(650) 558-7200 January 20, 2000 Shirley King Tr 320 Pinehill Road Hillsborough, CA 94010 Dear Ms. King, Since there was no appeal to or suspension by the City Council, the January 10, 2000 Planning Commission approval of your conditional use permit amendment application became effective January 19, 2000. This application was for an existing food establishment classified as a Specialty Shop Food Establishment in the Burlingame Avenue commercial area at 1318 Burlingame Avenue, zoned C-1, Subarea A, Burlingame Avenue Commercial Area. The January 10, 2000 minutes of the Planning Commission state your application was approved with the following conditions: that this business location, occupied by a specialty shop with 434 SF of on-site seating may be replaced by another specialty shop at the same location within the same or less square footage subject to the conditions of the existing conditional use permit, or shall be allowed to change to a different type of food establishment with a new conditional use permit; and that if this specialty shop food establishment is changed to any other type of food establishment classification, this site shall not return to specialty shop use; 2. that the 434 SF area of on-site seating of the specialty shop may be enlarged only by an amendment to this conditional use permit; 3. that an amendment to this conditional use permit shall be required for delivery of prepared food from this premise; 4. that there shall be no food sales allowed at this location from a window or from any opening within 10' of the property line; 5. that if this site is changed from any food establishment use to retail or any other use, a food establishment shall not be replaced on this site and this conditional use permit shall become void; 6. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 1, 1999, Sheets A0.1, A2.1 and ID.1, with a business site of 1529 SF and customer seating area of 434 SF; January 20, 2000 1318 Burlingame Avenue page -2- 7. that the applicant shall install and maintain daily, or more often if necessary, the trash receptacle(s) of the streetscape design as approved by the City to be located inside the door, along Burlingame Avenue at the front of the store, and/or at locations as required and approved by the City Engineer and the Fire Department; 8. that the food establishment with take-out service may not be open for business except during the hours of 10:30 A.M. to 10:00 P.M. daily, with no more than 10 employees on site at any one time including the manager, and that the number of customers and employees on this site shall never exceed fire department occupancy requirements; 9. that the applicant shall remove once a day, or more frequently if determined to be necessary by the City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs, in the gutter, and in planters, in front of the store along Burlingame Avenue, and within 50' on each side of the store front, and shall arrange and pay for additional BFI pick up service to dispose of trash in cans including city cans adjacent to the site which are required to be provided on site in the public right-of-way or if necessary, as determined by the City Engineer; and 10. than any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame or the California Building and Fire Codes in effect at the time of any future application. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
