Sheets A0.1, A2.1 and ID.1, with a business site of 1529 SF and
customer seating area of 434 SF;
7. that the applicant shall install and maintain daily, or more often if necessary, the trash
receptacle(s) of the streetscape design as approved by the City to be located inside the door, along
Burlingame Avenue at the front of the store, and/or at locations as required and approved by the
City Engineer and the Fire Department;
8. that the food establishment with take-out service may not be open for business except during the
hours of 10:30A.M. to 10:00 P.M. daily, with no more than 10 employees on site at any one time
including the manager, and that the number of customers and employees on this site shall never
exceed fzre department occupancy requirements;
9. that the applicant shall remove once a day, or more frequently if determined to be necessary by the
City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs, in the gutter,

and irt planters, in front of the store along Burlingame Avenue, and within 50' on each side of the
store front, and shall arrange and pay for additional BFI pick up service to dispose of trash in cans
including city cans adjacent to the site which are required to be provided on site in the public right-
of-way or if necessary, as determined by the City Engineer; and
10. than any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition
as amended by the City of Burlingame or the California Building and Fire Codes in effect at the
time of any future application.

Dear Mr. Valerio,
Since therc was no appeal to or suspension by the City Council, the March 8, 1999 Planning
Commission approval of your conditional use permit for take-out services became effective March
15, 1999. This application was to allow expansion of seating area in an existing food establishment
at 1318 Burlingame Avenue, zoned C-1, Subarea A.
The March 8, 1999 minutes of the Planning Commission state your application was approved with
the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped February 1, 1999, Sheets A0.1, A2.1 and ID.1, with a business site of
1529 SF and customer seating area of 434 SF;
2. that the applicant shall maintain daily, or more often if necessary, the trash receptacle(s) of
the streetscape design as approved by the City to be located inside the door, along
Burlingame Avenue at the front of the store, and/or at locations as required and approved by
the City Engineer and the Fire Department;
3. that the food establishment with take-out servi�e may not be open for business except during
the hours of 11:00 A.M. to 10:00 P.M. daily, with no more than 6 employees on site at any
one time including the manager, and that the number of customers and employees on this site
shall never exceed fire department occupancy requirements;
4. that the applicant shall remove once a day, or more frequently if determined to be necessary
by the City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs,
in the gutter, and in planters, in front of the store along Burlingame Avenue, and within 50'
on each side of the store front, and shall arrange and pay for additional BFI pick up service
to dispose of trash in cans provided on site or on street if necessary as determined by the

5. that any improvements for the use shall meet all California Building and Fire Codes, 1995
Edition as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be
issued. One extension of up to one year may be considered by the Planning Commission if
application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure
Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must
do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or
federal law.

reviewed criteria and Planning Department comments. Five conditions were suggested for
consideration. There were no questions of staff.
Chauman Deal opened the public hearing. Nick Valerio architect for World Wrapps and Keith
Cox, a founder of the company, spoke. This was the second store in the chain, expected to
appeal more to a fast food crowd, find from experience customers want to eat on-site; want to
add seating so more customers can eat on-site, want to improve the ambience in the dining room
by removing the tall stools and tables; improve the kitchen efficiency, it is too far between
stations now, this allows the increase in the seating area; will keep the two tables on the street,
have an encroachment permit for them; there is a miss print in the staff report they propose 20
to 22 tables with 44 seats. Want a higher quality �level, better than fast food, more like fast
casual; want to upgrade design to match quality of food; willing to spend money to improve the
dining experience, the increase in seating can focus on desire to eat in. Commissioners asked:
have you remodeled other stores, this is second, first is in Palo Alto will be finished on Friday;
how has your traffic changed in the past two years, gone down lost about 30% since the iirst
year; was hooked on your product at your Marina store in San Francisco, lost my business after
three visits, the level of the food was not the same. The public hearing was closed.

C. Key noted that she had no problem with the expansion when she saw the direction they were
coming from, to make it less fast food, need to build business base and meet customer need via
research; on this basis she moved approval, by resolution, with the five conditions in the staff

Reference staff report, 1.22.96, with attachments. CP Monroe summarized the request and
reviewed criteria and Planning Department comments. Five conditions were suggested for
consideration. CP noted for the record, the applicant submitted a revised projection of the
number of employees and customers. Restaurant is now open. They now have some experience
to judge their required staffing and felt 10 employees and 80 customers on site at any time would
better represent their business.
Commission asked if we have a criteria for percentage of take-out at restaurants to require a
permit. CP answered no. They asked that the bussing of tables and chairs on the sidewalk be
included in the conditions. The continuance from the January 8, meeting was explained; the
commissioners wanted to emphasize the concern about litter up and down the street.
Chm. Jacobs opened the public hearing. Matt Blair, 2107 Broadway, San Francisco,
representing World Wrapps, was present to answer questions. There are 32 seats, in a peak
hour there is a turn over of about 80 people. The percentage of take-out is 30-40 percent. He
assured the commission they will be more than willing to purchase whatever trash receptacle the
city deems necessary and they are concerned about the liter and the environment.
Commissioners noted this is a discretionary permit and there is no code criteria. Other take-out
permits have been granted therefore must be equitable. There were no other comments and the
public hearing was closed.
C. Mink noted this application will not be detrimental to the vicinity and the operation of the
use is in a manner compatible with the existing uses in the general area. He then moved

approval of this project with the following amendeti conditions; 1) that the project shall be built
as shown on the plans submitted to the Planning Department and date stamped December 1,

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for �
conditional use nermit amendment for an existin� food establishment classified a a S ecialty Shop Food
Establishment at 1318 Burlin�ame Avenue. zoned G1 Subarea A, Burlin�ame Avenue C�mmercial Area
APN: 029-152-200: Shirlev Kin� Tr 320 Pinehill Road, Hillsborou�h, CA 94010, pro e�rtv owner;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
January 10, 2000, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and� DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and Categorical Exemption, per
Article 19. 15301 - Existing Facilities, Class 1, operation of existing private structures involving negligible
or no expansion of use beyond that previously existing is hereby approved.
2. Said conditional use permit amendment is approved, subject to the conditions set forth in
Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

1. that this business location, occupied by a specialty shop with 434 SF of on-site seating may
be replaced by another specialty shop at the same location within the same or less square
footage subject to the conditions of the existing conditional use permit, or shall be allowed
to change to a different type of food establishment with a new conditional use permit; and
that if this specialty shop food establishment is changed to any other type of food
establishment classification, this site shall not return to specialty shop use;
2. that the 434 SF area of on-site seating of the specialty shop may be enlarged only by an
amendment to this conditional use permit;
3. that an amendment to this conditional use permit shall be required for delivery of prepared
food from this premise;
4. that there shall be no food sales allowed at this location from a window or from any opening
within 10' of the property line;
5. that if this site is changed from any food establishment use to retail or any other use, a food
establishment shall not be replaced on this site and this conditional use permit shall become
void;
6. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped February 1, 1999, Sheets A0.1, A2.1 and ID.1, with a business site of
1529 SF and customer seating area of 434 SF;
7. that the applicant shall install and maintain daily, or more often if necessary, the trash
receptacle(s) of the streetscape design as approved by the City to be located inside the door,
along Burlingame Avenue at the front of the store, and/or at locations as required and
approved by the City Engineer and the Fire Department;
8. that the food establishment with take-out service may not be open for business except during
the hours of 10:30 A.M. to 10:00 P.M. daily, with no more than 10 employees on site at
any one time including the manager, and that the number of customers and employees on
this site shall never exceed fire department occupancy requirements;
9. that the applicant shall remove once a day, or more frequently if determined to be necessary
by the City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs,
in the gutter, and in planters, in front of the store along Burlingame Avenue, and within 50'
on each side of the store front, and shall arrange and pay for additional BFI pick up service
to dispose of trash in cans including city cans adjacent to the site which are required to be
provided on site in the public right-of-way or if necessary, as determined by the City
Engineer; and
